INTRODUCTION
This report recommends thak the C~ty Caunc~l mtroduce for first readi~g an ordinance to
amend Section 9 04 0$ 12 020 of ArtGCle IX of the Santa Manica Mun~c4pal Code to Enclude
outdoor public utilities and maintenance serrnce yards as perm~tted uses ir~ the RVC
Residential Visitor Commercial Zonmg D~strict On January 25, 1994 the Council adopted
Ordinance 1721 ~CCS) to add outdoor public uttlities and main#enance sernce yards as
a perm~tteci use in tha RVC Distr~ct On June 28, 1994 the Council adopted Ord~nance
1750 (CCS) to add a variety of housing uses as permitted uses m the RVC Qistrict
However, ~rdEnance 1750 inadvertently omitted outdoor public utifities and maintenance
service yards from the RVC District Permitted Uses section The proposed ordinance
cantained in Attachment A wi11 correct the omission
BACKGROUND
The proposed ord~nance to permit autdoor public utilities and maintenance service yards

resulted fram a proposal by the City of Santa Monica's Environmental and Public Works
Management department to develop what is now caifeci the Dry Wea#her Runoff and
Recfamation Fac~iity (~WRFF), a Eaw-flow runoff treatment facrlity, at 1615-4625 Appian
Way The pro~aosed fac~lity is ta be located adlacent to the Mass Avenue sewage pumping
station In additian, the text amendment wouid permit the continued operation of the City's
beach maintenance faciiity iocated at 1~40 The Promenade and the Moss Avenue sewage
pumpmg station. Bath the sewage pumping stafian and the beach maintenanee facility pre-
date the existing RVC District standards and, therefore, are considered legal
nonconforming uses

ordmance is also consGStent w~th the Gity's Land Use Plan of the Local Coastal Program,
spee~f~cally New Development Policy ~9, which allows for outdoor publ~c util~tEes on RVC
zoned parcels located withir~ #he Santa Monica Pier subarea

An ln~t~al Study and Negative Declaratior~ for the text amer~dment contamed in the
proposed ordfnance was prepared an acc~rdar~ce w~th the procedures set torth ~n the
Ca~iforn~a En~ironmental Q~aiity Act (CEQA) ar~d adopted by the City Councii on Jar~~ary
18, 1994 ir~ con~unct~o~ wtth the adoption of Ordmance 1721
PUBLIC NOTIFICATION
Not~ce af the publac hearing was published in the Arqonaut at least ten days ~rior ta the
date of the Counci! hearing (Attachment B)

implement~ng the current Comprehensive Land Use and Zoning Ord~nance wh~ch in
Sectran 9 04 08 12 020 ~~sts the pe~m~tt~d us~s m t~e RVC Residentral-V~sitor Commercra~
zoning district, and
WHEREAS, on .fanuary 25, 1994, the City Council adopted Ordinar~ce 1721 (CCS}

w~th the goals, ab~ect~ves, pol~cies, fand uses and programs of the City's General Plan,
specRfical~y w~th po1~~y statements conta~ned m the Conservat~on Element, includ~ng Pal~cy
Statements 9, 1 Z, 13, a~-d 45 These pofrcies call ~or Crty action to reclaim wastewater,
improved sewage treatment, p~ovide adequate storm drainage and runoff sysfems,
encourage ma~ntenance ofthe recreat~onal aspects of th~ beaeh area anci to maintam and

WHEREAS, the City Councif finds and rieclares that the p~blic health, safety ar~d
gen~ral welfare requires the adoption of the proposed ardinance m order to pro~~de for the
~m~rovement of the env~ror~mental qualrty of #he beach, recla~m storm water for ~rr~gation
and preserve and protect the quai~ty of the Santa Monica Bay
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA MON~CA

of any competent ~urisdiction, such decision shall not effect the ~alydity of #he remaining
