SR-502-008 (3) EPWM: CP: AA: RDB: H:\Staff Reports In Process\11_23\CCMISC-AshlandAve.DOC City Council Meeting: November 23, 2004 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT:Adoption of a Resolution Authorizing the Los Angeles County Flood Control District to Construct a Project at Ashland Avenue and Neilson Way Introduction This report recommends that the City Council adopt the attached resolution authorizing the Los Angeles County Flood Control District (?District?) to construct a low-flow storm drain diversion in Ashland Avenue near Neilson Way. Background Council adopted the City of Santa Monica?s Sustainable City Program in September 1994 with the resolve that City actions that affect the natural environment must not jeopardize the prospects of future generations. In support of this plan, the City has developed and implemented best management practices (BMP) to reduce urban runoff entering Santa Monica Bay within the City, including contracting for the design of urban runoff pollution devices for the Centinela, Montana and Wilshire storm drains, completing the Santa Monica Urban Runoff Recycling Facility and installing dry wells in Clover Park and at the Big Blue Bus facility. The project proposed by the District will assist the City in meeting the goals of the Sustainable City Program and contribute to regional water quality improvement. 1 Discussion The District proposes to construct an underground dry weather urban runoff diversion within the public right-of-way in Ashland Avenue near Neilson Way. The proposed project will intersect and divert dry-weather flows from the existing storm drain, which includes runoff from the Main Street business district, into the sanitary sewer system. The runoff would travel through City-owned sewers and be treated by the Los Angeles Hyperion Treatment Plant prior to discharge into Santa Monica Bay. Construction for this project will be managed by the District and will occur in the parking lot entrance at the end of Ashland Avenue. Neilson Way will not be closed or impacted by this project and the other two parking lot entrances and exits will remain unaffected. The District will notify surrounding residents and businesses prior to start of work in April 2005. The project is scheduled for completion by July 2005. All work will be coordinated with the City to avoid any unnecessary impacts. Pursuant to California Public Contract Code section 20995, the City Council must adopt a resolution authorizing this project. This resolution provides for the following: ? Authorizes the District to construct the diversion project near Neilson Way and Ashland Avenue. ? Grants the District authority to occupy the public right-of-way to construct, operate, and maintain the project. ? Waives all fees related to this project. 2 ? Concurs with the Los Angeles County Department of Public Works finding that the project is categorically exempt from the California Environmental Quality Act pursuant to CEQA Section 15301(b). Budget/Financial Impact This project is funded by the District and has no budget or financial impact. Recommendation Staff recommends that the City Council adopt the attached resolution authorizing the Los Angeles County Flood Control District to install a low-flow storm drain diversion in the public right-of-way in Ashland Avenue near Neilson Way.
