SITE LOCA nON AND DESCRIPTION
The subject property IS a 8,409 square foot parcel located on the east side of Lmcoln Blvd.
at the northeast comer of the mtersectIon of Lincoln Blvd. and Grant Street having a frontage
of 101.5 feet. Surrounding uses conSIst of a sportmg goods retail use (C4 zoning dIStrict) to
the north, a bar (C4 zonmg dIStrIct) across Grant Street to the south, a motel (R2 zoning
distnct) to the east, and an insurance agency office use (C4 zoning district) across Lincoln
Boulevard to the west. The eXIstmg on.site use is a fast-food restaurani with a drive-up
wmdow which currently operates 24-hours per day.

MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
Smce 1988, Section 9.04.14.090 of the Mumcipal Code has required that the operat:J.ons of
new or expanded fast-food restaurants located adjacent to residentially-zoned property be
limited to the hours of 7:00am to !0:00pm. The eXIsting fast-food restaurant pre-dates the
above referenced section of the Mumclpal Code and therefore, is exempt from these

provisions. However, on April 11, 1995, the CIty Council adopted Interim OrdInance #1794
(extended on June 13, 1995 by Intenm Ordinance #1806) which requires existing fast-food
restaurants located adjacent to or separated by an alley from residentially-zoned properties
which do not have either a Conditional Use Permit (CUP) or a Development ReView (DR)
Pennlt to obtain a CUP to operate a dnve-up window between the hours of !0:00pm and
7:00am.
CEOA STATUS
The project is categorically exempt from the proVISions of CEQA, pursuant to Class 5 of the
State GUldelmes in that a ConditIonal Use Permit is considered a minor land use hmitation.
FEES
The project is not subject to any spec13.l Planning and Zoning related fees.
The project is exempt from the Housing and Parks Project Mitigation fee established by
Ordmance No. 1367 (CCS), based on the fact that the project will not result in the new
construcuon of 15,000 net rentable square feet or the addition to an existing project of
10,000 net rentable square feet or more of office area.
PUBLIC NOTIFICA nON
Pursuant to Mumclpal Code Section 9.04.20.20.080, Within 30 days after the subject
applIcauon was deemed complete, the applicant posted a sign on the property stating the
followmg mfonnation: Project case number, bnef project description, name and telephone
number of applIcant, site address, date, time and locatIon of pubhc hearing, and the Planning
and Zomng DlVlSlon phone number. It IS the applicant's responsibility to update the hearing
date if It IS changed after posting.
In addItIon, pursuant to Municipal Code Section 9.04.20.22.050, notice of the public hearing
was mailed to all owners and residentIal and commercIal tenants of property located WIthin a
500 foot radius of the project at least ten consecutive calendar days pnor to the hearing. A
copy of the notice IS contained In Attachment A.
ANALYSIS
Background
The eXisting fast-food restaurant and dnve-up Wlndow operation currently has no
dlSCretlOnary permits. As a result of neighbor's complaints about nOIse associated with the
late-mght operaUons of drive-up wmdows at several fast food restaurants located adjacent to
reSIdentIal areas, - the CIty Council conSIdered a number of different approaches to address the
Issue. After receiving input and mformation from CIty staff, on March 28, 1995, the City
Council passed a Resolution of Intenuon directing the Planning Commission to initiate an
amendment to the Zorung Ordinance which would, as of May 1, 1998, lirmt the hours of

