STTE L4CA'~'ION A~ID DESCRIP'~'ION The sub~ect property is a 8,360 square faot parcel located on t~e north s~de pf Wilshire Blvd. at the northwest comer of the intersection of Wilshire Bivd. and Ct~elsea Avenue having a frontage of 76 feet. Surraunding uses consist of a multi-family residenhal use (R2 zoriing district) across an alIey ta the north, an urgent care facility (C6 zomng dismict) aczoss Wilshire Blvd. to the south, a public park (DP zoning district) acrass Chelsea Avenue to the east, arid an amrnal hospita~ t~se (CC zoning distnct) to the west. Existing on-site use is a fast-food restaurant with a drive-up window. Zoning District: C6 Land Use District: General Commercial Parcel Area: 8,36(} square feet NfUI~IICIPAL CODE AI~TD GEAIERAL PLAN CONFORMANCE S~nc~ 1988, Sect~an 9.04. ].4.090 of the Municipal Cade has raquired that the operations of new or expanded fast-food resta~arants lacated adjacent to residentially-zoned property be 1 lim~ted to the hours af 7:IX}am ta 20:OOpm. The exist~ng fast-food resta~rant pre-dates tt~e above referenced section of the Mun~cipai Code and therefore, is exe~npt from these pro~isions. However, on Apni 11, 1995, the City Council adopted Intenm ~rdinance 3~1794 (extended on lune 13, 1995 by Intenm Ordinance #180{) which requires exishng fast-food restaurants located adjacent to or separated by an ailey from res~dentially-zoned properties which do not ha~e either a Conditional Use Permit (CUP) or a Development Review (DR) Pernut to obtain a CUP to operate a dri~e-up windaw between the haurs of 10:0{)pm and 7:0[}am. 'T~e apphcant praposes to construct a steel tube and glass acoustical sound screen approxirnately forty-faur {4~} feet long and approxxmately fourteen (14) feet in height adj~cent to the drive-up window aisle. Sec#in~ 9.04.10.04.080{a)(2) of the Zoning Ordinance limits the height of the acoustical saund screen to eight (8) feet in height. Therefore, the applicant has also app~ied fvr a ~anari~e in aecordance wi~h Section 9.Q4.24.10 of the Zoning Ord~nance. CEOA STATU$ T'~e pmject is categorically exempt from the provisions af CEQA, pursuant ta Class S of the S±a±? Guidelines in that a Conditio~al Use Permit and Variance are cvnsidered minor land use l~mztations. 'Tf~e project is not subject ~o any speciaT Planning and Zoning related fees. The pro~ect is exempt fr~m the Housing and Parks Pro~ect Mit~gation fee established by Ordi~nance No. 1367 (CCS}, based on ~he fact that the proje~t will nat result in the new coz~struction of 15,OOQ net rentable square feat or ihe addlrion to an exist~ng pro1ect of 10,000 net rentable squaze feet or mare of affice ~ea. PUBLIC NOTIFICATION Pursuant to Municipal Code Se~t~on 9.04.20 24.0$0, within 30 days after the subj~t apphcatian was deemed complete, the applicant posted a sign on the property stating the following iriformation: Project case number, bzief project c~escription, narne and telephane nurnber of applicant, site address, date, time and loeation of public hearing, and the Plannir~g and Zoning Division phone number. it is the apphcant's responsit~ility to update the hearing date if it is changed after posting. In addition, pursuant to Municipal Code Section 9.04.20.22.050, not~ce of the public hearing was mailed to all owners and resident~al and commercial tenants of property located within a 500 foot radius of the pro~ect at least ten consecutive calendaz days priar to the hearing. A copy of the not~ce is contatned in Attact~jnent B. 2 ANALYSFS Back~'oun~ The exisring fast-food restaurant and drive-up window operabon c~rrently has no discrEtionary permits. As a resuit of neighbvr's complaints about naise associated with the late-night operations of drive-up windows at several fast food restaurants located adjacent to resident~al areas, the Ciry Council considered a number o~ diff~rent approaches to address the iss~e. On April 11, 1995, the Councii adopted Intenm Ordinance #1794 which requires that ea~isting drive-through restaurants witt~out CUP's or DR's whic~ want to operate a drive-up window between the hours of 10:00pm and 7:IXlam apply for a CUP v~nthin sixty days or ciase the c~rive-up window portion of the restaurant betwcen 10:00pm and 7:4(}am. Ordinance #1794, which was extended by the City Council on June 13, 1995 by interim ardinance #1806 also states that any CUP granted pursuant to tEus ordinarice shail contain a condition that as of May 1, 1998, the dri~e-up window operation shall cease entirely between the hours o€ 10:0~pm anci 7:OOarn. Subsequendy, on October 17, 1995, ~he City Counci~ adopted Ordinance i81~ {CCS) to require that as of May 1, 1998 drive-up windows