(north side) between Berkeley Court and Centinela Avenue, and
Amending City Council Resolution 9344 CCS
Introduction
This report recommends the creation of Preferential Parking Zone S to include the
following six residential blocks: 1) Berkeley Street between Colorado and Pennsylvania
Avenues, 2) Franklin Street between Colorado and Nebraska Avenues, and 3)
Pennsylvania Avenue between Stanford Court and Centinela Avenue. It will also
include some frontage on the north side of Nebraska Avenue that is adjacent to
residential properties, Regulations would be implemented immediately on five blocks
where residents have submitted qualifying petitions. Santa Monica cannot create
preferential parking on Centinela Avenue proper because this street belongs to the City
of Los Angeles,
Backqround
This is a low-density multi-family neighborhood that also includes some single family
homes, It is directly north and east of the Light Manufacturing and Studio District
(LMSD) Zone, and south of Preferential Parking Zone W, The commercial area
located in the LMSD is a mixture of businesses ranging from small craft enterprises to

employment centers for companies such as Adelphia Communications, Sempra Energy
Corporation, Pioneer Magnetics, and Rainbo Records and Cassettes,
Existing Preferential Parking Zone W is bounded by Colorado Avenue on the south,
Stanford Street on the west, Santa Monica Boulevard on the north, and Centinela
Avenue on the east, and restrictions vary by block. East of Berkeley Street restrictions
are: "No parking 7am-midnight daily, except by permit." For Berkeley Street and west,
restrictions are: "Two hour parking 8am-5pm Monday-Friday, and No parking any other
time or day, except by permit." This zone was created in July 1999, and although the
pre-approved blocks have been eligible for over five years, only one, the 3100 block
between Berkeley and Franklin Streets, is now in the process of petitioning for
preferential parking.
Residents of five blocks in what would be a new Zone S have now completed and
submitted qualifying petitions for preferential parking:
. 1700 block of Franklin between Pennsylvania and Nebraska (June 2003)
(Includes curb on north side of Nebraska Ave, between Berkeley Court and Franklin
adjacent to a single family residence with a Franklin address)
. 3000/3100 blocks of Pennsylvania between Stanford and Franklin (August 2003)
. 1600 block of Berkeley between Colorado and Pennsylvania (January 2005)
· 3200 block of Pennsylvania between Franklin and Centinela (March 2005)
The sixth block in this area (1600 block of Franklin between Colorado and
Pennsylvania) has submitted a petition, which is currently at 46 percent of the 67
percent required to qualify. (See Attachment B: Vicinity Map)

Commercial Parkinq Issues
In and adjacent to the LMSD, on-street parking is utilized to a high degree by
employees of businesses in this district. Many businesses have inadequate parking on-
site, Metered parking (both long and short term) exists on about 50 percent of
commercial-adjacent Nebraska Avenue frontage between Stewart Street and Centinela
Avenue, Most of the business-adjacent street parking on Stanford Street between
Colorado and Nebraska Avenues, and on Berkeley Street between Pennsylvania and
Nebraska Avenues is currently unregulated,
Study Findinqs
The area roughly bounded by Colorado Avenue, Stanford Street, Centinela Avenue and
Nebraska Avenue was studied in June 2004 on a weekday and on a Saturday to
determine parking occupancies and usage, A summary of peak parking occupancies is
included as Attachment C, The study demonstrates that parking occupancies are fairly
high (greater than 75 percent) on all the petitioning blocks. Average occupancies on
the residential blocks in the study area range from 71 percent to 86 percent. Peak
occupancies range from 88 percent to 107 percent (more parked cars than there are
parking spaces) and generally occur at 7am and then again around noon to 2pm,
Saturday midday occupancies are much lower ranging from 32 to 70 percent.
Community Input
Residents, businesses and others in the study area were invited to attend a meeting to
discuss preferential parking in November 2004. Residents at the meeting strongly

wanted preferential parking, but there were varying opinions on the types of restrictions
that they wanted, Some residents wanted restrictions on weekdays only during prime
work hours while others wanted restrictions 24 hours a day/7 days a week, Residents
generally agreed that they wanted "No parking" versus "Two-hour parking", This is
consistent the attitudes of residents of other preferential parking zones in the area and
typical of areas affected by large employers/institutions, Comments from the
neighborhood meeting and other correspondence received are summarized in
Attachment D,
One owner of a small business in the area was concerned about the lack of available
parking to support his business, A significant amount of parking will be unaffected by
preferential parking regulations as that parking is directly adjacent to business and
commercial uses in this area, After the meeting, larger businesses in the area were
contacted by telephone to be sure they were aware of the residential petition efforts and
the general preferential parking process underway, Businesses in general were
concerned about parking for their employees,
Since there were such disparate opinions regarding restrictions, a survey was sent to all
residents, The survey asked what type of restrictions residents would prefer on: 1)
Monday-Friday, 2) Saturday and 3) Sunday, Each day-of-week section had five choices:
1) No parking 7am-6pm, 2) No parking 7am-9pm, 3) Two-hour parking 7am-6pm, 4)
Two-hour parking 7am-9pm and 5) No restrictions, The results of the survey are shown
in the following table:

