SR-417-007 (37) EPWM:CC:AA::DB:JC:\Staff Reports In Process\2_08\CC 1933.doc City Council Meeting: February 8, 2005 Santa Monica, California TO: Mayor and City Council Chairperson and Redevelopment Agency FROM: City Staff SUBJECT: Construction Related Contracts for the Seismic Retrofit of Parking Structure 5; Redevelopment Agency Funding of Seismic Retrofit of Parking Structure 5; and Adoption of Resolutions Finding that the Projects are of Benefit to the Earthquake Recovery Redevelopment Project Area Introduction This report recommends that the City Council award a construction contract for seismic retrofit of Parking Structure 5 to the best bidder, West Valley Investment Group, in an amount not to exceed $1,081,500 and approve a contingency amount of $108,150 (10%). It is also recommended that Council authorize the City Manager to negotiate a first modification to Contract 8197 (CCS) with Black & Veatch for deputy inspection and testing, noise monitoring, and construction management services in an amount not to exceed $210,000. This report also recommends that the City Council and Redevelopment Agency authorize the City Manager and Executive Director to execute a Cooperation Agreement between the two entities for payment of the costs associated with the seismic retrofit for Parking Structure 5 and adopt resolutions finding that the seismic retrofit of Parking Structures 5 benefits the Earthquake Recovery Redevelopment Project area. 1 This project will be financed with the remaining Grant Acceleration Program (GAP) Federal Emergency Management Agency (FEMA) funds designated for Parking Structure 5 and Redevelopment Agency (RDA) funds. Background On April 9, 2002, City Council conceptually approved the Downtown Parking Task Force?s recommended strategic plan to retrofit Parking Structures 2, 4, and 5; to rebuild Parking Structures 1, 3,and 6; and to add additional parking resources in the Downtown area. Parking Structure 5 is located on the west side of Fourth Street, between Broadway and Santa Monica Boulevard, and is the largest in a series of parking structures in the Downtown Area to be seismically retrofitted. FEMA partially funded Parking Structure 5 in the original amount of approximately $580,000 and $500,000 of those funds were utilized for design and miscellaneous expenses related to Parking Structure 5. Remaining FEMA funds in the amount of $80,000 may be lost if not spent this calendar year and the entire grant is jeopardized if the project is not completed by December 31, 2005. Discussion The seismic retrofit of Parking Structures 5, and subsequently of Parking Structures 2 and 4, will include strengthening the existing shear walls and foundations. The projects also include Americans with Disabilities Act (ADA) upgrade work. Work will be scheduled to maximize access to spaces within the structure during construction activity. The work on Parking Structure 5 is anticipated to commence in March 2005 and 2 conclude by October 2005. The seismic retrofit of Parking Structures 2 and 4 is anticipated to follow in Fiscal Years 2006 and 2007. Construction Contract for Parking Structure 5 A Notice Inviting Bids for seismic retrofit of Parking Structure 5 was published in the Los Angeles Times on November 13 and 18, 2004. The bid documents were sent to six construction journals. Twenty contractors and potential subcontractors requested the bidding documents. The City Clerk?s office received five sealed bids, which were publicly opened and read aloud on December 15, 2004 by the Deputy City Clerk. The bid results were as follows: Contractor Amount West Valley Investment Group $1,081,500 G.B. Cook, Inc. $1,138,125 TB Penick & Sons, Inc. $1,373,250 Alfa 26 Construction Company $1,663,502 Trimax Construction Corp $1,880,000 City Engineer?s Estimate $1,150,000 The best bidder, West Valley Investment Group supplied the City with names of recent similar projects. These projects included work on various seismic retrofit projects for UCLA and the Los Angeles County Department of Public Works. All contacts reported that the firm?s work was excellent. The State Contractor?s License Board verified that its license and the subcontractors licenses are current and in good standing. The Center for Contract Compliance was contacted and reported that there were no labor compliance complaints on file for West Valley Investment Group. 3 Construction Management Services for Parking Structure 5 In October 2001, the City requested statements of qualifications for construction management services for various construction projects in the City. Five firms submitted qualifications. On March 25, 2003, Council awarded Contract 8197 (CCS) to Black & Veatch for construction management services for Parking Structures 7 and 8 in the amount of $557,750. In addition to this contract, Black & Veatch has also performed satisfactory service for the City on projects including the Beach Improvement Group (Palisades Park and South Beach), Transit Mall, and various sewer projects. Considering its recent experience with the seismic retrofit of Parking Structures 7 and 8, staff recommends that a first modification to this contract be negotiated with Black & Veatch for deputy inspection and testing, noise monitoring, and construction management services for Parking Structure 5 in the amount of $210,000. With this modification, the new contract amount will be $767,750. Redevelopment Considerations for Parking Structure 5 The Redevelopment Agency, as the owner of Parking Structure 5, is authorized by Health and Safety Code Section 33400 to maintain, manage, and repair the structure. The Cooperation Agreement delegates to the City the Agency?s authority to carry out the seismic retrofit of Parking Structure 5 and provides for the Agency?s funding of those costs not be paid with FEMA funds. To use redevelopment funds for the seismic retrofit of Parking Structure 5 the City Council and Redevelopment Agency must make the appropriate findings, as required by 4 Health and Safety Code Section 33445. The attached Resolutions would determine that the use of these funds is of benefit to the Earthquake Recovery Redevelopment Project area, no other reasonable means of financing the improvements are available, the project will assist in earthquake recovery efforts and eliminating one or more blighting conditions in the Earthquake Recovery Redevelopment Project area, and the project is consistent with the Agency?s Five-Year Implementation Plan. Authorize the City Engineer to issue any necessary change orders to complete additional work within budget authority; 4. Authorize the City Manager to execute a Cooperation Agreement between the City and the Redevelopment Agency for payment of the costs associated with the seismic retrofit of Parking Structure 5; and 5. Adopt a Resolution finding that the seismic retrofit of Parking Structure 5 is of benefit to the Earthquake Recovery Redevelopment Project area. Staff recommends that the Redevelopment Agency: 1. Authorize the Executive Director to execute a Cooperation Agreement between the City and the Redevelopment Agency for payment of the costs associated with the seismic retrofit of Parking Structure 5; and 2. Adopt a Resolution finding that the seismic retrofit of Parking Structure 5 is of benefit to the Earthquake Recovery Redevelopment Project area.