at existing fasE food resta~rants located adjacent ta res~dentially zoned praperkies shall be closed between 7:OOarn and 1Q:40pm. In accordance with Qrdinance #1$06, the applicant is requesting a CUP ta operate the dri~e- up window porn€on of the Jack-in-the-Box Restaurant between the hours of 6:OUa3n and 1:U(}am daily. The apphcant is proposing to constretct an acoustical sound wall between the dnve-up a~sle and the alley at the rear af the property to attenuate the naise impacts which are associated with the late nigh~ operations of the drive-up window. The applicant is also requesting a Variance to allow the construction o€ the sound wail above the permitted eight feet ir~ height. T'he sound wall rises vertically to a height of ten (10) feet. A diverting attachment of four (4) €eet intended to deflect noise toward the s~bject property is attached to the ~ertical rise at a forty-f ve (45) degree angle. T`he applicant hired Gira~x & Associates, an environmental consulting firm, to perform acoustical testing over t~ree nig~its at the restaurant to document no~se condit~ons and ta ident~fy nvise-generaang acp.~i~ies that would benefit from enhanced noise control (see attachment D}. The consultants dac~mented eight (8) ins~ances attributable to restaurant acti~ities dunng their study period which exceeded the City's nacttirnal standard for peak noise events. Six (6) of the occurrences were directly related ta the operation of the drive-up window (car horn - 3 times; ~ehicies in dnve-up axsle - 2 times; persvn shouting to another car - 1 time}. Giroux & Associates recommended three actions to reduce the noise impacts: 1) terminate dnve-through food service at 1:OOam (five of the six incidences cited pre~+iously occurred after 1:04am}; 2) establish a silent-speaker ordenng systern which is directed away frorri the r'esidential area ta the narth; and 3) erect an acoustical saund wall a minimum of eaght (8) feet in height, topped by a four (4) foot slanted panel to deflect sound southward. Gu~aux & Assoc~ates estimates that the sound wall would be able to abate noise impacts by 10 to ~5 decibels, which wo~Id have reduced aIl eight (S) af the registered vio~ations of the City's nocturnal. standards zeferenced abo~e ta a le~el that is within complianoe of tt~e City standard. The City's nvise consultants, Mestre, Grieve & Assoc., have reviewed ttie plans for the acoustical sound wall and estimate tt~at it wiIl abate the noise by S ta 10 decibels. 3 Ttus estirnated reductton woutd have a2so brought a~l of the registered noised vio~at~ons into compliance with the City standard. Additionally, the City's cansultan~s recommended that the wall be designed as a contig~ous str~cture v~nthout gaps between supporting steel tubing and glass pane~s to ens~re proper noise atter~uation. The busir~es~ currently has a silent-speaker order~ng system on the mertu boarc~ which faces the rear property line and the resider~aal uses across the alley. The applicant praposes to install a second silent-speaker ordenng system which wi~l be located at the pick up window and used during the haurs of 6:OOam ro 7•0{lam at~d 10:00pm to 1:Oflam ~aiiy. Staff recommends as a condition of appraval that the applicant be required to post a sign at the menu board indicating that orders shall be taken at the pick up window between 6:OOam and 7;(l~ am and 1D:OOprn and 1:UOam ~aily. Interim Qrdinance #1$06 pravides as follaws: "In grantiatg a Conditional Use Pernut, the Planning Commission, or City Council an appeal may impose such condiaons as are necessary to insure that the authorized drive-~p window operati~n is not detrimental to surrounding properties or residents by reason of lights, noise, activities, parking or other achons." Therefore, conditions which rnay be imposed in approvimg tlus CUP ne~tl to relate ta the impac~ of the drive-up operations authorizaci after 1Q:OQpm and befare 7:OOam. Conditians related to the establishment's general aperation are not authorized by this ordinance. The Ctty has recei~ed complaints from nearby residents with respect to the noise generated by the loud-spea,ker ordering system and t~ie general noise of customers who are ordering fast-food during late-~ght hours. Staff is recomrrtending that, as a condit~on af approva~, the applic~t provide on-site security persannel during the foilowing hours of operatian af the drive-up window: i0:00pm to 1:0[fam and 6:OOam to 7:0(lam daily. Nei~hbori~ooci Comnatibilitv The acaustical sound wall which is pmposed by the agplica~t to mitrgate pm~ect-related noise impacts on ad~acent residential properties and the additional silent speaker ord~ring system for the dnve-up window will help ens~re neighbarhood compatibility during the hours of aperation af the dnve-up window as contained in fhis CUP application. RECOMMENDA'I7QN It is recommerided that the Planning Cammissian approve the application for a Conditional Use Permif and Vanance based upon the fallowing findings and subject to the conditians as 4 listed below: CONDITIONAL USE PERMIT FINDINGS 1. The propose~ use is condirionally permitted within the sub~ect district and complies with all of the agpt~ca6le pro~isions of the "City of Santa Monica Comprehensi~e Land Use and Zaning ardinance", in tt~at ~he dri~e-~p windaw operatian has been in existence since 1964. 