TO: Mayor and City council FROM: City Staff SUBJECT: Public Hearing on the Intention to Abate Weeds and Award of Contract Introduction This report requests that the City Council hold a public hearing on the City's intent to abate weeds and to award a contract to Apple Tractor Service in the amount of $37,060.00. Background On January 27, 1987, the City Council adopted a Resolution of Intention declaring certain weeds growing upon certain lands within the city to be a public nuisance. All costs of the work done on private property will be assessed at one hundred percent of the cost with an administrative charge of $25.00 per lot assessed to the property owner. The resolution also set a public hearing for March 24, 1987, at which time any protest may be heard. A Notice Inviting Bids was published on February 2, 3 and 4, 1987, in accordance with legal requirements. Bid proposals were prepared and mailed to three contractors. Two bids were received and opened publicly on March 3,1987, by the Deputy City Clerk. The bids were as follows: Apple's Tractor Service $37,060.00 Gary's Lot Cleaning $28,540.00 Staff recommends that the low bid submitted by Gary's Lot 7-13 - 1 - MN< 2 it 1387 GS:SES:KR:sdg Santa Monica, California Council Meeting: March 24, 1987 Cleaning be rejected as the bid was incomplete due to the omission of the required bid bond. The bidder has taken no steps to cure this deficiency. In addition, the bid was non-responsive in that the bidder gave two bids, one without the required performance bond and one with the required performance bond. The bid documents requested a single bid and did not permit bidders to change the terms of the bid documents. BUdget/Financial Impact Appropriation authority is available in Maintenance Management Account No. 01-500-481-000-642 in the amount of $37,246.00. Recommendation It is recommended that the City Council: l. Open the public hearing and acknowledge any protests; 2 . Close the public hearing; 3 . Reject the low bid submitted by Gary's Lot Cleaning; and 4. Award the contract to Apple Tractor Service in the amount of $37,060.00.
