SR-507-000 (62)~~- ~ c~tY or Santa Monica City Council Report City Council Meeting: November 14, 2006 Agenda Item: ~ To: Mayor and City Council From: Craig Perkins, Director Environmental & Public Works Management Subject: Results of the Streetlight Assessment District Election Recommended Action It is recommended that the City Council: 1. accept the attached certified results of the streetlight assessment district election as tabulated by the City Clerk; 2. approve the formation of an assessment district on Georgina Avenue from 4tn Street to 7th Street, based upon the results of the election in conformance with Proposition 218; and 3. adopt the attached Resolution to assess property owners for the construction cost of streetlight improvements, and issue bonds as security for unpaid assessments in conformance with Proposition 218. Executive Summary On October 10, 2006, City Council held a public hearing for the formation of streetlight assessment districts on 30th Street, from Pico Boulevard to Pearl Street (District "A") and Georgina Avenue, from 4t" Street to 7th Street (District "B"). Ballots were received and accepted up to the end of the public hearing. The City Clerk tallied the ballots and 1 has certified the results of the vote indicating that District "A" failed and District "B" passed. The total estimated project cost is $231,000, which includes the City's portion of $115,500. In order to expedite the project, currently available funds from other street lighting accounts will be used to proceed with the project design. Discussion On October 10, 2006, City Council held a public hearing for the Formation of Streetlight Assessment Districts in conformance with Proposition 218 for the following streets: District "A" 30t" Street District "B" Georgina Avenue - Pico Boulevard to Pearl Street - 4th Street to 7th Street Ballots were taffied proportional to the financiaf obligation of each affected property. The City Clerk received ballots and kept them secured until this Council meeting. The results are as follows: DISTRICT LOCATION RESULT A 30t" Street - Pico Boulevard to Pearl Street Failed B Georgina Avenue - 4th Street to 7th Street Passed City staff will meet with the residents at the beginning and at various stages of the design process. The City will solicit competitive bids for the project and Council will award a contract to the best bidder. Property owners may pay for the improvements in 2 full after construction is completed, or they may choose to pay the bondholder in installments over a ten-year period at an interest rate of 8%. Public Outreach A public meeting was held on May 3, 2006 at the Santa Monica Main Library to discuss the type, location, and approximate cost of the street lights for these districts. Consistent with Council policy, adopted January 23, 2001, to only install ornamental post-top style street lights on residential streets, residents were provided the option to choose from ornamental post-top type poles: the Aegean and Corsican concrete poles (manufactured by Ameron International) and the New York metal pole (manufactured by Antique Street Lamps). Residents on Georgina Avenue (District "B") selected the Aegean concrete pole. Attachment 3 shows all three styles. Staff will continue to host public meetings to encourage community participation, present the project goals, and solicit comments. Public input will be reflected in the final concept design presented to Council. Budget/Financial Impact The proposed total cost breakdown for the project is as follows: Estimated property owner assessments $ 115,500 Estimated City portion $ 115,500 Total project estimate $ 231,000 3 This estimated cost includes engineering design, construction, construction management and administrative costs such as staff time for public notifications, advertisements, project management, invoicing, and bond administration. The remaining estimated costs for the project ($115,500) would be paid through property owner assessments. Assessments will be paid upon completion of the work and will be held in a Trust Account pending payment to the Contractor. Bonds are issued for any unpaid assessments. Bond proceeds are paid to the Contractor or assignee, and the property owner(s) then reimburse the bond holder(s) over time. Financial Assistance Federal Community Development Block Grant (CDBG) funds are available to assist low- to-moderate income households with the costs of the streetlight assessment. Based on current guidelines property owners may qualify for financial assistance to pay the assessment cost if their annual income is less than $38,800 for a family of one person, $44,350 for a two-person family, or $49,900 for a three-person family. The funds are provided on a first-come-first-serve basis to qualifying property owners.
