BACKGRaL7ND
On July 28, ~998, a group of resEden#s from the No~th of Mo~tana Ne~gl~bork~oad
Assac~ation (NOM~) spal~e before the C~ty Caunc~f ar~d requested that the Councii enact
an emergency mterim ordinance to limit fhe size of F~ouses permjtted m the R'{ d~stnct,
north of Montana Avenue. The nejghbarhood reprssentat~~es stated that there has been
a surge of demohtion of existing ofder hauses and construct~on of new, `bversized" houses
The group requested tF~at ar~ emerger~cy ofd~nanee be aelopted ~r~ order ta er~s~are that new
de~e~opment is compatib~e with the existmg neighborhaod scale and character as welf as

De~efopment Patterns
The exist~ng citywide singie family (RI) developmen# standards were in~t~ally adopted in
S~ptember, ~ 988 and subsequently amen~ed ~n 1993 The 9 993 amendments ~ncl~ded
modifications to #he method of calculat~ng step back requirements and reiaxed the
standards far two story accessory buii~ings by eiim~nating the Cond~tionai Use Permit
reqwrement if specific setback and ste~ back standards are met
Staff has studred permit actr~rty m th~ narti~ of Mon#ana nerghbar#~ood dat~ng back to 'f 989
in order to pro~~de a history of demol~tion and constructian ac#i~ity in #he area since
adoption of the current development standa~ds There are approximately 3000 single
famcly parcels m the area north of Montana Avenue As ~Ilustrat~d on the #oNow+ng chart.

as might be expected, new home canstruct~on peaks during the years when the econamy
+s strongest However, the rate af demo~ition and new eonstrUCtion activity in 1998, to date.

surge in the demalttsan of older hous~ng and reconstruct+on of housing bu~lt to the
maxtmum aNowable deveiopment s#andarcls ~ast year, there were 25 demol~tion permits
f~led for single fam~ly hames in this area, mare than doubling the numb~r af such
applications filed in 1996 and a five fold increase over the numf~er of such applicafior~s in
1995 In ~ 998, 33 demolit~on appl~cation have already beer~ f~led A cor~t~nuation o€ th~s

constructEOn ~a~rmits for development m the north of Montana neighborhood during the
same period
Develo~ment Issues
The narth of Montana Avenue residsntial arsa conta~ns a mix of older. single stary and two
story homes, and newer, larger dweNings that have been constructed ~n recent years As
prev~ously stated, many area res~dents ha~e ra~sed cancerns regardmg the number of

demol~tions and #he amount, size and scale of new development in th~s single family
neighborhood These concerns relate pnmanly ta the height, perc~ived number of stories
and massing of the new buddmgs, as well as the compatibility of the new structures with
the existing hauses in the area Many of the new, larger structures ~lo no# have a
contextua~ re~ationshrp witf~ ad~acent structures, resuiting m negati~e Empacts rn terms vf
the neighborhood's access to light and air, privacy, and #he o~erall amount of open space
as viewed from the street and between budd~ngs Th~ new structures are out of proportion
jn relatian to the lot width and height of exist~ng structures Photographs illustrat+ng these
devefo~ment trends are provided m Attachment D
Neighborhaod representati~es have recommended that the Enterim ordinance mclude a
reduct~on ~n the perm~tted lot co~erage (from 40% to 35%), a prohibition an lofts ar~d
mezzanines, and a requirement that two story accessory structures comply with the same
sEtback requ~rements as the primary structure Staff considered these recommendat~ons
and exammed ather ways to m+t~gate the rmpact af new structures on the extstrng
neighborhaods
Development Standards
As outlined below, the proposed amendmenfs to the R1 zoning standards +n the area north
ot Montana Avenue are a~tended to sl~ghtly maariy the ex~stmg standards and to create
buifdings that mtegrate befter ~nto the neighborF~ood These rn4dif~cations are designed
to reduce bu~lding massing wh~le still allowing far design expression and flexibifity They
are not intended to stop construct~on As with all interim ord~nances, the #Erst ordinance w~li
~
be effecti~e for a penod of 45 days, dur~r~g which time staff will return with an extension
It is estima#ed the in#erim standards will be in effect for at least one year whike staff, the
Planning Commission, the City Council, a~d the public de~elop permanen# standards
• Lot Coverage
One of the ne~ghborhaod recommendations was a request to reduce the maximum
allowable lot coverage ~n the area from 40% ta 35% Staff has considered this suggestian
and has cohcluded that reducing the maximum allawable lot ca~erage would not
necessarify reduce the perceGVed bulk and mass of a s#ruct~re While decreasing the
allowab~e lat co~erage would reduce the buildmg footprrnt, ~t wauld not reduce the overall
mass~ng of the structure ~n fact, it cauld result m buildmgs with mqre mass and bulk s~nce
de~elopers would be encouraged to maximize the second #loor in order to recoup the
amaunt of square faotage lost due to the reduced building faotpnnt Staff bel~ev~s
reducing lot co~erage would ultimately discaurage ane stary houses and one story
ae~cl~tions irrstead of redueirrg lot coverage, oth~r measures to address buildmg mass and
scale are propased
• Building Height, Lofts, Mezzanines and Unini~ab~table Flaar Space
Presently the perm~tted height in the district is two stories and 28 feet This height limit
allows for ~ntermed~ate floor levels such as lofts and mezzar~~r~es to be constr~cted
f~etween the first and second floars and b~tween the second f{oar and roaf of a structure,
pro~~ded the floor area does not exceed 33% of the floor area befow In addition, the
bujldmg code allows unmt~abitable spaces such as attics and starage areas with a height

