Costs for the FY 1995-96 Annual Street ResurfacIng Program and
Appurtenant Work on Various City Streets
Introduction
ThiS report recommends that the City Council set a public hearrng on May 27, 1997 to 1)
confirm the assessment costs for constructmg and repairing concrete gutters and
sidewalks. resurfacmg streets, and completing appurtenant work. and 2) hear protests
regarding the completed work These Improvements were performed In conjunction with
the FY 1995-96 Annual Street Resurfacing Program at varrous commercial. Industnal, and
residential locations
Background
The FY1995-96 Annual Street Resurtaclng Program Included concrete gutter construction,
street resurfacmg, slurry sealing, parkway pavement removal, curb ramp construction, alley
reconstruction. curb and gutter repairs, and Sidewalk and dnveway constructIOn at vanous
locations In the City The crltena used to determine which streets were Included In that
year's program and the method of repair Included age, dramage problems, surface and
subsurface conditions, complamts received, type of use (I e , commercial and residentIal),
current traffiC volume. and projected change of use or traffiC volume 0: the 6'ts C

accordance with Santa MOnica's "Sustamable City" program, 100% of the eXisting
pavement was recycled and approximately 10,000 used tires were added to the asphalt
mix used In the resurfacing
In accordance With the 1979 City Council policy, residentIal properties are assessed at one
half the cost of removal and replacement of damaged curbs, sidewalks, dnveways, and
parkway pavement CommercIal propertIes are assessed the full cost of the repaIr of thIS
work Residential properties are not assessed for new concrete gutter construction or
street resurfacmg, however. commercial and Industnal property owners are assessed the
full cost of the repairs The assessments are calculated such that each commerCial and
Industnal property owner(s) pays the same umt cost regardless of the Width of the street
affecting their property For street resurfacmg, a tYPical assessment for a commercial or
Industnal property owner With a 50-foot lot IS $1,075 and $1,150 for new gutter
constructIon
On December 28. 1995. notices of the City'S mtent to form a street resurfacing assessment
dlstnct and hold a public heanng were posted and mailed m accordance WIth State law to
all affected property owners The public heanng was held on February 13, 1996, and after
clOSing the publiC heanng, the City CounCil ordered the work to commence
The Annual Street Resurfacing Program IS completed and property owner assessments
are now due A public heanng to confirm the assessment costs must be held pursuant to

Section 5882 of the California Streets and Highways Code The attached resolutIOn sets
the public heanng for 6 30 pm on May 27. 1997 AU affected property owners wIll be
notified of the public heanng date and the assessment amount at least 45 days pnor to the
public heanng A list of property owners and assessment amounts will be available to the
City Council at the time of the public hearing

The assessment dlstnct was admln!stered In accordance wIth the procedure set forth In the
Improvement Act of 1911 of the California Streets and Highways Code and the
Government Code Since this assessment dlstnct was Initiated on February 13, 1996 and
WIll be confirmed pnor to July 1, 1997. It IS exempt from the new assessment reqUirements
of Proposition 218, approved by voters In November, 1996
BudgetlFmanclallmpact
The total project construction cost was approximately $2,000,000 The prOject Included
street repairs, bridge repairs, and earthquake related repairs Funds for the entire project
were paid out of the general fund. the earthquake fund, the water fund, the wastewater
fund, and vanous grant funds ThiS staff report only deals With the assessment portion of
the project Revenue of approximately $227,000 for the repair of Sidewalks, dnveways
and curbs, and the removal of pavement In parkway areas of residential propertIes Will be
deposIted In Revenue Account No 01-500-421-00000-0179-10000, "SIdewalk RepaIr
Revenue"
For commercial and Industnal properties, assessments m the estimated amount of
$422.800 Will be paid by affected property owners and Will be held In a Trust Account No
80-000-000-00000-9750-04392 pendmg payment to the contractor Bonds are Issued for
any unpaid assessments Bond proceeds are paId to the contractor and the property
owner(s) then pay the bond holder(s) over time

Recommendation
Staff recommends that the City Council adopt the attached Resolution setting a public
hearing for May 27. 1997 to confirm the assessment costs for the Improvements
performed In conjunction with the FY1995-96 Annual Street Resurfacmg Program and
appurtenant work at various locations throughout the City

THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOllOWS
SECTION 1 The Superintendent of Streets will file a report of work pursuant to
Section 5882 of the Streets and Highways Code of the State of Callforma, relatmg to the
construction of certain Improvements completed on

SECTION 2 Pursuant to SectIon 5870 et seq of said Code, the City Council does
hereby order and declare that on the 27th day of May at 6 30 pm, In the City Council
Chambers of City Hall, 1685 MaIn Street. Santa Monica, California 90401, It Will hear and
pass upon the report by the Supenntendent of Streets. of the cost of Improvements
together with any objections or protests. If any, which may be raised by any property owner
subject to an assessment for the cost of such Improvements and by any other Interested
persons
SECTION 3 Bonds Will be Issued for noncash assessments Senal bonds bearmg
Interest at the rate of 8 75% per annum shall be Issued to represent each assessment of

One Hundred Frfty dollars ($150) or more remaining unpaid for thirty (30) days after the
recording of the warrant Each senal bond shall extend over a penod ending nine (9) years
from the second day of January next succeeding the next September 1 st following Its date
Payments on the principal of unpaid assessments and mterest shall be made by property
owners to the City Treasurer and the same shall be disbursed by him/her or as provided
In the "Improvement Act of 1911" hereinafter referred to In accordance with the Streets
and Highways Code Section 6442, the first two percent (2%) delinquency penalty
authorized by such section shall be retained by the City for the cost of servicing the
delmquency
SECTION 4 All protests or objections must be In wntlng and filed with the City
Clerk on or before the time set for the hearmg of the protests and objections
SECTION 5 City Staff IS hereby directed to mall notices, pursuant to Government
Code Section 54954 6, In the manner and form preSCribed by law, of the cost of
Improvement and of the adoption of thiS ResolutIon to all persons owning commercial,
Ind ustnal. or reSidentIal real property In the hereinbefore deSCribed assessment dIstrict
whose names and addresses appear on the last equalized assessment roll for the City
taxes or as known to City Staff
SECTION 6 City Staff IS directed to publish thiS Resolution, In accordance With
Government Code Section 6063. In The Outlook once a week for three weeks With at least

five days Intervemng between each date of publication The first publicatIon IS to be made
not less than 45 days prior to the date of the above public hearing
SECTION 7 The City Clerk shall certify to the adoption of thiS Resolution, and
thenceforth and thereafter the same shall be In full force and effect
