SUBJECT Introduction and First Reading of Ordinance Amending Chapter 8 24 of
the Santa MOnica Municipal Code Concerning Underground Storage
Tanks
INTRODUCTION
In order to become an approved Certified Unified Program Agency (CUPA), the City IS
required to amend chapter 8 24 of the Municipal Code concerning underground storage
tanks This staff report Introduces the ordinance for the first reading
BACKGROUND
In early 1996. the City Council authorIZed staff to apply to the California Environmental
Protection Agency (CaIEPA), Department of ToxIc Substance Control (DTSC) to
become a Certified Unified Program Agency (CUPA) As a CUPA, the City IS required
to coordinate, consolidate and make consistent the aspects of regulating hazardous
matenals and hazardous waste In the City The aspects of hazardous waste that the
City currently regulates Include underground storage tanks (UST). above-ground
storage tanks. the Communlty-nght-to-know program, Article 80 of the Uniform Fire
Code, and the Risk Management and Prevenllon Program, and Hazardous Waste
Generator program

Currently, all programs are administered and managed within the City by either the
Environmental Programs DIvIsion, the Santa Monica Fire Department, or the Los
Angeles County Fire Department The Los Angeles County Fire Department manages
the Hazardous Waste Generator Program, all others are managed by the City
The section of the Santa Monica Municipal code regarding UST has not been updated
since 1983 and IS not consistent with state law Therefore, In order for the City to be
certified as a CUPA, the Municipal Code must be updated to become consistent with
state law
DISClJSSION
USTs that contain hazardous matenals pose a potential nsk to ground water supplies In
the City The current underground storage tank ordinance does not sufficiently protect
beneficial uses Over the past 13 years, there have been many changes to state law
regarding USTs that are not reflected In our municipal ordinance State law requires
that mUnicipalities that regulate USTs must have ordinances that are consistent with
state law If a municipality desires to have an ordinance that IS different than what has
been adopted state-wide, the municipality must petition the Cal-EPA to have a
different UST ordinance Staff has determined that adopting state law by reference IS
the most effiCient method of Insunng that the City IS In compliance with state law

Because the City IS not petitioning the state to have an ordinance that IS different than
state law, there IS no budgeVflscallmpact There IS a $5000 processing fee If the City
desired to petition the state to have an ordinance that IS different than state law There
IS no budgeUflscallmpact
RECOMMENDATIONS
Staff recommends that the City Council adopt state law as the City's new underground
storage tank ordinance

CITY OF SANTA MONICA AMENDING AND ADDING
PROVISIONS TO CHAPTER 8.24 OF THE SANTA MONICA

ORDAIN AS FOLLOWS.
SECTION 1. Santa Monica Mun~c~pal Code Section 8.24.010 is
amended to read as follows:
8.24.010 F~ndings and purpose.
The City Council finds and declares as follows:
(a) Substances hazardous to the public health
and safety, and to the environment, are stored
prior to use or disposal ~n underground locations
in the City.
(b) Underground tanks used for the storage of
hazardous substances and wastes are potent~al
sources of contam~nat~on of the ground and

its City Councll, boards and commissions, officers,
agents, servants, and employees under this Chapter
require the exercise of discretion and judgment.
SECTION 28. Any provision of the Santa Monica Municipal
Code or appendlces thereto inconsistent with the provisions of this
Ordlnance, to the extent of such lnconslstencies and no further,
are hereby repealed or modified to that extent necessary to affect
the provisions of this Ordinance.
SECTION 29. If any section, subsection, sentence, clause, or
phrase of this Ordinance is for any reason held to be invalid or
unconstltutlonal by a decision of any court of competent
jurlsdlction, such decislon shall not affect the validity of the
remaining portions of this Ordinance The City Council hereby
declares that it would have passed this Ordlnance and each and
every section, subsectlon, sentence, clause, or phrase not declared
invalld or unconstitutional wlthout regard to whether any portlon
of the ordlnance would be subsequently declared invalid or
unconstitutional.
SECTION 30. The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance. The City Clerk shall
cause the same to be publlshed once in the official newspaper
