SUBJECT: Award of Contract for the Fiscal Year 2001-2002 Community Development
Block Grant Curb Ramp Project
Introduction
This report recommends that the City Council award a contract for the construction of fiscal
year 2001-2002 Community Development Block Grant (CDBG) funded curb ramps at
various locations throughout the City to Damon Construction Co., the best bidder, in the
amount of $124,600 and approve $16,400 in contingency funds.

A Notice Inviting Bids was published on December 7 and 15, 2001 in the ?California
Section? of the Los Angeles Times. The bid package was sent to eleven public plan rooms
including five women/minority business enterprise associations. Five contractors requested
bid packages. The City Clerk?s office received three sealed bids, which were publicly
opened and read out loud on January 7, 2002 at 3 PM, by the Deputy City Clerk.

The bid results were as follows:
1. C.J. Construction, Inc. $105,500
2. Civil Works Corp. $116,715
3. Damon Construction Co. $124,600
City Engineer?s Estimate $120,000
Projects funded with Federal grant money, such as CDBG, are subject to Federal
requirements of the Disadvantaged Business Enterprise (DBE) Program adopted by the
City pursuant to Federal law. To be eligible for federal funding, the selected contractor
must meet the 11% DBE goal established for this project or demonstrate a good faith effort
as described in Code of Federal Regulations Title 49, Part 26, in their attempt to reach that
goal which is clearly stated in the City?s bid documents. The two lowest bidders, C.J.
Construction, Inc. and Civil Works Corp. did not meet the Federal DBE requirement nor
did they demonstrate a ?good faith effort.? The only bidder meeting the Federal DBE
requirement was Damon Construction, Co.
The best bidder, Damon Construction Co. supplied the City with a list of references related
to curb ramp and sidewalk repair projects for the cities of Lynwood, Burbank, Thousand
Oaks, Glendale, Inglewood and Santa Monica. Staff contacted the agency representatives
for these projects and they all reported that the contractor's work quality was very good
and that work was completed in a timely and cost efficient manner. Staff also contacted the
Center for Contract Compliance and found Damon Construction Co. in good standing and
capable of handling labor compliance issues. The State Contractor?s License Board

verified that the Contractor's license is current, active, and in good standing. In their bid,
Damon Construction Co. committed to meeting the established DBE goal.

Recommendation
Staff recommends that the City Council:
1. Award a contract for CDBG curb ramp construction to Damon Construction, Co., the
best bidder, in the amount of $124,600, and approve $16,400 in contingency funds;
and
2. Authorize the City Engineer to issue any necessary change orders to complete
additional work in conformance with the Administrative Instructions on change
orders.
