DISCUSSION At its meeting on August 5, 1992, the City Council directed staff to prepare a resolution exempting motorists displaying a disabled placard from the "permit only" restrictions in the downtown parking structures. The attached resolution has been prepared and is presented to the Council for consideration. Currently, ground floor parking areas of the parking structures are restricted to permit parking only between the hours of 7:00 am and 7:00 pm, Monday through Saturday. Although by law motorists displaying a disabled placard are exempt from many parking restrictions, the city's administrative policy does not recognize an exemption in the permit only areas of the 6 ....A "L J,.i f...... \.~. n' .... .+ buildings which have been empty for six months or more to meet current physical development standards (i.e., a residential building with sideyards one foot short of current requirements having to be demolished or remodeled to meet current standards where such building has been unoccupied for six months or more). Following through with the appellant's and city Attorney's interpretation would result in potentially devastating consequences to all types of land uses in the City, including housing. For example, a single family home with less than two parking spaces which was unoccupied for six months or more could not be reoccupied without current code parking being provided, or an apartment in a residential building with inadequate parking which was empty for six months or more could not be occupied unless code parking was provided for the building. similarly, if a retail space in a building lacking full code parking was empty for six months or more, the space could not be leased to any business unless code parking were provided. Particularly in a difficult economy, it is not unusual for residential or other types of properties to be unoccupied for six months or more while an appropriate buyer or tenant is sought. The results of following the City Attorney's and appellant's interpretation on this issue would likely reduce the availability of housing as well as places where business could be conducted, in addition to having significant adverse impacts on property owners, and potentially the city itself through reductions in revenues from - 12 - . . . RESOLUTION NO. 8517 (CCS) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA PERMITTING MOTORISTS DISPLAYING A DISABLED PLACARD TO PARK IN THE PERMIT ONLY AREAS OF THE DOWNTOWN PARKING STRUCTURES THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Santa Monica does hereby resolve that motorists displaying a disabled placard shall be exempt from the permit parking only restrictions in the downtown parking structures. SECTION 2. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