clearar~ce of less than se~en feet to be constructed above the two story limit Two story
buildmgs cantaining these types of areas aften have #he appearance of a fhree story
bu~ldmg, which adds fo the perce~ved he~ght and number of s#or~es of the str~cture
Reducing the permitted height could lead ta flat roof structures and wouid discourage
elements such as clerestones or ra~sed ceiling heights This, in turr~, would g~ve the
appearance of box-like structures It appears the ~ssue ~s floor space between le~els which
gi~e the ~mpression of a three story structure Therefare, staff recommends that the
lnterim ordmance prahibrt lofts, mezzanmes, and any other floor space between the frrst
and second level, or the second IeWel and roof The elim~nation of these types of areas will
reduce the perceived height and number o~ storEes af a structure, wh~ch wikl help to ensure
that new construction in the area is more compat~ble with the existing iow scale character
of #he ne~ghborhood
• Bu~ldc~rg Pro~ect~ons
Primary structures on a standard parcel (50' x 150'} in the R1 district are requir~d to be set
back a minimum of 20' ~n the front yard, 5' on the side yards, and 25' in the rear yard
(measured from the center 1in~ of the rear alley) While buElding walls are required to
comply with these set backs, the development standards allow numerous pro~ec#ions far
elements such as ea~es, chimneys, bay windaws, patios, balcon~es, and porte cocheres

appears that the permitted pro~ections into the required yard areas mcrease the perce~ved
budding mass and give the impression the structure ~s built out to ~he property lines Th~s
is particularly true on two ad~acent parcels where a new struct~re is located next to an

existing structure with non-conforming setbacks Therefore, staff recommends that the
mt~rim ardman~e prohibit all pro~ecfions in#o any required yard, except roof eaves The
elim~nation of other pro~ections wiif control the scale and massmg af new construction and
insure greater compatibility with the north of Montana Avenue ne~ghborhood context
• Two Stary Accessory Structures or~ Corner Lots
The current R1 development standards permit a two story accessory structure to be
located on one side parcel line and five feet from the rear parcel {ine. pro~ided the second
story portion o€ the bu~ldmg camplfes vv~#h the se#back req~~rements for the pr~rrtary
structure This pro~is~on allows for second story additions to existing garages, where thE
roof of the garage is used as a roof deck and #he deck is setback three feet from the side
praperty line and five feet from the rear property line These structures, when located ort
a carner parcel, resulf in the perceptjan af large. two stary buildings located in the rear and
side yard areas, increasing the site's de~elopment intensity In order to address this
cancern and retiuce the irnpact afi these structures, staff recommends tha~ the intenm
orcl~nance requ~re that all portions of a two story accessory structure comply with ~he
setback requirements far the primary structure This will require the entire accessory
structure to provide a five fOpt side yard setback and a 25 foot rear yard setback
(measured fram the center line of the rear a11ey) This pro~ision would appEy to all new
accessory structures on corner lats as well as additians to exis#mg accessary structures
Since many existing single story garages are located along side andlor rear property I~nes.
under this prov~sion, second stary additions to these ex~sting structures wauld be
proh~bited

