The Ckty Pianning Commission approved the Tentative Map and the Tenant-Part~c~pating
Conversion for the abo~e pro~ect on June 11, '! 997, after a public hear~ng and a careful
review of the recard and staff recommendations The action of the Plannmg Cammission
was based on the Camm~ss~on's fmdmgs that the prvposed Tenan#-Partic~patmg
Conversian meets the requirements of Article XX of the City Charter and thatthe proposed
subdEVision is consistent with applECable general and specific plans as adopted by the City
af Santa Monica aiong with all mandatory requ~rements of the Subd~vis~on Map Act of the
State of California

The owners have submitted to the City a Wntten Consent Agreement bmding the owners
anci any successors in ~r~terest ta each condition Emposed in connection with approval of
th~s Tenant-Part~cipati~g Conversion This Written Consent has been approved by the
City Attamey and the Cjty Manager Each participating tenant has been mfarmed in writ~ng
af his or her r~ghts under Arficie XX of the City Charter The L~cense Di~GS~on reparfs that
proper arrangements ha~e been made to ensure payment of the Tenant-Participating
Con~ers~on Tax
The F~na~ Map canforms to the Tenfative Map The F~nal Map has been certified by the
City Eng~neer for car~formance with the Tentati~e Map ar~d conditions thereon, the
Subd~~ision Map Act and local ordmances The CEty Attarney's office has approved a
Deciaration of Covenants, Conditions, and Restr~ctions, or equivalent documsnt, for this
pro~ect as compiying wifh fhe car~ditions af the Tentative Map and the Tenant-Parfic~patmg

Caunal approval of a fmaf map for a Tenant-Part~cipating Canversion represents one of
fhe last steps necessary m the conversian process Follow~ng City Councif action a~d
approval by the California Department of Real Estate the applicants may begin selling #heir
un~ts to the tenants As each unit is sold a conversion tax per Section 2008 af Article XX
is due in a~ amount equal to twelve times the mor~thly maximum all~wable rent for that
unit These taxes wilf be used to assist [ow and moderate income households to purcF~ase
or improve their un~ts sub~ect to affordable repayment per Section 2D09 of ArkECle XX

BUDGET/FISCAL IMPACT
The recommendatian presented ~n th~s report daes not have an ~mmediate budget orfiscal
impact If and as units in the pro~ect are sold ~n the future, Tenant-PartECipating
Conversion Taxes wiil be collected pursuant ta tt~e pro~isions of Article XX af the City
Charter and same ~ncreased property tax revenues may be generated
