Introduction
This report recommends that the City Council Introduce for first reading the
accompanYing ordinance
Backaround
At the City Council meeting of May 27, 1997, City Council directed staff to prepare
the necessary documents for renaming Lincoln Park to Christine Emerson Reed Park
In response to thiS direction, an ordinance has been prepared to amend MUnicipal Code
SectIons 4 08 091, 4 08 180 and 4 55 020 to reflect thiS change.
DISCUSSion
Upon final approval of the reqUired ordinance changes, park signs Will be Installed to
reflect the renaming of the park In addition, City staff Will work With family members
and the Recreation and Parks CommisSion to plan an event to commemorate the park
renaming

TO REFLECT THE NAME CHANGE
WHEREAS, Chrrstrne Emerson Reed served as an esteemed member of the Santa
Monica City Council from 1975 to 1990. and as Mayor from 1984 to 1986, and
WHEREAS. Christine Emerson Reed represented the City's Interests on the Los
Angeles County Transportation CommIssion and Metropolitan Water DIstrict Board, and
WHEREAS, Chrrstlne Emerson Reed first served the City as a Recreation and
Parks Commissioner and was an active supporter of the City'S parks and open spaces, and
WHEREAS, the City CounCil desires to honor Chrrstrne Emerson Reed for her
service to the community,
NOW. THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA

Section 4.55.020. Definitions.
As used rn this Chapter, the following words and phrases shall have
the follOWing meanings
"Department" shall mean the Department of Communrty and Cultural
Services
"Director" shall mean the Director of the Department of Community
and Cultural Services
"Litter" means any abandoned, discarded substance including, but not
limited to garbage, refuse, rubbish, abandoned and Inoperable household
appliances, discarded packaging or containers. dIscarded bUilding, plumbing
or construction material, unless pursuant to construction operatIons, lighted
or nonhghted cigarettes. cigars, matches or any flaming or smoldering
material. and all other waste matter which I If thrown or deposited as
prohibited herein, may be detrimental to public health. safety and welfare
"Park" and "parks" shall mean and Include the followrng parks In the
City Ashland (SunseUAshland Park) Park, Beach Park #1, Beach Park #4,
Bernard Way Linear Park, Clover Park, Crescent Bay Park, Douglas Park,
Goose Egg Park, Hotchkiss (Mary Hotchkiss Park) Park, Joslyn Park, Li~;:;;:;:~
Christine Emerson Reed Park, Manne Park, Memonal Park. Ocean View
Park, Ozone Park, Pacific Street Park. Palisades Park, Park Drive Park,
Schader Park. South Beach Park, Stewart Street Park, Virginia Avenue Park
and any City-owned landscaped open space In the CIVIC Center area
"Park facility" and "park facilities" shall mean any building, structure,

recreational facility, table, bench, fence, monument, equipment, apparatus,
walkway or park property In any park
"Park foliage" shan mean any tree, hedge, bush, shrub, plant, flower,
grass or foliage In any park
SECTION 5 Any provIsion of the Santa Monrca Municipal Code or appendices
thereto InconSistent with the provIsions of thiS Ordinance, to the extent of such
InconsistencIes and no further, IS hereby repealed or modified to that extent necessary to
effect the provIsions of thiS Ordmance
SECTION 6 If any section. subsection, sentence. clause, or phrase of thiS
Ordinance IS for any reason held to be Invalid or unconstitutional by a decIsion of any court
of competent JUrisdiction, such decIsion shall not affect the validity of the remammg
portIons of thiS Ordinance The City Council hereby declares that It would have passed thiS
Ordinance and each and every section, subsection, sentence, clause, or phrase not
declared Invalid or unconstitutional Without regard to whether any portion of the ordinance
would be subsequently declared Invalid or unconstitutional

SECTION 7 The Mayor shall sign and the CIty Clerk shall attest to the passage of

Peaceful Performance of City Service
It 18 mutually understood and agreed that partic1pat1on by

partles hereto wlll participate in, encourage,
ass1st or condone any str1ke, concerted work
stoppage, cessatlon of work, slow-down, sit-down,