operatIon of drive-up wmdows of existmg restaurants located adjacent to resIdentially-zoned
propertIes to between 7:00am and 10:00pm. AddItIOnally, on April 11, 1995, the Council
adopted Intenm Ordmance #1794 which requrres that dnve-through restaurants without
CUP's or DR's wluch want to operate a drive-up window between the hours of lO:OOpm and
7:00am apply for a CUP WIthIn sixty days or close the dnve-up window pomon of the
restaurant between lO:OOpm and 7:00am. Ordinance #1794, which was extended by the CIty
Council on June 13, 1995 by Interim Ordmance #1806 also contams a provisIOn that, as of
May I, 1998, all dnve-up windows at fast-food restaurants cease operations between the
hours of 10:00pm and 7:00am.
In accordance with tlus Ordinance, the applicant is requestIng a CUP to operate the drive-up
wmdow portion of the Jack-m-the-Box Restaurant between the hours of 6:00am and 1:00am
Sunday through Thursday and 6:00am and 3:00am Fridays and Saturdays. The applicant is
proposing to construct a kiosk at the entrance to the dnve-up aisle. An employee would take
fast-food orders from inSIde the kiosk between the hours of 10:00pm and 1:00am Sunday
through Thursday and between lO:OOpm and 3:00am on Fridays and Saturdays. Orders will
be pIcked-up and paId for at the drive-up wmdow. The applicant is also proposing additional
landscapmg along the eastern property line between the drive-up aisle and the alley to the
east to attenuate nOIse associated with drive-up window operations.
Intenm Ordinance #1806 provides as follows: wIn granting a Conditional Use Permit, the
Planning CommIssIon, or City Council on appeal may impose such conditIons as are
necessary to Insure that the authorized drive-up window operation is not detrimental to
surrounding properties or residents by reason of lights, noise, activitIes, parking or other
actions" Therefore, conditIons which may be imposed in approving this CUP need to relate
to the Impact of the drive-up operatIons authorized after IO:OOpm and before 7:00am.
CondItIOns related to the establishment's general operation are not authonzed by this
ordmance
The City has receIved compl31nts from nearby reSIdents with respect to the nOIse generated
by the loud-speaker ordenng system and the general noise of customers who are ordenng
fast-food dunng late-mght hours. Staff 15 recommending that, as a condinon of approval, the
applIcant prOVIde on-site secunty personnel dunng the follOWing hours of operation of the
dnve-up wmdow: lO:OOpm to 1 :OOam Sunday through Thursday ~ lO:OOpm to 3:00am Fnday
and Saturdays and from 6:00am to 7:00a.m daily.
PrOlect DeSIgn The placement of the kIosk, the kiosk deSIgn, the placement of the relocated
menu board and addltional landscapmg as shown on plans submitted as part of this
applIcatIon will be subject to review and approval of the ArchItectural ReVIew Board.
Parlang: and CIrculation The landscapmg as shown on plans submitted as part of this
applIcatIon shall be Installed so as to have no impacts on CIrculation. No Impacts on parkmg
are antlcIpated.
NeIghborhood COffiDatibihty The proposed bosk and landscaping contained in the
applIcatlon and the on-site secunty person reqUIred as a condition of approval of this
applIcatlon to mItIgate project-related nOIse impacts on adjacent residentIally-zoned propertIes

will help ensure neighborhood compatibility during the hours of operation of the drive-up
wmdowas contamed in the staff recommendation.
ConclUSIOn It IS the conclusion of staff that approvmg the application as submitted for the
operanon of the dnve-up wmdow between the hours of lO:OOpm to 1:00am Sunday through
Thursday and from 10:00pm to 3:00am on Fridays and Saturdays along with the
recommended conditions as contaIned in thiS staff report will not significantly affect the other
land uses m the area if the applicant complies With the condlt:J.ons of the staff
recommendation.
RECOMMEND A nON
It is recommended that the Planning CommisSIOn approve the application for a Condmonal
Use Permit based upon the followlOg findings and subject to the conditions as hsted below:
CONDITIONAL USE PERMIT FINDINGS
1. The proposed use is conditIonally permitted withm the subject district and
comphes With all of the applicable proviSIOns of the "City of Santa Monica
Comprehensive Land Use and Zoning Ordinance-, in that the drive-up window
operanon has been in existence since 1965.
2 The proposed use would not impaIr the integrity and character of the district in
which It IS to be established or located, in that the noise impacts of extending the
hours of operation of the drive-up wmdow from 7:00am to !0:00pm daily to
between 6:00am and 1:00am Sunday through Thursday and from 6:00am to
3:00am on Fndays and Saturdays can be reduced with the operation of the kiosk
and increased landscapmg proposed br the applicant and the on-site security
person recommended by staff as a condition of approval of this CUP.
3 The subject parcel is physically SUitable for the type of land use being proposed,

