Subject: Recommendation to Authorize the City Manager to Negotiate and
Execute a Professional Services Agreement with Kennedy/Jenks
Consultants, Inc.
Introduction
This report recommends that the City Council authorize the City Manager to
negotiate and execute a professional services agreement with Kennedy/Jenks
Consultants, Inc., in an amount not to exceed $7,400,000 over five years to
provide engineering support services to the City and the Charnock Engineering
Committee, formed as part of the Settlement Agreement with Shell, ExxonMobil
and ChevronTexaco to restore the drinking water production from the Charnock
Well Field.
Background
The Charnock groundwater sub-basin is an important source of drinking water for
Santa Monica. The City shut down its five drinking water wells located in the
Charnock Well Field in 1996 due to the presence of MtBE. In accordance with a
Court approved Settlement Agreement, the City and Shell Oil, ExxonMobil and
ChevronTexaco (the Settling Oil Companies) have agreed to construct a
treatment facility in order to produce drinking water from the well field and

ultimately restore the resource. The Charnock Engineering Committee (CEC),
comprised of one City and one representative of the Settling Oil Companies, was
formed in accordance with the Court approved Settlement Agreement to oversee
the planning, design, construction and operation of the treatment facility.
Discussion
On April 9, 2004 the City issued a request for qualifications on behalf of the CEC
to engage an engineering support services contractor with experience in large
scale public works projects involving municipal drinking water facilities. The
engineering support services contractor will be initially tasked with developing
and implementing a remediation program management plan and advancing the
plan through the completion of the preliminary engineering design report phase
of the project. Three fully responsive proposals were received: Black and
Veatch Corporation, Kennedy/Jenks Consultants, Inc., and Metcalf and Eddy.
The proposals were rated and interviews conducted by the CEC to determine the
most qualified firm. Factors considered were: technical competence and
experience treating groundwater for municipal drinking water, staffing capability,
project approach and planning, past performance record, quality control, cost
control and reporting. The CEC selected Kennedy/Jenks Consultants, Inc., and
entered into discussions of a cost proposal and creation of a program
management plan that would guide the project over the next five years.
The selected firm will provide program management services, pilot studies and
tests, an optimized process selection, a preliminary design report, and CEQA

and public outreach support. A program management plan will be developed to
guide future phases of the project from process selection/conceptual design to
final operation of the treatment facility. The plan will be updated throughout the
execution of the program as the scope of work for each phase becomes better
defined. Any treatment solution selected will meet or exceed all state and federal
water quality requirements.
Financial/Budget Impact
The total cost of these services is not to exceed $7,400,000 over five years,
including contingency.
Funds required are:
Contract: $6,160,000
Contingency: $1,240,000
Total $7,400,000
Funds in the amount of $1,480,000 for the first year of the contract are available
in account number C050973.555060. Future year funding of the agreement will
be appropriated in future year Capital Improvement Program projects in amounts
equal to the anticipated contract expenditure needs for that fiscal year.
Continuation of the contract in future years will be contingent upon Council
approval of future year budgets. Funding for this contract is provided entirely by
the Settling Oil Companies pursuant to the Settlement Agreement.

Recommendation
Staff recommends that the City Council authorize the City Manager to negotiate
and execute a professional services agreement in an amount not to exceed
$7,400,000 (including contingency) with Kennedy/Jenks Consultants, Inc., for
engineering support services during the restoration of the Charnock Well Field.
