EPWM:CP:AA:BZ:GDV F:\DATA\SPFILES\SP1797\CC1797PHCONFIRMCOST.doc Council Meeting: October 14,2003 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Hold a Public Hearing and Adopt a Resolution to Confirm Assessment Costs for the Installation of Streetlights Introduction This report recommends that the City Council hold a public hearing and adopt a resolution to confirm assessment costs for the installation of streetlights in the following districts: District B - Dewey Street from 1 ih Street to 23rd Street District C - Robson Street from 17th Street to Dewey Street District D - Marine Street from Lincoln Boulevard to 17th Street Backqround At its June 13, 2000 meeting, the City Council accepted petitions for the installation of streetlights and adopted a Resolution of Intention to establish the following assessment districts: District A - Ozone Avenue from Lincoln Boulevard to Frederick Street District B - Dewey Street from 17th Street to 23rd Street District C - Robson Street from 17th Street to Dewey Street District D - Marine Street from Lincoln Boulevard to 17th Street District E - Strand Street from 5th Street to 6th Street District F - Frederick Street from Marine Street to Dewey Street On April 10, 2001, the City Council held a Public Hearing for the formation of streetlight assessment districts in accordance with the requirements of Article XIII D of the California 1 ItA OCT 14 2003 Constitution, the Improvement Act of 1911, and Santa Monica Municipal Code Section 7.04.860, On May 8, 2001, the City Council accepted results of the streetlight assessment election, The assessment election for Districts A, E and F failed; Districts B, C and D passed and were approved for streetlight improvements, On September 11, 2001, the City Council awarded a contract to L.A. Signal, the best bidder, for the construction of new streetlights. The City Council also authorized bonds to be sold and ordered the work to commence, Streetlight installation was completed in February 2003, with a notice of completion filed on March 12, 2003 On September 23, 2003, the City Council set a public hearing for October 14, 2003 at 7:00 pm, pursuant to Section 5881 of the California Streets and Highways Code. The following day, September 24,2003, all affected occupants and property owners were notified by mail of the public hearing date and their assessment amount. Discussion In accordance with Santa Monica Municipal Code section 7.04.860, whenever 60% of the occupants of residential units in any area petition the City Council to institute proceedings for residential street lighting, the City Council shall institute those proceedings under Article XIII D of the California Constitution, and the Improvement Act of 1911 to provide residential street lighting to the area Rent Control staff must also review the petition to determine conformance with Rent Control regulations for pass-through of assessments to tenants, 2 Property owners are assessed for street lighting based on the size of their properties. The cost for the installation of standard street lighting is $34.84 per lineal foot. Residential property owners are assessed 50% and commercial property owners are assessed 100% of their property's front footage. Residential property owners with corner lots are assessed 20% and commercial property owners with corner lots are assessed 40% of their property's side footage. Low to moderate-income households can apply for assistance through the Community Development Block Grant (CDBG)-funded program. If the assessment exceeds $150, owners have the option of either paying for the improvements over ten years at an 8% annual interest rate, or paying their assessment in full within 30 days after being invoiced. Civil Engineering and Architecture Division staff will provide Rent Control Department staff with assessment amounts for each property, to enable them to work with landlords of residential properties regarding the pass-through of costs to tenants. Budoet/Financiallmpact The total project cost is $340,393. The cost breakdown is a follows Property Owners' Share Construction Cost Incidental Expenses* City Share Construction Cost Incidental Expenses* $100,191 $ 10,095 $209,043 $ 21.064 $340,393 Total Project Cost *Incidental expenses include staff time for project management, administration of assessment districts, publication of public hearings, notification of property owners, 3 inspection, recordation, and reconciliation of invoices up to ten years for property owners who choose to pay their assessment on the installment plan. The City paid the contractor, L.A. Signal, $198,948 at completion of construction and absorbed the total incidental expenses of$31, 159. The remaining project cost of$110,286 will be paid through property owner assessments. Property owners have the option of either paying for the improvements over 10 years at an 8% annual interest rate, or paying their assessment in full within 30 days after being invoiced. Paid cash assessments will be held in Trust Account No. 80.201134 pending payment to L.A. Signal's assignee. Bonds are then issued by the City for any unpaid assessments. Property owners remit payments to the City Treasurer and the bondholder is paid as payments are received. Recommendation Staff recommends that the City Council hold the public hearing, acknowledge any protests, and adopt the attached resolution confirming the assessment costs.