servIceS to ensure that the proposed use would not be detrimental to public health
and safety, in that the existing use will remain and the physical expansion
associated with this applIcatIon is limited to the installation of a kiosk and
landscaping as shown on plans dated August 15, 1995.
7. Public access to the proposed use will be adequate, in that no alterations to
existing parking, circulatIon or access are proposed as part of this appl.1catIon.
8. The physical location or placement of the use on the site is compatible with and
relates harmomously to the surrounding neighborhood, 10 that the physical
expansion associated WIth tlus applIcation IS hooted to the installation of a laosk
and landscaping as shown on plans dated August 15, 1995.
9 The proposed use is consistent with the goals, objectives, and pollcies of the
General Plan, in that no change of use at the subject property IS proposed in this
applIcation.
10. The proposed use would not be detrimental to the public interest, health, safety,
convenience, or general welfare, in that the adverse impacts of extending the
hours of operation of the drive-up window from 7:00am to IO:OOpm daily to
between 6:00am and 1:00am Sunday through Thursday and from 6:00am to
3:00am on Fridays and Saturdays can be reduced with the operation of the kiosk
and increased landscaping as proposed by the applicant and the on-site security
person recommended by staff as a condition of approval of this CUP.
11. The proposed use will not result In an overconcentratIon of such uses m the
Immediate vic10ity in that the dnve-up window use will not change.
CONDITIONS
Plans
1 This approval IS for those plans dated on August 15, 1995, a copy of which shall
be maintained in the files of the Planning and Zoning Division. Project
development shall be consistent with such plans, except as otherwise specified in
these conditions of approval.
2. The Plans shall comply WIth all other proVlsions of Chapter 1, Article IX of the
MUniCIpal Code, (Zoning Ordmance) and all other pertinent ordinances and
General Plan policies of the City of Santa Momca.
3. Mmor amendments to the plans shall be subject to approval by the Drrector of
Plannmg and Community Development. A sigmficant change in the approved
concept shall be subject to Planmng CommiSSIOn Review. Constructlon shall be
10 conformance with the plans submitted or as modified by the Planning
CommiSSIon, Architectural ReVIew Board or Director of Planning and
Community Development.

4. Plans for the bosk. additional landscaping and the new locatIon of the menu
board contained in tlus application shall be subject to review and approval by the
Architectural Review Board. Plans shall be submItted to the ArchItectural
Review Board In accordance with the submittal gUIdelines.
Construction
5. Unless otherwise approved by the Department of Envrronmental and Pubhc
Works Management. all sidewalks shall be kept clear and passable dunng
construction.
6. SIdewalks, curbs, gutters, paVIng and driveways which need replacing or removal
as a result of the project as determined by the Department of Environmental and
Public Works Management shall be reconstructed to the satisfactIon of the
Department of Environmental and Public Works Management. Approval for this
work shall be obtained from the Department of Environmental and Public Works
Management prior to issuance of the building penmts.
7. Vehicles hauling dirt or other construction debris from the site shall cover any
open load with a tarpaulin or other secure covenng to minimize dust emissions.
8. A sign shall be posted on the property in a manner consistent With the public
hearing sign requirements whIch shall identify the address and phone number of
the owner and/or applicant for the purposes of respondmg to questIons and
complamts dunng constructIon. SaId sign shall also mdicate the hours of
pemussible construction work.
9. The property owner shall msure any graffiti on the site is promptly removed
through compliance with the City's graffiti removal program.
10. A copy of these condItions shall be posted in an easIly visible and accessible
location at all times during construction at the project SIte. The pages shall be
lammated or otheTWlse protected to ensure durabilIty of the copy.
Miscellaneous ConditIons
11 The dnve-up wmdow hours of operation shall be from between 6:00am and
1:00am Sunday through Thursday and between 6:00am and 3:00am Fnday and

