SR-802-005 (5) EPWM:CP:AA:DB:JCF:\DATA\SPFILES\SP1949\CC1949 cc Rev4.DOC Council Meeting: February 24, 2004 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Waiver of Competitive Bidding Requirements and Authorization for Contract with New Creation Builders for Structural Improvements to the Municipal Pier Roadway Introduction This report recommends that the City Council waive competitive bidding requirements and authorize the City Manager to negotiate and execute a contract with New Creation Builders for construction of structural improvements to the Municipal Pier roadway from the easterly end of the Pier Bridge to the westerly terminus of the beach access stairway in the amount of $675,928 plus $67,072 in contingency funds for the project. Background City Council, at the January 27, 2004 meeting, approved budget changes to the Municipal Pier Structural Rehabilitation Project in the amount of $5.7 million, and authorized a contract with Moffat and Nichols for engineering design service for the project. The entire project will entail pile, stringer and deck replacement; utility upgrades to meet current codes; traffic loading analysis and recommendations for strengthening; and development of a comprehensive operations and maintenance plan. The Pier roadway from the end of the Pier Bridge to the westerly side of the beach access stairway is the first critical piece needing major repair and upgrade. A preliminary study of that area was completed last year by another structural engineer 1 under hire to the City and verified recently by Moffat & Nichols. It is imperative that this first phase of work be done ahead of Memorial Day 2004. Timely completion of this work will minimize impacts to the public and provide for an increase in the load carrying capability of the pier to allow safer access for emergency vehicles to that location. The Santa Monica Fire Department will be able to access and stage multiple pieces of emergency equipment on the Municipal Pier at a critical operating location with appropriate turn-around area for equipment, thereby enhancing public safety. Currently, due to load limitations of the existing wood structure and differential settlement of deck boards, all Fire Department emergency vehicles must stay on heavy steel plates to distribute their weight. Fire Department emergency vehicles must remain on the steel plates at all times which requires single file deployment and distance between fire trucks of not less than fifty feet apart in order to traverse the Pier from the Pier Bridge to the west end of Pacific Park. No fire trucks are currently able to travel on the new concrete section to the west end of the Pier. To exit, fire trucks must remain on the steel plates and back off the Pier in single file order while maintaining the fifty-foot separation. The project will repair and upgrade the structure to allow more than one fire truck on the Pier and a turn around area for fire vehicles. Other work on the pier includes the replacement of trench plates and deteriorated asphalt paving with stable and secure deck boards in the most heavily trafficked pedestrian area extending from the beach access stairway easterly to the Pier Bridge, which will eliminate exposure to potential trip-and-fall hazards. 2 Another concern is the timing of the Bubba Gump construction on the pier. Bubba Gump Shrimp Company leases premises on and adjacent to the Municipal Pier in accordance with the lease contract # 7983. The premises include a portion of the Pier deck that has significant dry rot and structural deterioration based on visual inspection and differential settlement of the deck surface. Bubba Gump anticipates the demolition of the former Boathouse restaurant beginning in April 2004, following issuance of its Coastal Development Permit on February 18, 2004 and Santa Monica Building permit. Construction of the new restaurant structure will commence immediately thereafter. Repairs and structural rehabilitation and upgrade of the Municipal Pier roadway will allow Bubba Gump to proceed with its construction unimpeded by subsequent pier rehabilitation work and will minimize the length of time that Pier patrons are re-routed away from this area of the Pier due to potentially hazardous conditions. Discussion An informal Notice Inviting Bids for the construction was published on December 18, 2003 and bid packages were sent to eight marine contractors. The City received two monetary bids and two ?No Bid? responses. 3 The bid results were as follows: 1. New Creation Builders $675,928 2. Meeks Construction, Inc. $892,665 3. Connolly-Pacific, Co. No Bid 4. W.W. Stephenson, Inc. No Bid City Engineer's Estimate $825,000 City staff contacted references and all respondents reported that the contractor's work quality was excellent and that work was completed in a timely and cost efficient manner. In addition New Creation Builders have recently completed two projects for the City successfully, including one at the Pier, doing similar work. Staff also contacted the Center for Contract Compliance and found New Creation Builders in good standing and capable of handling labor compliance issues. The California Contractor?s State License Board verified that the Contractor's license is active and in good standing. The Santa Monica Municipal Code, Section 2.24.071(e), allows the City Council, by a 2/3 vote, to waive competitive bidding due to "urgent necessity" of public health, safety and welfare. Future phases of the project will follow appropriate legal bidding requirements. 4 Budget/Financial Impact FUNDS REQUIRED: Construction Contract $675,928 Contingency $67,072 Total Required $743,000 Funds in the amount of $743,000 are available in CIP account C30064504.589000. Recommendation Staff recommends that the City Council: 1. Waive competitive bid requirements and authorize the City Manager to negotiate and execute a contract with New Creation Builders for construction of structural improvements to the Municipal Pier roadway in the amount of $675,928 plus $67,072 in contingency funds for the project; and 2. Authorize the City Engineer to issue any necessary change orders to complete additional work within budget authority.