• Maximum Second Story Square Footage
As previously stated, one of the primary concerns expressed by area residents is the mass
and bulk af new structures and ti~at the second stories pro~ide very little ar#iculatior~ and
relaef in comparisan to the first story Th~s resu~ts in large, blvck shaped structures While
the current R1 de~elopment standards require that the secand story be stepped back on
a portion of the front, side, and rear elevations, structures built in compliance with these
standards still do not achie~e the desired amo~nt of second sfory articulation In order to
ac~~ress this concem and to ensure that the secand story is appropriately scaled in relation
to the first story, stafF recommends that the interim ord~r~ance limit second flaar square
footage based upon #he size of the first floor building foot print As praposed, the second
story floor area would be limited to 6~% of the building foot pr~nt This will require that the
second story E~e approximately two thirds the size of the first floor, which will resul# m
greater second story articulation than provided in the current ordinance Additionally, in
order to pre~ent the entire second s#ory setback area from being used as deck space, staff
recommends that balcany an~ terrace areas on the second flaor be limited to ~% of #he
first floar tootprint
On a standard 7500 square foot parcel using the maximum permittec! 4~°/o lat co~erage.
the proposed standards would allow a 2600 square foot first floor, a 1690 square foot
secor~d floor, ar~d a 40Q square foot garage, tor a tota! of 4690 sauare feet The standards
also allow up ta an additional 250 square feet above the garage, permitting up ta 4940
square feet of occupred area on a 7500 square faot parcel Current development
standards would permit a 2600 square foot first floor, a 29 88 square foat seco~d floor, and

a 400 square foot garage, for a total of 5195 square feet With the addition of 25a square
feet permitted above the garage, current develapment standards would allow up to 5445
square feet of accupied floor area on a 7~00 square foat parcei Th~refore, staff's
proposed modifications will not resul# in a significant reduction in floor area for typ~cal single
family homes
• Front Yard Exca~ation
Neighbors in the sub~ect area have expressed a concern about the exca~atiar~ of front yard
areas m arder to pro~ide access to subterranean garages The current standards permit
three feet of exca~ation withEn the front yard setback measured from the site's a~erage
natural grade ThGS is particuiarly problematic on parcels that are sloped because the
pro~ect can take adWantage of the a~erage natural grade measurement, excavate a
considerable amount of the front yard, and develap a subterranean garage which when
~iewed frorn the stre~t, is nat campatible with the character af the surroundir~g
neighborhood In fiact the resulting hause is perceiWed as a three story building from the
street In order to pre~en# excessive exca~ation in the front yard setback area on an
intenm basis until it is studied m greater detail, the proposed ordinance cantams a provision
that {~rohibits any excavation within the front yard setback A prohibition on frvnt yard
exca~at~on wilf prevent frant yard access to subterranean parking
Result of Proposed Mod~f~cations
The proposed mod~fications ta the R1 development standards in the north af Montana
s~ngle fam~iy neighborhaod wo~ld resuft is a slight reduction m the tota~ amaunt of square

tootage ~ermitted or~ a parcel Given t~te standard 75Q0 square foot parcel size m th~s
area, current de~elopment standards would allow appraximately 5195 square feet of
d~~efapment, not including up ta 25a additional square feet above fhe garage The
proposed standards would reduce this amount to approximately 469~ square feet, a 500
square foat reductian m the maximum building size Despite the modest reduction in
square footage, t~e nature of the praposed developrnent s#andards will provide far
structures compatible with the existmg character of the neighborhood
The emergency interim ordinance would apply to building permit applications filed after
August 18, 1998, the effective date af this ordinance This date was se~ected because it
ensures the ordir~ance will operatem prospectively only and t~ereby be less sub~ect to legal
chaffenge Additianally, ~t allows ~ro~ects fhat are currenfly in plan check and have been
designec~ and engineered ta meet the current R1 developmenf standards, to proceed
without re~ising the building design to comply with the propased standards The nan-
emergency interim ordinance would apply ta building permit appf~cations filed after the
effecti~e date of that ordinance
GEQA STATUS
The proposed Enterim ordinance is categoncally exempt from the provisions of ~he
Cal~forn~a En~r~ro~mental Quality Act (CEQA} ~ursuant to Class 5 ot the 5tate G~~del~nes
in that these minor modifications to the R1 de~elopment standards in the north of Mantana
single family neighborhood will not alter the permitted area land uses ar increase
de~elopment dens~ty

Arbitrarily reducing the 1ot coverage from 4U9`a ~0 35°~0, may result in some larger
back yards, but wi11 not change the street view of the facade o# most ~ew
hotases. Such S reduction in 1ot co~erage is shartsighted and migh# r9sult ir~
box~er houses as arch+tects are forced to ~ncorporate t~esired sleme~ts ot their
desigr~s in a smaller volume without the freedom to expand #he faot print and
st~p back the second floor.
E~iminating ths possibifity of a mezzanine also wi1# resul~ irt boxrer designs, By

I would mueh rather those people have 100 more square feet

Our back yards are tiny and prec~ous. We need more green

The offens~ve monstrasities that NOMA po~nts ou~, o~ w~ic:~
there ar~ many, are largely b3ailt like b~g boxes - straiaht

faux Mediterranean or Spanish style - and buii~ more-or-less
stra~ght aut square to the max~rlsm ~ot coverage.
'The thing is, other two-story homes that are not bu~lt like
g~ant, offensive blocks, that have beautiful peaked roofs,

That way we can still have grace~ul homes of tradiLional and