Saturday.
12. The operation of the drive-up window shall be conducted in a manner not
detrimental to surroundmg properties or resIdents by reason of lights, nOIse,
activities, parking or other actions.
13. Street and/or alley lighting shall be provided on public nghts-of-way adjacent to
the project if and as needed per the specIfications and with the approval of the
Department of Environmental and Pubhc Works Management.
14. The hours of operanon of the dnve-up window shall be conspIcuously displayed
mside and outside of the restaurant.
Validitv of Permits
15. In the event permittee VIOlates or fails to comply Wlth any conditions of approval
of this permit, no further permits, licenses, or approvals shall be issued until
such violation has been fully remedied.
16 Withm ten days of Planning Division transmittal of the Statement of OffiC1al
ActIon, project apphcant shall SIgn and return a copy of the Statement of Official
ActIon prepared by the Planning Division, agreeing to the Conditions of approval
and acknowledging that failure to comply with such conditions shall constitute
grounds for potential revocation of the permit approval. By signing same,
appl1cant shall not thereby waive any legal rights applicant may possess regarding
saId conditIons. The signed Statement shall be returned to the Planning and
Zomng DiVIsion. FaIlure to comply WIth this condiuon shall constitute grounds
for potentIal permn revocation.
17 This determination shall not become effectIve for a period of founeen days from
the date of detemllnatIon or, if appealed, until a final detemnnation is made on
the appeal. Any appeal must be made In the form required by the Zoning
AdmInistrator. The approval of thiS permit shall expire one year from the
penmt's effecnve date, unless, in the case of new development, a building permit
has been obtamed prior to the expiratIon of this approval in order to exercise the
nghts granted by this approval. This permit shall also expire if the building
penrot expIres or If the rights granted under this approval are not exercised
within one year following the earliest to occur of the following: issuance of a
Certificate of Occupancy or, If no Certificate of Occupancy IS required, the last
required final inspectIon for the new constructIon. One six month extenSIOn may
be permItted If approved by the Duector of Planning and Community
Development.
Special Conditions

18. The kiosk as shown m the plans dated August 15, 1995. shall be utilIZed WIthout
loud speaker amplIficatIon between the hours of lO:OOpm and 1:00am Sunday
through Thursday, 1O.OOpm and 3:00am Fnday and Saturday and 6:00am and
7:00am daily. A sign mdicating that fast-food orders will be taken at the bosk
and the hours of operanon of the bask shall be conspIcuously displayed at the
menu board.
19. Addttional landscapmg shall be Installed along the eao::tern property line
asmdIcated on the plans, dated August 15, 1995 and subject to reVIew and
approval of the Arclutectural RevIew Board. The landscapmg shall be of a
sufficIent denSIty and matunty to attenuate the nOise assocIated with the drive-up
wmdow operations and reduce the noise impacts on adjacent residennally-zoned
propertIes to the east.
20. Between the hours of lO:OOpm and 1:00am Sunday through Thursday, !0:00pm
and 3:00am Fnday and Saturday and 6:00am and 7:00am daily, the applicant
shall provide an on-premIses security person who shall work to ensure that the
dnve-up wmdow operatlons shall be conducted in a manner not detnmental to
surrounding propernes or residents by reason of lights. noise, activitles. parking
or other actions.
21. The hours of operation of the drive-up window contained In this permit shall take
effect upon the installanon of the kiosk and landscaping as proposed by the
apphcant. Until such tJ.me as the bosk and landscaping IS installed and approved
by the City, the hours of operation of the drive-up wmdow shall be 7 : OOam to
lO:OOpm daIly.
22 In accordance WIth Intenm Ordmance #1806, thIS CondItional Use PermIt shall
expire as of May I, 1998. At that orne, the drive-up window pornon of the fast-
food restaurant on the site shall be closed between the hours of lO'OOprn and

To all members of the Planning Division:
My husband and I reside at 835 Grant Street *4, Santa
Mon~ca, one-half block east of the Jack-In-The-Box Restaurant
which is the subject of the above-referenced application. We
have serious concerns about the request for an extension of hours
for the drive-up operation given the bar/pool hall located
directly across the street and the ever-present prostitutes that
ply their wares at that corner.
It would seem to be a poor idea to extend the Jack-In-The-
Box drive-up hours until the wee hours of the morning, given the
unsavory elements already attracted to that corner in the middle
of the nlght. We hardly need to make the area that much more
attractive, at that time, with the prospect of available food as
well.
We would hope that you would s~riously consider the
detrimental effects of such extendea hours upon the adjoining
nelghborhood and that you would vote to deny the conditional use
permlt.

reSIdents. and I am concerned that the mcreased excepnonally late hours of operanon will compound our
problem of undesIrable elements m the neighborhood. F.trSt, we have had to complain constantly to the
Santa MOnIca Police about drug and prosutute acUVlty associated with the Santa MOnica Motel on the
southwest comer of Lmcoln Boulevard and Grant Street and the Rest Haven Motel behmd Jack-m-tbe-Box
on the northeast comer of the intersectIon. In fact, the owners of the Santa Monica Motel were mstructed
to post a warmng SIgn about thIS illegal actIVIty outsIde their premises. Then there IS the BIg John Tavern
on the southeast corner and the Jolly Jack Tavern one block south on Lmcoln Boulevard, both of which
attract addItIOnal and potenually questionable acUVlly to this area. Finally. we also have two liquor stores
WIthm one block of thIS intersectIon. one one block south of Grant Street on the east side of Lincoln and
the other one block south of Grant Street on the west SIde of LIncoln.

