MUNICIPAL C4DE AND GENERAL PLAN CONFORMANCF,
The proposed text a.n~e~dmen€ is consistent w~ch the Municipat Cade and sn conforriury with the
Gen~erat Plan in that Land Use Element Ob~ect~ve #1 6 states that the commercial corredors of the
Ctty shauld "Accommodat~ com~mercial uses wiuch serve reg~onaI, commuruty and Iocal needs
while respecting the adjacent residential neighborhoads." Automob-le dealersiup establ~shrnents
are consistent with rhic ty~ of Iand use The proposed text amendment would allow auto dealers
locat~d ~ the C6 zonin~ dis#rict, in existence as of October 1, 149G, to remain as perautted uses,
and elim»tes inconsistencies between C6 district standards that currendy allow expansion of
existing dealerships, and no~~anforming use regulations that proh~bit the expansion or
intensification of non~onforming uses.

the City for a Zoning ~rdinance Tezt Amendme~t rv spec~f}+ automobile dealershigs in existence
on October 1, 1996 are permitt~d uses in the C6 zoning district. The application was fiied by the
W. I. Simon.svn, Inc. wt2ich has be~n located at 1626 Wi~sh~re Bcwlevarc~ since 1937. Currentlp,
the G6 d~strict regulations do not identify existing dea~ersh~ps as permitted uses, but allow existu~g
dealerships to expand, subject to either a Per~ormance Standards Pern~it or a Cor~dttxonal Use

Conclusiq~
The standards for the C6 zon~ng district were last amended u~ 1995 when prov~s~ons were adopted
wh~ch allowed far auto dealerstups to expand up to I0~ with a Perfomance ~taitdards Pernut and
more than 10% ar rnore than 5,0()0 s f, whichever is less, wlth a Conditional Use Pe~m~t At
the sarne tur~e, the Zoning 4rdinance non-conformmg use regulattons preclude such expansians
since auco dealershyps aze nat ~~cluded as perm~tted uses ~n the C6 D~str~ct. T'he pr~posed text
amendment will elim~nate this inconsistency. Since #his amenciment only addtesses anto
deaferships existing as of Qcwber 2, 1996, only a ~uni~d riumber af non~onfvrming autoinobile
deaterships (three) are affected. Further, si~ce th~s text amer~~ent does not authorize the
establish~ent of new auta dea~erships in the C6 District, the number of dealerships will not
increase. The proposed text am~ncim~nt woald also proltibit the eacistuig dealerships from being
con~erted to a confom~ing use and then resume autodealerslup operatians ar w cantinue ~s
pennitx~d uses ~f their aperations have been u~active for a penocl of ane year or tonger.
It is recommended that the Flanning Com*n~5s~on secon~~rid to thc City Council adogtion of che
Froposcd Te~ct Am~endmenR to a.mcnd Soction 9 04.Q8.2~6.020 of the Zoning Ordinance as set forth
in Attachment B based ugon the following fi~ings:
