SR-603-005 (3) Council Meeting: February 14, 2006 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Resolution Authorizing the City Manager to Execute a Memorandum of Understanding with the Public Attorneys Union INTRODUCTION This report requests that Council adopt the attached Resolution authorizing the City Manager to execute a Memorandum of Understanding (MOU) with the Public Attorneys Union. BACKGROUND The current Memorandum of Understanding (MOU) with the Public Attorneys Union (PAU) expired on June 30, 2005. Per the terms and conditions of that MOU, negotiations with PAU for a successor MOU commenced and resulted in a new agreement that has been ratified by the membership of PAU. This agreement is a five-year contract from July 1, 2005 through June 30, 2010. The agreement provides for a cost of living increase of 4.0% for FY2005-2006; provides for cost of living increases for FY2006-2007, FY2007-2008, FY2008-2009 and FY2009-2010 based on the Consumer Price Index (CPI) for Urban Wage Earners and Clerical Workers in the Los Angeles-Riverside-Orange Country area, with a 2% minimum and a 4% 1 maximum; provides for an 8.98% equity adjustment to the Deputy Attorney III salary range for FY2005-2006 to bring the salary for the job classification of Deputy Attorney III in line with the salary paid by comparison cities; provides that movement from Deputy Attorney I to Deputy Attorney II and from Deputy Attorney II to Deputy Attorney III shall be at the discretion of the City Attorney and will be based on job performance; provides that salary step increases within the salary range shall be at the discretion of the City attorney and will be based on job performance (i.e., there will be no automatic salary step increases); and makes minor non-economic changes. BUDGET/FINANCIAL IMPACT The total cost of the new contract terms for FY2005-2006 is $497,000. Provision was made in the FY2005-2006 budget to accommodate the results of negotiations with bargaining units and no appropriation is necessary. RECOMMENDATION It is recommended that Council adopt the attached Resolution authorizing the City Manager to execute the new Memorandum of Understanding with the Public Attorneys Union.