2. The proposed use would not impair the ~ntegnty and character of the district in which it is to be established or located, in that the noise irnpacts of extending ~he hours of operation af the dnve-up window from 7:OOam to 30:OOprn daily to 6:IX}am to 1:0(}am daily can, according to a report submitted hy the agplicant's environmerital ccrosultants Giroux & Assaciates, be attenuated by the acanstical sound wail and additional silent-s~eaker ordering system as proposed by the applicant and with the an-site security person recommended by staff as a condition of approval of this CUP. 3. The sub~ect parcel ~s physically suitable for the type of land use being proposed, in ihat the existing land use witt remain and the physical exgansion associated with this agplication is limited to the installation of an acaustical svund screen and additional silent-speaker ordering system as shown an plans dated October 20, 1995. 4. The praposed use is compatible with the land uses presently an the subject parcel in that the ex~sting land use will remain. S. The propased ~se wo~ld be c~mpati~le with existing and permissible land uses within the district a~d the general area in whic~ the propased use is to be located, in that the proposed use (a dn~e-up w~ndow) been in opera~on since 1964. Additionally, the physical expansion associated with this applicat~on is limited to the installation of an acousticai sound wall and additional s~lent-speaker ordering system as shown on plans dated October 2Q, 1995. 6. There are adequate provisions far water, sanitat~on, and public utilities and services to ensure that the proposed use would not be detrimental to public healch and safety, in that the existing use will remain and the physical expansion associated with this applicarion is limited to the installat~on of an acoustical souncE wall and additional silent-speaker ordenng system as shown on p3ans dated October 2~, 1995. 7. Public access to the proposed use will be adequate ~n that the installation of the acoustical sound wall and addit~onal silent-speaker ordering system will not make alterations ~o existing parking or circulatio~ and adequate access to the alley at the rear property line wiit be maintained. T'~e proposed use will not res~It in an vverconcentration of such uses in the immediate vicinity in that the drive-up window use will not change. VARIANCE FINI7INGS 1. There aze special circumstances or exceptional charactenstics applicable to the property in~ol~ed, including size, size, shape, topography, lacation or surround~ngs, or tu the intended use or de~elopment of the property that do not apply to other properties in the vicinity under identrcal zoning classification, in that the design and fourteen (14) height d~me~~ion of the sound wall proposed by the appllcant is in accordance with that recammended by the appl~canC's sound engineenr~g cons~ltant in order to attenuate the noise irr~pacts of late night operations of the dri-+e-~p wmdow on adjacent resi~ential uses. 2. The gr~ting af s~c~t varianoe wi~~ not be detrimenta.t or inJ~rious to the pragerty or improvements in the general vicinity an~ d15tr1Ct in which the property is located, in that the sound ~uvall as proposed will benefit the area as it is intended to attenuate the noise impacts of late night aperat~ons of the ~n~e-up window on adjacent residential uses. 3. The strict application af the provisions of this Chapter would result in prachcat d~fficu~ties or unnecessary hardships, not inc~udu~g e~ono2nic diffic~tiss or economic hardships, in that a sound wall limited to e~ght ($) feet in height woulci not effeehvely attenuate the noise impacts af the late night operations af the dnve-up w~ndaw on a,~jacent residentiai uses. 4. The granting of a variance will not be contrary to or in conflict with the general purpases and intent of this Chapter, or to the goals, ob~ectives and poiicies af the Gen~raI Plan, in that the propased sound wall is to be constnzcted