SUBJECT: Setting a Public Hearing for November 11, 2003 to Vacate a Portion of
First Court from Vicente Terrace to Approximately 200 Feet Northerly
Introduction
This report recommends that the City Council set a public hearing for November 11,
2003 to vacate a portion of First Court from Vicente Terrace to approximately 200 feet
northerly. A condition of the alley vacation is the dedication of an easement for utilities.
Discussion
As part of the construction of its new headquarters at 1776 Main Street, RAND has
requested the vacation of a portion of First Court in order to use it as a private access
road to its loading dock. Vacation of the alley will facilitate future development proposed
in the Civic Center Specific Plan. First Court contains storm drains, sewer mains, and
electrical power lines. The proposed vacation will include a dedicated easement for
these utilities, preserving access by the utility owners.
The existing Civic Center Specific Plan (CCSP), which was adopted in 1993 and
amended in concert with the RAND Development Agreement, provides for the
conversion of First Court to open space and pedestrian pathways. As such, the
proposed vacation is anticipated by and consistent with the CCSP. Construction of a

loading dock in this location was approved by the City Council under the terms of the

development agreement and CCSP Amendments was certified by the City Council on
October 3,2000. The proposed vacation is also consistent with the Civic Center Land
Use Plan, which was conceptually approved by the City Council in June 2002.
The portion of the alley proposed for vacation is surplus and is not required for street
PUrposes. The proposed va.tion +O"-Id h~ no impact on iexistintJ . and pro~
buildings that front Ocean Avenue and have access through dead end driveways off of
Ocean Avenue. Therefore, First Court is not required for access to these buildings.
vacation of the easterly half of First Court will leave the westerly half as a 1 O-foot wide
alley. The remaining portion of the alley will contain public utilities and provide interim
vehicle access to the remaining portions of First Court until the implementation of the
applicable phase of the Civic Center Specific Plan that incorporates the remaining
portion of First Court.
Budget/Financial Impact
There are no budget or financial impacts as a result of this recommendation.
Recommendations
Staff recommends that the City Council set a public hearing for November 11
regarding the vacation of a portion of First Court from Vicente Terrace to approximately
200 feet northerly.
