Resolution Authorizing the city Manager to Execute An
Amendment to the Memorandum of Understanding with the
Santa Monica Police Officers' Association (SMPOA)
FROM:
INTRODUCTION
This report requests adoption of a Resolution authorizing the
city Manager to execute an amendment to the Memorandum of
Understanding (MOU) with the Santa Monica Police Officers'
Association (SMPOA).
BACKGROUND
In July,
1987,
the City entered into a Memorandum of
Understanding (MOU) with the Santa Monica Police Officers'
Association (SMPOA). In that MOU, there is a provision to set up
a "cafeteria plan" in conjunction with the offering of the PERS
Health Program to the SMPOA members (which was to cost the City
no more than if the SMPOA had remained in the ci ty' s health
plan).
A cafeteria plan requires the employer to give the
employee a choice in how s/he receives the benefit value; one of
the options must be cash. If the employee elects to receive cash
in lieu of payment of health insurance premiums with pre-tax
dollars, that amount is considered to be compensation and the

city must then pay an additional PERS contribution on that
amount.
In order to comply with section 125 of the IRS Code (governing
cafeteria plans) and to have the employee pay any additional PERS
costs which are attendant upon the employees election to receive
cash, representatives of both the City and the SMPOA have agreed
to amend the existing MOU to clarify the intent of the parties in
offering the PERS Health Plan.
BUDGET/FINANCIAL IMPACT
There is no additional cost attributable to this amendment.
RECOMMENDATIONS
It is recommended that the City Council adopt the attached
Resolution authorizing the City Manager to execute an amendment
to the Memorandum of Understanding with the Santa Monica Police
Officers' Association.