fos ~se vvith a 5 drive-up window that has been in aperation since 19b4 and currently operates 24 hours per day. The hours of operation of the dri~e-up window will be reduced in accordance with the CUP applicat~on submitted cancurrentiy with this vanance application. S. The variance would not impair tt~e integrity and character of the distnct in which it is to be located, in that the saund wall as proposed wiil benefit the area as it is intended to attenuate the noise impacts of late night operations of the drive-up window on adjacent residentia~ uses_ 6. The subject site is physically smtable for the propnsed variance, in that the proposed sound wall is located eighteen {18) feet frorn the adjacent mult~-family residenhai building ta the north, and rises iess than three {3} above a fence which sepazates the mulh-family residential bnilding frorr~ the alley. 7. There are adequate pro~isions for water, sanitat~on, and public utilities and services to ensure that the proposed varianc~ wouid nvt be detrimental to public health and safety, ~ that the existing use w711 remain and the physical expansion assocxated w~th this apphcaaon is limited to the installat~on of an acoustical saund wall. 8. There will be adeq~ate provisians for publ~c access to serve the subject vaziance proposal, in that the physical expansion associated with this applicat~on is limited ta the installation of an acoustical sound wal.l 9. CONDITIONS Pla~ns 1. This approval is for ~ose pians dated October 20, 1995, a copy of which shall be maintained in the files of the Planning and Zoning Divisio~. Project development shall be consistent with such p1ans, except as at~erw~se speczfed in these cvndiaons of approval. 2. The Plans shail camply w~th all other provisxans of Chapter 1, Arncle IX of the Municipal Code, (Zoning Ordinance) and a~l other pertinent ord~nances and General Pla~ policies of the Cxty of Sarita Monica. ~ 3. Muior amendments to the plans shall be subject to approval by the Director of Planning and Cammunity Development. A significant change in the approved concept shall be subject to Planning Commission Review. Construct~on shall be in conformance with the plans submitted or as modified by the Planning Commission, Architectural Review Board ar Darector af Planning arrd Community Deve~oprnent. Archite~tural Review Board 4. Plans for final design of the aco~ast~cal sound wall and ad~it~onal silent-speaker prdering sysiem shall be subject to re~iew anc~ approval by the Archite~tural Review Board. 5. As appropriate, the Architectural Review Boaxd shall require the use of anti- gxaffiti matenals on surfaces likely to attract graffiti. Constructian 6. Unless otherwise approved by the Department of Environtnental and Public Works Management, all sidewalks shall be kept clear and passable during co~struction. 7. Sidewaiks, curbs, gutters, pa~ing and dnveways which need replacing or removal as a result af the pro~ect as de~ermined by the Department of Environmental arid P~blic Vi7orks Managernent shal~ be reconstructed to the sat~sfactian c~f the Department of Environmental and Public Works Management. Appraval for ~is work shall be obtained fram tlse Department af En~ironmental and Public Works Management priar to issuance of the building permits. S. Vehicles ~auling dirt or other construction debns from the s~te shall cover any open load with a tarpaulin or other secure cavering to minizruze dust emissions. 9. A sign shall be posted on the property in a manner consistent with the public heanng sign requ~rements wh~ch shall ~dentify the address and phane number of the owner andlor appiicant for the pt~rposes of responding to c~uestions artd complaints dunng the construct~on of ~E~e sound wail. Street and~or alley lighting shall be provided on public nghts-of-way adjacent to the project if and as ne~ded per the specifica~io~s and with the approval of the Department of Envu~or~mental an~ Public Works Management. 14. Final bu~ldutg ptans submitted far approval of a building permit shall include the location and design of the acousrical saund wail and the new silent-speaker ordering system. V~liditv of Permits 15. In the event permittee violates or fails to comply vsnth any candi~ions of approval of ttus permit, no further permits, licenses, or approvals shall be issued until such violation has been fully remedierl. 16. Within ten days of Planning Di~isian transmittal of the Staternent of Official Actian, project applicant shall sign and return a copy of the Staternent of ~fficial Actian prepared by the Pianning Division, agreeing to the Conditions of appcova.l and acknowledging that failure to comply with such con~itions shall constitute grounds for potentiai revocation of the permit approval. By signing ~ame, applicant shall not thereby waave any legal rights applicant may possess regarding said conditions. 