SUBJECT Ordinance Amending Section 3 08 030 of the Santa Momca Municipal
Code to Designate a PreferentIal Parking Zone by ResolutIon
Introduction
This report recommends the City Council adopt an ordinance amending Section
3 08 030 of the Santa MonIca MUnicipal Code to designate a preferential parking zone
by resolution Preferential parking zones are currently designated by ordinance ThIs
report also recommends some procedural changes for the processing of preferential
parking requests

Pnmary responsibility for processing preferential parking requests rests With the
Parking and TraffiC Englneenng DIvISion The process Includes venflcatlon that at
least 67% of the households (required by ordinance) Within the area support the
requested preferential parking zone When a petition IS venfled, a parking analYSIS IS
undertaken The analYSIS Includes an hourly review of the parking use along the street
from 7 00 am to 7 00 pm on a tYPical weekday and fIeld observations of the location by
staff on various days and hours Once the parking data IS collected, use summaries

are prepared Based on the criteria In the enabling ordInance, staff determines
whether the street qualifies for preferential parking
If a street qualifies, a staff report IS prepared and submitted to CounCil for conceptual
approval Often, several preferential parking locations are submitted In one report to
Increase the effiCiency of accommodating these requests The process to thiS pOInt
should take about three to four months
Upon Council's conceptual approval, the City Attorney's Office prepares a draft
ordinance and the City PlannIng DIVISion conducts an environmental evaluatIon,
tYPically an Initial study ThiS part of the process takes an additional three to four
months After completion of these steps, the ordInance and environmental documents
return to CounCil for first and second readings The ordinance takes effect 30 days
after the second reading
Following adoption of the ordinance, permits are sold to reSidents and signs are
Installed ThiS process should take between four and SIX weeks, including the 30 day
period after second readIng
DISCUSSion
Staff IS proposing changes to the procedures for preferential parking to accelerate the
processing of requests First, IS to deSignate a preferential parking zone by resolution

Instead of by ordrnance Second, process the environmental evaluation prior to
Council consideration of a proposed zone
Currently, a preferential parking zone IS designated by ordinance However, Section
32 of the General ProvIsions of the California Vehicle Code (eVC) Indicates that when
a local authonty can take action by ordinance, they can also take action by resolution
As outlined above, the process Involves three Council meetings, Involving two public
heanngs, and a 3D-day period before a new preferential parking zone IS established
By designating a preferential parking zone by resolution, It Will only be necessary to
present the matter to Council at one meetrng Additionally, a resolution takes effect
when It IS signed by the Mayor
It IS recommended that once the Parking and Traffic DIVIsIon determines a preferential
parking zone should be established, the proposed zone be forwarded to the CIty
Plannrng DIVIsion to conduct the environmental review After the completion of the
review, the entire matter Will then be scheduled for Council action Currently, the CIty
Planning DIVIsion IS directed to conduct an environmental review after conceptual
approval by the CounCil
The current process takes approximately eight to 10 months from receipt of a
preferential parking request Staff anticipates the changes outlined above Will reduce
that tIme to about SIX months

It should be noted the proposed changes assume the process IS completed by City
staff, especIally the environmental review However, on occasion It may be necessary
to retaIn a consultant to conduct the environmental review and prepare the documents
This would add some time to the processing of requests

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SECTION 308030
OF THE SANTA MONICA MUNICIPAL CODE TO
AMEND THE PROCESS BY WHICH A PREFERENTIAL
PARKING ZONE IS ESTABLISHED
WHEREAS, the City of Santa Monica has determined that the processing of
preferential parking requests should be accelerated, and,
WHEREAS, currently preferential parking zones are established by ordinance,
and,
WHEREAS, Section 32 of the General ProvIsions of the California Vehicle Code
provides that whenever local authontles are gIven power to take action by ordinance
they also have the power to take that action by resolution, and,
WHEREAS, establishing preferential parking zones by resolution would be more
efficient and less time consuming,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS
SECTION 1 Section 3 08 030 of the Santa MOnica Municipal Code IS amended
to read as follows

Section 3 08 030 Desl~natlon of a Preferential ParkrnR Zone
(a) Upon the recommendation of the Parking and Traffic
Engineer, the City Council shall consider areas for designation as
preferential parking zones If the Council finds that an area satisfies the
criteria set forth In this Chapter for preferentIal parking zone designation,
the Council may adopt a Resolution designating an area as a preferential
parking zone and authonze the Parking and Traffic Engineer to establish
appropriate parking restrrctlons for the zone, or
(b) The City Council may, at Its discretion, adopt a Resolution
designating an area as a preferential parking zone and authorize the
Parking and Traffic Engineer to establish appropriate parking restnctlons
for the zone
SECTION 2 Any provIsion of the Santa Monrca Municipal Code or appendices
thereto Inconsistent with the provIsions of this Ordinance, to the extent of such
inCOnsistencies and no further, are hereby repealed or modified to that extent
necessary to affect the provIsions of thiS Ordinance
SECTION 3 If any section, subsection, sentence, clause, or phrase of thiS
Ordinance IS for any reason held to be invalid or unconstitutional by a decIsion of any
court of any competent JUrisdiction, such decIsion shall not affect the validity of the
remaining portions of thiS Ordinance The City Council hereby declares that It would
have passed thiS Ordinance, and each and every section, subsection, sentence,
clause, or phrase not declared Invalid or unconstitutional without regard to whether any
portion of the Ordinance would be subsequently declared Invalid or unconstitutional

SECTION 4 The Mayor shall sIgn and the CIty Clerk shall attest to the passage
of this Ordinance The City Clerk shall cause the same to be published once In the
official newspaper Within 15 days after Its adoption This Ordinance shall become
effective after 30 days from Its adoption
