SUBJECT: Easement Agreement between the City Council and Parking Authority,
and the Bernard Perloff Trust and the Roger and Jean-Marie Trust, for
Continued Ingress, Egress, and Parking for 2434 Main Street and Lot 11.
Introduction
This report recommends that the City Council authorize the City Manager and the
Parking Authority authorize the Executive Director to negotiate and execute an
easement agreement with the Bernard Perloff Trust and the Roger and Jean-Marie
Trust (Perloff-Webster) for continued ingress and egress to Lot 11, and parking for 2434
Main Street.
Background and Discussion:
On July 27, 1983, an easement agreement was entered into between the City of Santa
Monica, Parking Authority of Santa Monica, and Perloff-Webster, allowing public access
through the property at 2434 Main Street to Lot 11 and reserving 22 parking spaces, a
handicapped space and a loading zone space to fulfill parking requirements for a
building on that property which was approved by Planning Commission on January 30,
1984. The easement agreement was to continue to July 10, 2008.

In 2003, Perloff-Webster approached staff to renew the easement agreement for
another 25 years in advance of the end date in order to take advantage of favorable
interest rates for refinancing. Presently, the spaces reserved for 2434 Main Street are
virtually unused over the weekend, while the remainder of Lot 11 may be full. A new
easement following current City guidelines can be created to maximize public parking in
Lot 11 during peak weekend times. The new agreement would return 11 spaces to
public use on weekends through June 2008. After that date, all 22 spaces provided to
2434 Main Street under the easement agreement may become available for public
parking on the weekend, depending on Perloff-Webster?s tenant need; should Perloff-
Webster require exclusive weekend use of any of the 22 spaces, it will pay the going
rate for monthly permits. The easement agreement will expire June 30, 2033.
Budget/Financial Impact
The recommended action should have positive financial impacts through increased
public use of Main Street. The number of spaces released for public use on the
weekend is expected to result in additional sales tax dollars and meter revenue,
although the precise dollar amount is difficult to predict and projected budget impacts
would not be significant city-wide. After July 1, 2008, there may also be additional
income from easement fees for any parking spaces retained by Perloff-Webster on the
weekend.

Recommendation
Staff recommends that the City Council authorize the City Manager and Parking
Authority authorize the Executive Director to negotiate and execute an easement
agreement with the Bernard Perloff Trust and the Roger and Jean-Marie Trust (Perloff-
Webster) for continued ingress and egress to Lot 11 and parking for 2434 Main Street to
achieve the mutual objective as described.