'Tf~e signed Statement shail be returned to the Planning and Zoning Division. Failure to comply with this condition shall const~tute grounds for potential perntit revocatian. 17. This determination shall nat becorne effective for a period af faurteen days from the date of determination or, if appealed, vnt~l a final determination is made on the appeal. Any appeal must be made in tti~ form rec~uired by the Zoning Administrator. The approval af th~s perm~c shall expire one year from the permit's effective. date, unless, in the case of new development, a building permit has be~n obtained prior to the expiration of this approva~ in order to exercise the rights granted by this approva~. This permit shall also expire if the b~ilding perfnit expires or ~f the rights granted under tlus appraval are r~ot exercised withici one year following the earliest to occur of the following: ~ssuance of a Certificate af Occupancy or, if no C~rtificate of Occupancy is requirecE, the last required final inspectian for the new construction. One six month extensian may be permitted if approved by the Direc~or of P~anning and Comrnunity Development. Special Conditions 18. The additional silent-speaker ordering system s~awn on plans dated October 20, 1995, shall be uti~ized withaut loud spealcer ampl~fication between the hours of 6:0{}am and 7:OOam as well as 10:OOpm and 1•OOam daily. A sign indicat~ng that 9 fast-food oxc~ers wiIl be taken at ihe second silent-speaker ordering system during the hours indicated above shali be conspicuousiy displaye~cl at the menu board. ~9. Between the hvurs of 10:0{)pm to 1:UDam and 6•0{}arn to 7:0(}am daily, the applicant stlail provide an on-prernises se~urity person who shall work to ensure that th~ dnve-up window opeFat~ons shali be conduct~ in a manner not detnmen- tal to surroun~ing properties or residents by reason of lights, noise, activit~es, parking or other achons. 20. The haurs af operation of ttie drive-up window contained rn this permit shall take effect upan tt~e installation of the acaustical saund wa~l and additianal silent- speaker ordering system as proposed by the applicant. Unhl such time as the acoustical sound wall and additional silent-speaker ordering system are installed arfd approved by the City, the hours of aperation of the dri~e-up window shall be 7:OOam to 10:IX}pm daily. 21. The acoustical sound wall s~all be designed as a contiguous structure without gaps between supporting steel tubing and g~ass panels to ensure proper noise attenuation. 22. in accordance with Interim Ordinar~ce #1 SOb, this Condihonal Use Permit shall expire as of May 1, 199$. At that t~me, the drive-up w~ndow portior~ af the fast- food restaurant on the site shall be closed between tne hours of 10_0(}pm and 7:OOam daily. ND15E ordinance compliance req~ires an assessment of noise level difterences between the source in operation versus the saurce shutdown. This concept works we~l for fixed noise sources such as pumps, air conditioners, generators, etc. It does not w4rk ~ell when the ambient background and the source both are variable in time. Rather than the average, however, peaks are general~y we11 defined as comang either from restaurant acti.vities or ambient sources. Compliance was therefare evaluated in terms o€ meeting the peak exposure criteria. Peaks are particu~arly appropriate because humans ~espond more to peaks than to averages. Within reason, one can psychological~y adapt to most steady-state no~.se levels. It is the deviations fram the average {the unusual) that triggers human reactian rather than the usual 1evel. Noise I~ionitoring Noise measurements were made an three nights. Measurements were made from 8 p.m_ to midnight on Thursday, September 28, 1995. Based upon noise complaints recei~ed fram adjacertt candominium owners, nuisance events are more prevalent on weekends and may extend beyond m~dnight. A second study was therefore conducted on Friday, Octoher 20 and Saturday, octabe~ 2~, running from 9:3U p.m. to 2 a.m. for each perzod. Two or three lacations were monitared. One location was on a tripod at the north side of the alley separating the restaurant from the nearest residence identif~ed as the "Al~ey" site. A second meter was deployed at~p the wal~ along the driveway leading into the parking area far the residences, called the "Wall" site. A third meter was deployed in the bushes near th~ Enclosure for the refuse bin in order to get as cldse