B. In the event that there occurs any strlke, concerted
work stoppage, cessation of work, slow-down,
slt-doWTI, stay-away, plcketl~g or any other form of
lnterference with or llmltatlon of the peaceful
performance of Clty serVlces, the City, 1n addltlon
to any other lawful remed1es or d1sclpllnary
act1ons, may by action of the C1ty Manager cancel
any or all payroll deductions, proh1blt the use of
bullet1n boards, proh1blt the use of C1ty
faclllties, and prohlblt access to former work or
duty statlons
C Nelther the employee organizat1on, nor any person
acting ln concert with them, will cause, sanctlon,
or take part ln any strlke, walk-out, sit-down,
slow-down, stoppage of work, picketlng, retard1ng of
work, abnormal absenteelsm, wlthholdlng of serVlces,
or any other lnterference w1th the normal work
routine. The provisions of this Article shall apply
for the same term as this Agreement, or durlng any
renewal or extension thereof. Vlolation of any
prOV1Slon of thlS MOTI by the Recognized Employee

THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN
AS FOLLOWS
SECTION 1 Santa MOnica MUnicipal Code Section 9 24090 IS amended to read
as follows
SECTION 2.24.090. Informal purchasing procedures.
(a) Convenience Purchase Orders
(1) IndiVidual purchases related to the City's maintenance
requirements, amounting to less than $1,00000 aggregate amount per
purchase order are exempted from competItive bid requirements
(2) In the event that the savings potential clearly does not
Justify this exemption, open market request-for-quotatlon procedures shall
be followed

(b) Open Market Orders
(1) Except as provIded In Sections 2 24 071, 2 24 073,
224080 or 224090, public works proJects, all purchases of supplies,
materials equipment or contractual servIces, and all sales of personal
property of the CIty whIch has been obsolete or unusable, or for any other
reason IS to be disposed of, which are not more than $25,000 00 In amount,
shall be made In the open market, without the requirement of formal
newspaper advertising
(2) All open market purchases, wherever possIble, shall be
based upon not less than three competitive bids and shall be awarded to the
person offering the lowest and best bid
(3) The Purchasing Agent shall soliCit bids by direct mall
request to prospective vendors, or by telephone, and by public notice on the
bulletin board In the Purchasing Department The Purchasing Agent shall
keep a record of all open market orders and the bids submItted In
competition thereon, and such records shall also be open to publiC

2.24.100 Formal bidding procedures.
(a) Except as otherwise provided, all purchases of supplies,
matenal, equipment or contractual services, other than profeSSional services,
which shall be governed by Section 2 24 073, and all sales of personal
property of the City which has become obsolete or unusable, or IS to be
dIsposed offor any other reason, of more than $25,00000, shall be made to
the lowest and best bidder after pubhcatlon In a newspaper of general
Circulation In the CIty of Santa Momca, by two or more inSertions, of notices
Inviting bids therefor, the first of which shall be at least ten days before the

time for opening said bids At the time specified In the notice Inviting bids,
such bids, shall be opened and declared publicly The PurchaSing Agent shall
tabulate all bids received pursuant to this section and shall refer them to the
City Manager for presentation to the City Council, which shall make the
awards The City Council may reject any and all bids presented and may
re-advertlse In Its discretion
(b) After rejecting bids, or If no bids are received, the City Council
may declare and determine that, In ItS OpiniOn, the supplies, matenals,
equipment or contractual services may be purchased under more favorable
circumstances In the open market, and after the adoption of a resolution to
this effect by at least five affirmative votes, It may proceed to have such
supplies, matenals, equipment or contractual servIces purchased In the
manner stated, Without further observance of the proVISions of thiS section
(c) Purchases of supplies, matenals, equipment or contractual
services may be made Without advertiSing for bids If the purchase of such
supplies, materials, equipment or contractual services shall be deemed by the
City Council to be of urgent necessity for the preservation of life, health or
property and shall be authonzed by at least five affirmative votes, or It shall
be determined by such vote of the City Council that to advertise for bids
would be to no avail and would cause unnecessary expense and delay

of competent JUriSdiction, such deCISion shall not affect the validity of the remaining
portions of this Ordinance The City Council hereby declares that It would have passed
this Ordinance and each and every section, subsection, sentence, clause, or phrase not
declared Invalid or unconstitutional Without regard to whether any portIOn of the ordinance
would be subsequently declared Invalid or unconstitutional
SECTION 6 The Mayor shall sIgn and the CIty Clerk shall attest to the passage
of this Ordinance The City Clerk shall cause the same to be published once In the official
newspaper Within 15 days after Its adoption This Ordinance shall become effective 30
days from Its adoption
