Council Meeting: February 12, 2002 Santa Monica, California
TO: Mayor and City Council
FROM: City Staff
SUBJECT: Public Hearing and Resolution Ordering Vacation of Public Service Utility
and Right-of-Way Easements at Sixth Court
Introduction
This report recommends that the City Council hold a public hearing to receive
comments regarding the proposed vacation of public utility and right-of-way easements
located at Sixth Court, immediately adjacent to the Santa Monica Main Library, and to
adopt the attached resolution ordering the vacation.
Discussion
Currently Sixth Court transverses from Santa Monica Boulevard to Arizona Avenue
between Sixth Street and Seventh Street. The Main Library is immediately south of the
area to be vacated and a public parking lot is to the north. The City owns both
properties. It was determined that the area to be vacated is no longer needed as an
alley and vacating the property may provide future development options on the adjacent
properties.
At its December 18, 2001 meeting, the City Council directed the City Clerk to set a
public hearing on the proposed vacation proceedings for January 22, 2002. At that time,
the hearing was continued to February 12, 2002. Notices noting the time and place of
1
the public hearing were posted along the area of the proposed vacation. Notice of the
hearing was published on January 31 and February 6 in the Los Angeles Times.
Publication and posting of the notices was done in accordance with Part 3, Chapter 3 of
the California Streets and Highways Code, ?General Vacation Procedures.?
Budget/Financial Impact
There are no costs associated with the relocation of non-City owned utilities. The
respective utility companies will handle relocation of these utilities.
Recommendation
Staff recommends that the City Council:
1) Hold a public hearing on the proposed vacation of utility and right-of-way
easements in Sixth Court, as described in Exhibit A to the Resolution; and
2) Adopt the attached resolution ordering the vacation of utility and right-of-way
easements in Sixth Court.