as possible to the dx-ive-thro~gh, callEd the "Bushes" monitar. This -5- meter was designed to differentiate betwe~n drive-thraugh noise versus averall parking ~ot activity or non-site noise generation. The measur~m~nt locations are shown on the sketch in Figure 1. An observ~r noted any special audib~e noise events an a minute-by- minute basis to aliow far subsequent eorre~ation of ind~vidual readings with ident~fiable events. The observer's ~ocat~on in the northernmost parking space within the lot is also shown in Figure ~. Measurements were made with a Larson-Davis Labs Mode~ 700B integrating noise dosimeter at the alley site. Near the speaker and near the con~a parking entrance, an Extech Model D40773~ meter coup~ed to a"Stow-Away" Mvdel SVB32 digztal data logger was used to record noise levels. The peak noise levels recarded at all sites, along with observer notes on the ca~se of individual peaks, are presented in the appendix. Sound waves spread sphez~cally from a point source of emissions. Acaustical energy is attenuated proportional to the surface area of the sphere through which it passes just Iike solar Energy dissipates with increasing distance from the sun. Mathematically~ this spreading loss is expr~ssed as a decay of 6 dB of sound pressure level fo~ each doub~ing af trav~], distance. If, for example, a nai.se event accurs 3 feet fra~n the ~icrophone and the meter is ].0 feet from the nearest condominium window, the naise level at the window wil]. be ~.3 dB lawer than recvrd~d at the meter. If, however, the event occurs 30 ~eet from the meter and 40 feet from the wzndow, the exgosure at the window will be only 2.~ dB lower. In evaluat~.ng the exposure of the adjoining xesidents, the noise measurement data thus needs to be qualified in t~nns of the saurce- receiver distance. An observ~d 75 d8 due to a source next to the meter likely is well below 75 dB at the windows of the condominiums. A 75 dB readzng d~e tc~ a source at the drive- through, parkinq lot or from traffic on Che~.sea or Wilshire prabably is close ta 75 dB at the residence as well. Residential Naise Exposure Figure 2 shows the instantaneous no3se levels at the "wall" monitor an the three nights vf data co~lection. A tatal of 2~ events vf 75 dH or more were observed on the three nights. Some occurred before ~Q p.rn., some were due to local contamination ~ram events in c~ose proximity ta the meter, and some were due to non-restaurant activiti~s, and some were duE to events in the parkang lot or drive-through that did exceed the City standard. A list of the majar single noise events is presented in Table 2. Although Thursday night had more sing~e events {9) than Friday (8) or Saturday (4), ~ost of Thursday events occurr~d before ~0 p.m. while mast of Friday's single events were after ~ a,m. The drive- through speaker was not operating properly on Saturday night with tha order taker's orde~ confir~ation clearly audible, but not exceeding the standard. Table 3 summarizes the source of readings over 75 dB. Of the 21 observed ev~nts, the estimate af possible violations of standards was as fol~ows: Close to meter, probably less than 75 dB at residence - 6 Non restaurant sources in a1~ey or street - 7 Restaurant act~vities - 8 The eight events associated with restaurant activity were examined mo~e closely. Table 4 shows that six of those events were possible violations of standards. Two recommendations, if implemented, wou~d have reduced these six probable violations of the City standard to zero. They are: 1. Tern~znate drive-through food service at 1 a.m. This recommendatxon would ha~e eli~ainated five of the six ~ikely abserved violations of the City standard on a].lowable peak noise. 2. Establish a night speaker approx~mately ~D feet farther around the drive-thraugh ais~e with a silent confirmation screen. Erect a barrier around the narthern drive-throuqh perimeter terminating at the aJ.].ey and coveri.ng as ].arqe a#ield of view as possib~e to shiel.d residential windows from a direct line of siqht. The barrier design should be of qlass or plastic in vertical panels to a minimunE heiqht of 8 feet topped by a 4- foot slanted panel deflecting sound southward. A minimum pane~ thickness of 0.5 inch for safety glass or 0.75 inch for plastic ~.aminate is recommended to assure adequate wall mass to prevent sound re-transmission. Noise abatement effectiveness from barriers depends upon the transma.ssion path-1.ength difference between the refracted sound wave over the barrier versus the direct source ta receiver path. For an infinite barrier configured as above, the noise attenuation From ~rive-through activities would be almost 24 dB. Because vf side leakage around the end of the recommended wall, noise reduction effectiveness is estimated to be z~-15 dB. The prvposed measure thus wi.ll reduee drive-through activity noise in excess of 10 dB and wo~xZd have eli~ainated the ane pre-~ a.