INTRODUCTION The City Council has directed the City Attorney to prepare an ordinance enlarging Preferential Parking Zone "L" which is located m the area of Santa Monica College Staff recommended that prior to adoption of such ordinance, the Counc~i authorize the preparation of an Environmental Impact Report (EIR) to analyze any potential adverse environmental impacts to the area caused by the expansion of the preferential parking zone Based on the results of the EIR, staff is recommending the adoption of the accompanyEng resolution certifying the EIR and the introduction for first reading of the attached ordinance which amends Santa Monica Municipal Code Section 3 08 240 to enlarge Preferential Parking Zane "L" BACKGROUND Staff received a petition from residents to the 1600 and 1700 blocks of Oak Street requesting the establishment of preferential parking in their neighborhood, an area south DEC t l 1996 r~} ~~ _ ~ +~ of Santa Monica College and Preferential Parking Zane "L" For the most part, the area ~s impacted by non-resident porkers attending Santa Monaca College with additional non- resident porkers visiting commercial development along Ocean Park Boulevard A parking study indicated that Oak Street between 16th and 18th Streets qualified far preferential parking In analyzing the parking study, staff also determined that there ~s a possability the parking problem will shift to neighbonng streets once the two (2) blocks of Oak Street are posted Therefore, staff has recommended establishing a larger zone with the anticipation that the residents of these surrounding streets will want to be included in the zone at a later date This approach of establishing a larger zone has been successfully implemented in the past By establishing a larger zone, preferential parking for adjacent streets can be implemented when petitions are received from the residents of the street without the need to proceed with the long preferential parking process The proposed area to be included in Preferential Parking Zone "L" is primarily single-family resident4ai with some multi-family development ENVIRONMENTAL IMPACT REPORT Preferential Parking Zane °L" was originally established by Council m 1988 and included the area of Santa Monica College and the surrounding area of approximately eighteen (18} blocks In 1991, the zone was expanded by another approximately thirty-two {32} blocks to create a preferential parking zone stretching from Euclid Street to Cloverfield Boulevard 2 and from the I-10 freeway to Ocean Park Boulevard Srnce this proposed expansion would add another eighteen (18) blocks to the zone, staff recommended that an EIR be prepared for the project The City Gouncil authorized the preparation of the EIR to analyze any potential adverse environmental impacts associated with thES second expansion of Preferential Parking Zone "t_" An environmental impact report (FEIR} was prepared in accordance wEth the provisions of the California Environmental QualEty Act (CEQA) and the City's CEQA Admmistratwe Guidelines (Attachment A) The FEIR was prepared to examine potentEally significant environmental impacts associated with implementing permit parking within the expansion area and to identify mitigation measures capable of avoiding or substantially lessening those impacts The FEIR concluded that there were two areas of less-than-significant impact These include the following • Potential impact to the Office of Parking Enforcement and the degree to which they have sufficient personnel and equipment to service the expanded preferen#ial parking area • PotentEal neighborhood impacts such as intrusive non-resident parking and potential adverse effects resulting from shifting of non-resident parking demand into adjacent areas In response to the potential impact to the Office of Parking Enforcement, the FEIR concludes that the impact is less than significant because current personnel can adequately serve the expanded area and no additional personnel or equipment would be needed Therefore, no mitigation measure related to parking enforcement is necessary In response to the potential neighborhood impacts, the FEIR concludes that neighborhood 3 ampacts would be less than significant because the "disruptive effects" of the preferential parking program were not significant enough to alter neighborhood character or disrupt the normal activities or patterns of activities or the neighborhood The FEIR identifies the following as the only area of potentially s~gn~ficant impact that could result from the implementation of the proposed protect • Potential impacts related to shifts m parking patterns Specifically, the potent~ai for shifting of displaced non-resident parking from the permitted area either to adtacent residential streets andlor to the Santa Monica College satellite parking facility which lacks sufficient capacity to accommodate additional parking during peak demand Should this occur, the FEIR states that Santa Monaca College could implement a series of measures as ident~fed m the FEIR to mitigate the potential impact If the measures implemented by Santa Monica College are unsuccessful, the preferential parkng area could be expanded beyond the recommended boundaries of the zone Should this be necessary, additional environmental review will be required With the inclusion of these mitigation measures, the protect will have no significant impact The FEIR also examines alternatives to the proposed protect (kncludmg "No Protect") and the potential adverse impacts of those alternatives Only the "No Protect" alternative was deemed environmentally superior to the proposed protect (however, this alternative does not address the problem of non-resident parking intrusion into the neighborhood) 4 The findings of the FEIR conclude that all potentially significant 4mpacts are either less than significant or can be reduced to less than significant levels through mitigation, and that there is no environmentally superior alternative to the protect that would achieve the protect goals Staff is recommending that the Council adopt the resolution certifying the Final EIR (Attachment B) DISCUSSION OF RECOMMENDED ORDINANCE The accompanying ordinance amends Municipal Code Section 3 08 240 to enlarge the existing Preferential Parking Zone "L" around Santa Monica College Currently, Preferential Parking Zone "L" consists of the area bounded by Euclid Street on the west, the Santa Monica Freeway on the north, Cloverf~eid Boulevard on the east and Ocean Park Boulevard on the south The accompanying ordinance enlarges than zone by adding an area south of Ocean Park Boulevard between Eucltd Street and 23rd Street to Ashland Avenue The expanded Preferential Parking Zone "L", therefore, is specifically described as the area bounded by Euclid Street between Ashland Avenue and the Santa Monica Freeway on the west, the Santa Monica Freeway between Euclid Street and Clove~eld Boulevard on the north, Cloverfield Boulevard between the Santa Monica Freeway and Ocean Park Boulevard, Ocean Park Boulevard between Cloverfield Boulevard and 23rd Street, and 23rd Street between Ocean Park Boulevard and Ashland Avenue on the east, and Ashland between 23rd Street and Euclid Street on the south Parking restrictions within the expanded Preferential Parking Zone "L" will remain the same, i e , no parking from 8 00 am to 8 00 pm Monday through Thursday, and from 8 00 am to 5 00 pm on 5 Friday, except by permit All other provisions applicable to preferential parking zones would apply If this ordinance is adopted, only the 1fi00 and 1700 blocks of Oak Street will be posted at this time for preferentral parkrng Approval of this larger zone allows the other streets located within the zone to be posted when and rf the residents request without the need for the lengthy preferential parkrng process BUDGETIFINANGIAL IMPACT It rs estimated that approximately 150 permits will be purchased by area residents in the proposed zones This will generate approximately $2,250 annually rn additional revenue Upon adoption of the ordinance establishing the preferentral parking zone, budget revenue account 01-21015-00000-0029-10000 should be revised to reflect an increase of $2,250 Installation of signs will be done by Crty crews The department's current budget should be sufficient to finance necessary expenditures involved with posting these zones RECOMMENDATION It is respectfully recommended that the City Council 1 Adopt the resolution certifying the final environmental impact report 2 Introduce the accompanying ordinance for first reading 3 Upon adoption of ordinance increase revenue budget account 01-210-415- (2} 8:00 a.m. to 5:00 p.m. on Friday of each week. {c} Any vehicle parked or stopped without a permit when required by this Section may be removed from the street by any police officer. (d} The annual fee for each permit issued for Preferential Parking Zane L shall be $15.00 per permit, or such other fee as may be established from time to time by resolution of the City Council. SECTION 2. Any provision of the Santa Monica Municipal Code ar appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effective 30 days from its adoption.
