SUBJECT: Proposed Designated Smoking Areas on the Santa Monica Pier
Introduction
This staff report recommends that the City Council adopt the attached resolution
designating certain locations along the Santa Monica Pier as smoking areas.
Backoround and Discussion:

As part of the March 23, 2004, introduction and first reading of the ordinance amending
the Santa Monica Municipal Code to prohibit smoking on the Pier except in designated
areas, Council directed staff to work with the Pier Restoration Corporation and return
with recommendations on the number and locations of designated smoking areas on
the Pier. On April 27, 2004, the City Council heard the second reading of the ordinance,
and directed that the designated smoking areas on the Pier be approved by the Fire
Department, and include areas for outdoor dining and Pacific Park during special
events. Further, smoking by actors as part of their roles played during filming on the pier
would be allowed, but smoking by crew members would be restricted to the designated
areas.
Prior to Council's second reading of the ordinance, staff presented the Pier Restoration
Corporation Board with eleven potential designated smoking areas located throughout
the Pier.

The locations had been identified by Resource Management Department and Fire
Department staff as potential smoking locations because each area:
1) is removed from the main public thoroughfare,
2) can be efficiently fire-proofed, and
3) is situated to benefit from the prevailing winds.
Consideration was also given to locations that would allow smokers on the pier
reasonable access to designated areas.
The PRC Board evaluated the locations and recommended that Council consider
designating eight of the eleven locations. The locations are the west gazebo, the
notch/central area, the fire lane to the rear of Pacific Park, the fire lane west of Pacific
Park restrooms, the area located to the rear of the west-end public restrooms, the west
lower fishing deck, the west upper deck and either the north or south fishing deck (see
attached 'Designated Smoking Area Map'). The Board also added an additional
smoking area located along the south railing adjacent to the parking area for use during
special events subject to Fire Marshal approval. A total of nine (9) designated smoking
locations are proposed by the PRC.
In addition to identifying smoking areas on the public deck, the PRC Board
recommended that restaurants on the pier, at their option, designate smoking areas on
a portion, or all, of their outdoor dining patios.
The Board believed that prohibiting smoking on outdoor dining patios on the Santa
Monica Pier would place pier restaurants at a competitive disadvantage to other

restaurants in the City that have no outdoor dining smoking restrictions. The Board also
received input from the Santa Monica Pier Lessees Association (SMPLA), which
opposed a ban on smoking in outdoor dining patios, but asked that if regulations were
put into effect that restaurateurs be permitted flexibility in the designation of smoking
areas on outdoor patios.
Lastly the Board recommended that a 'special use designation' exemption be given for
private events at Pacific Park and for smoking by actors as part of their roles played
during filming on the pier. The special use designation would permit pre-identified
locations within Pacific Park for special events that are closed to the public, subject to
Fire Marshal approval.
In addition to the PRC's recommendation, staff proposes that each designated smoking
area (other than restaurant patios) be restricted to no more than a 5'x15' area. Smoking
areas would be supplied with ashtrays for disposal of smoking material and identified
through signs and painted markings. Signs will be installed throughout the Pier to inform
visitors that smoking is prohibited except in designated areas.
Budoet/Financial Impact
There are no financial or budgetary impacts for the recommended action. The Los
Angeles County Tobacco Control and Prevention Division will provide signage at no
cost to the City. The sign message and design will be approved by City staff.

Recommendation
Staff recommends that City Council adopt the attached Resolution to designate smoking
areas on the Pier, as follows:
1) Designate the nine smoking locations identified as Area #1 West Gazebo, Area
#2 South Rail, Area #3 Notch/Central, Area #4 Fire Lane to the Rear of Pacific
Park, Area #5 Fire Lane West of Pacific Park Restrooms, Area #6 South Lower
Fishing deck, Area #7 Rear of West Public Restrooms, Area #8 West Lower
Fishing Deck and Area #9 West Upper Deck (Exhibit A - Santa Monica Pier
Designated Smoking Area Map);
2) Allow restaurants on the Pier to designate smoking areas on a portion, or all, of
their outdoor dining patios.
3) Permit a 'special use' exemption for private events within Pacific Park, and for
actors smoking during filming as part of their role in the film, subject to approval
by the City's Fire Marshal.