~a. excess noise event. This barrzer will also eliminate audibility of post-3o p.m. order placement as wel~. as creatinq noticeabJ.e noise reduction even for pre-ZO p.m. drive-through use. While there ~nay be isnl,ated, pre-1 a.~n. events in the lot in the future not screened by the drive-through pratection, we believe that the above recom~endations wi31 al~eviate a very large percentage of any perceived noise nuisance from existi.ng operatians. The brave-Ti-crough ~s Iocated at 2425 WilshZre Blvd. in the c~ty of Santa ~Ionica, and is apen to the public 24 hours a day. The Che~.sea Ave. condomini~m bualcEing, which is zoned i~-2, and the Drl~e~ Through area of ~he restaurant, which is zoned C-4, are separa~ed by an alley. Durzng the past year, rtoise and traffic between the hours of i1;00 P.M and 3:Q0 A.M. (particularly on weekends) have ~ncreased ta disturhing ~evels for ad~a~ning nezghborhaod t~omeowners and residents. The problems are tWOfo~d: 1. Residents are awakened by rowdy, noisy customers whp honk their horns to get Restaurant personnel to servx~e them, and 2. Custamers need to loudly shout their orders into the microphone in order to get ti~e attention of personnel. Several residents have phoned the Res[aurant during these ~isturhances, bnt have had ~~ttle to no success in cornmunicating with personne~ or in reducing the noxse le~el. It shauld be noted that the original appiication that Jack submitted had restricted hours. Cynica~Zy, they have re-submitted t~eir applicatian ta abtain unrestricted hours af their drive thru, keeping the same hours that they current~y operate. That cartainly has nat tak~n inta ace~unt the cancerns of the neighbors. Jack has cansistently operated from a position af unreasonableness, havinq taken no steps to mitigate the drzve thru problems, despite years of complaints. Please control this unruly monster with a Conditional Use Permit that allows reasonable haurs of peace and quiet to the neighborhoad. (It would ~e nice if you ordered thern to p~ck up their trash ~n the neighborhood as well.) The ho~rs of drive thru aperation should not esceed the followinq: Closed between 10 p.m. and 7 a.m. 3unday through Thursday niqhts and closed Midniqht to 7 a.m. Friday and Saturc3ay niqhts. Jack has uti~.i~ed so called "free gocds", the space around and c3ose to their property, to the detriment of others. It is apparent that th~se goods aren~t free. The costs of Jack's drive thru operataon. in the f~rm of disturbed sleep and denial of the right of q~iet enjoyment of ~heir hames, are born by the neighbors. The environmenta~ and quality of ~ife casts, that Jack inflicts on all of us, need to be curtailed. Jack soaks up sa much of our police protect~on that City CQUncil considered them a pu~alic nuisance. Palice costs are bora by all city ta}rpayers, yet, Jack uses a dispropartionate amount of these city services. YQU and I have to pay, not only for the cast of providinq excess service for them but also in suffering the reduced availabi2ity af police, when we need that service. Jack is a free loader, they exploit the public good whenever they can. Curtailing drive thru hours will go a long way towards mit~gating the costs of Jack's business that is born by the nezghbors and yourselves. It is only a small price for Jack to pay. Emplayees do not respand to our comp3aints, and c~aim they have no way to mitigate noi5e problems. 7. EMPLOYEES AND MANAGEMENT CANNOT CONTROL ~R REGULATE BEHAVIOR oF CUSTOMERS. People in their awn cars are often rude, rowdy and drunk or high, especially late at night. Signs have been posted at the drive-thru for several years aska.ng people not to honk their car horns. We have met several times witti ~oodmaker attornsys and on-site Jack--in-the- Box management. Promi.ses have been made, but never kept. As far as we are cancerned The Foodmaker organization has no credibility in that it has shown no respons~bility tvwards respect~ng the rights of trie adjaining residential neighborhood, as evidenced, for instance, on the night vf February 14, 1995. On that night we returned hcme at 10:00 p.m. from a Drive-thru hearing at City Council tv find that Jack-in-the-Box had planned an a11 night cQnstruction prolect in the parking lot. Hawever, they neglected to secure a permit to do so, we aierted the police, and this additional ].ate night activity was ha3.ted. 11.