Overall, the survey yielded a 32 percent return, For Monday-Friday, 59 percent wanted
to have "no parking, except by permit" restrictions, Both the survey and results are
included with Attachment E.
A number of residents provided comments on their surveys about street cleaning times,
Adjacent to commercial properties streets are cleaned on Sunday night from 11 pm-
1am, On Mondays from 9am-11am streets adjacent to residences are cleaned,
Residents stated that the two cleaning times so close together created challenges with
street parking, Transportation management staff will work with the Solid Waste Division
to see if street cleaning can be better coordinated,
Recommendations for Zone S
The entire area is recommended to be pre-approved for preferential parking so that any
block-to-block spillover associated with the regulations will be incorporated within the
proposed zone, To alleviate the parking pressure on residential streets, staff
recommends that the following regulations be approved adjacent to residential
properties:

1) No parking between 7:00 a,m, and 6:00 p,m. Monday through Friday, except by
permit on:
. Franklin Street between Colorado and Nebraska Avenues,
. Pennsylvania Avenue between Stanford Court and Centinela Avenue,
. Berkeley Street between Colorado and Pennsylvania Avenues, and
. Nebraska Avenue (north side only) between Berkeley Court and Centinela
Avenue,
Concern of Baha'i Center
The Santa Monica Baha'i Center, located at 3102 Colorado Avenue, is adjacent to the
proposed zone, A representative of the Baha'i Center, Perry Roshan-Zamir, has
expressed concern that creating a preferential parking zone in the area would hinder
members access to the Baha'i Center and could thereby violate members' rights under
the federal Religious Land Use and Institutionalized Persons Act of 2000 ("RLUIPA"),
RLUIPA prohibits government from implementing a land use regulation which imposes a
"substantial burden" on "religious exercise" unless there exists a compelling
governmental interest and the burden is the least restrictive means of satisfying the
governmental interest. Legal staff has evaluated this claim and assessed the law and
the facts, The proposed zone would not affect parking on the Baha'i Center property,
street parking directly adjacent to the property and street parking in the nearby light
industrial area to the south, Moreover, parking within the proposed zone would also be
available without restriction after 6 p,m, Monday through Friday and at all hours on
Saturday and Sunday, Based upon the continued availability of parking and other
considerations, it appears unlikely that a court would conclude that the creation of this
preferential parking zone constitutes a substantial burden in violation of RLUIPA.

BudqetlFiscallmpact
It is estimated that area residents in the proposed zone will purchase approximately 300
permits at $15,00 per permit. This will generate approximately $4,500 in revenue in FY
05/06 and in subsequent years in account 01415.400290,
CEQA Analysis
The proposed project has been determined to be categorically exempt from the
provisions of the California Environmental Quality Act (CEQA), pursuant to Article 19,
Section 15301 (c) which was recently amended to define Class 1 exempt projects in the
following way: "Class 1 consists of the operation, repair, maintenance, permitting,
leasing, licensing, or minor alteration of existing public or private structures, facilities,
mechanical equipment, or topographical features, involving little or no expansion of use
beyond that existing at the time of the lead agency's determination, , ,II This exemption
lists as an example of "existing facilities:" "(c) Existing highways and streets, sidewalks,
gutters, bicycle and pedestrian trails, and similar facilities," Preferential parking zones
involve only the issuance of permits for the use of an existing public street and include
negligible or no expansion of this existing use,
Recommendations
It is recommended that the City Council:
1, Approve the attached Resolution creating Preferential Parking Zone Sand
amending Resolution 9344 CCS (Resolution of the City Council of the City of

Santa Monica Re-Establishing Various Preferential Parking Zones) by replacing
Exhibit A.
2, Approve the revenue budget adjustment outlined in this report,

. Baha'i Center creates parking challenges Fri, night for 1600 block of Berkeley
. Is Baha'i Center using their parking lot?
. Factory hours are 7am-4:30pm; does Pioneer magnetics open at 6am?
. Sun, night street cleaning (11 pm-1 am) is problem for residents on Nebraska
. Will New Roads School be a problem in the future?
. Speeders on Colorado are a problem
. 1700 Franklin: north end has no problems finding parking
. 1700 Franklin: south end can't find parking
. 1744 Franklin: 6am-5pm-workers are waiting for residents to leave
. Workers nap in vehicles
. 2 hr regulations won't work if workers swap spots
. Pioneer Mag used to rent parking lot that Volkswagon/Lexus uses
. Variance was granted to New Roads 6 years ago?
. Employees and students are greater problem than customers
. Baha'i and other churches create parking challenges
. Suggestion: have same regulations as on Franklin north of Colorado
. Make regulations now that consider potential future parking issues
. Suggestion: regulations 6am to midnight
. School will have weekend events

Preferential Parking Survey
Last month, the City of Santa Monica held a meeting with neighbors to discuss preferential parking in
your neighborhood, Transportation Management would now like further help in determining what
types of regulations you feel would best meet your area's needs, We would like to recommend
regulations that are clear and useful without negatively affecting neighborhood quality of life,
As always, preferential parking will be implemented only on blocks that have submitted completed
petitions after the City Council approves any restrictions, Regulations can be implemented on
additional blocks as complete petitions are received, Only residents would be able to purchase
permits, which cost $15 each per year,