at the expense of the peace and safety of the resIdents. We certamly don't need. more people cruismg our
neIghborhood between 10:00 pm and 3:00 am on the weekends or between 10:00 pm and 1:00 am the rest
of the week If thIS busmess were on Montana Avenue. tlus request would be rejected immediately. We
who hve south of PICO Boulevard deserve and demand the same consIderations. I urge you to reject this
applIcatIOn WhICh will further conmbute to the deterioraung quahty of life m Santa Moruca.

Dear commissioners:
We have been asked by Foodmaker, Inc. ("Foodmaker")
and its franchisee to briefly comment on the staff report and
proposed conditions submitted to you by the planning staff for
the public hearing on Foodmaker's application (the "CUP
Application") for a conditional use permit (the "CUP") to
permit extended operation of the existing drive-through
facilities.
Foodmaker and its franchisee respectfully request
that the proposed conditions and findings in the staff report
be revised, as follows:
1. The Planning Commission should not adopt
proposed Condition No. 12. If the Planning Commission grants
the CUP, it will necessarily make the finding that the
contemplated use is not detrimental to surrounding properties
or residents. Foodmaker's franchisee has offered to construct
a kiosk to mitigate noise impacts on the surrounding area. The
franchisee is willing to do so to obtain a degree of certainty
that it will, at a minimum, have the right to operate the
drive-through facilities during evening hours until May 1,
1998. Condition No. 12, which is very loosely worded, would
introduce a new element of uncertainty as to whether the
franchisee would have the right to continue that operation.

The City has appropriate remedies if the operation of the
restaurant creates a nuisance. It also appears that Condition
No. 12 relates to the overall operation of the restaurant, as
opposed to only the operation of the drive-through facilities,
which is the subject of the CUP Application.
2. The Planning Commission should not adopt
Condition No. 20, which requires an onsite "security person"
during the extended hours. The presence of the kiosk will be
sufficient to mitigate the drive-through window's noise impact
during those hours. There is no evidence that the presence of
a security person will achieve any further noise mitigation.
The crime and safety issues raised by three residents (in
letters attached at the end of the staff report) relate solely
to the motel adjacent to the restaurant site and other nearby
uses. The restaurant has not been the cause of these problems.
It is also important to note that the restaurant is not located
adjacent to any residential use (the adjacent motel is on
residentially-zoned property, but is not a residential use).
In addition, it would be extremely impractical and
difficult for the franchisee to hire a security person to work
for a three-hour period during the evening (10:00 p.m. to
1:00 a.m.) and one hour in the morning (6:00 a.m. to
7:00 a.m.). Given that the franchisee has offered to construct
the noise barrier at considerable expense, it should not incur
the additional, unnecessary expense of hiring a security
person.
3. Condition No. 21 should be revised to permit the
extended operation of the drive-through window immediately, and
to prohibit those extended hours if the kiosk has not been
constructed within 60 days following ARB approval. The
franchisee should not be required to suffer financial hardship
so long as it proceeds in good faith to obtain ARB approval.

Fnends of Sunset Park has, for some ume now, supported Santa Momca resIdents m
theIr ongomg attempts to gam peace and quiet m theIr homes by limitIng the operatJ.on
of dnve thru windows at fast food restaurants.
One of the purposes of this letter is to appnse you of our dISCUSSIOns with several
resIdents on Bay Street who have, in the past, voiced therr serious concerns WIth the
nOIse and nwsance level generated by the eXIsting drive thm operatIon Also, of
major concern to resIdents are late night cnme problems for whIch tIns restaurant
proVIdes an attractIve base. It IS partIcularly cntIcal to consIder tlns safety issue ill
bght of the current crime cnSIS ill and around Sunset Park wlnch includes several
rapes and two murders wnhm the last several months. These reSIdents, include sernor
CItizens and others who have been unable, for various reasons to partJ.Clpate in the
Plannmg process.
On behalf of those resIdents we respectfully request that operatIon of the drive up
wmdow be restncted to Sunday thru Thursday 7 a.m. to IDldmght and
