SUBJECT An Ordinance to Allow Public Safety Dispatchers to Participate In the Peace
Officer Standards and Training (POST) Program
Introduction
At Its meeting on May 25, 1999, the City Council directed the City Attorney to prepare an
ordinance authOriZing Public Safety Dispatchers In the Police Department to participate In
the training provided under the auspices of the Peace OffIcer Standards and Training
(POST) CommissIon The attached ordinance responds to that direction
DISCUSSion
The State requires any city which opts to utilize POST training to adopt an ordinance
accepting the requirements of Penal Code Sections 1351 O(c) and 13512 Those sections
require adherence to POST standards for recrUitment and training and cooperation With
any POST inqUiry as to compliance The attached ordmance, which was requested by the
Santa MOnica Police Department, fulfills that requIrement as to the CIty's PublIC Safety
Dispatchers

Budget/Financial Impacts
The PolIce Department estimates that this OrdInance would cost an average of $2,000 per
year, those funds are available In the operating budget of the PolIce Department In
addition, POST will reimburse a portIon of the City's costs to train Public Safety
Dispatchers, although It is Impossible to determine how much reimbursement monies will
be received each year
Recommendation
Staff recommends that the accompanYIng ordinance be Introduced for first reading

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA TO ALLOW PUBLIC
SAFETY DISPATCHERS TO PARTICIPATE IN THE
PEACE OFFICER STANDARDS AND TRAINING PROGRAM
WHEREAS, the Peace Officer Standards and Training (POST) Commission adopts
rules for the purpose of raising the level of competency and establishing minimum
standards relating to recruiting and training law enforcement staff, including PubliC Safety
Dispatchers, and offers training programs as well, and
WHEREAS, the State of California requires all Cities which Wish to send members
of their law enforcement staff to the POST training to adopt an ordinance accepting the
requirements of California Penal Code Sections 13501 (c) and 13512, and
WHE REAS. POST Will reimburse the City for a portion of Its costs for tramlng Public
Safety Dispatchers, and
WHEREAS, the City of Santa Monica desires to send Its Public Safety Dispatchers
to receIve POST tralnlng,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY ORDAIN AS FOllOWS
SECTION 1 The City Council hereby accepts the requirements Imposed by

California Penal Code Section 1351 O(c), namely, that the City Will adhere to the standards
for recrUItment and traIning establIshed by the CommIssIon on Peace Officer Standards
and Training
SECTION 2 The City Council hereby accepts the requirements Imposed by
Callforn la Penal Code Section 13512, namely, that the City Will cooperate with any Inqu Iry
made by the Commission on Peace Officer Standards and Training to ascertain that the
City's Public Safety Dispatchers are adhering to the Commission's standards for selectIon
and training
SECTION 3 Any provIsIon of the Santa Monica Municipal Code or appendices
thereto Inconsistent with the provIsions of this Ordinance, to the extent of such
inCOnsistencies and no further, IS hereby repealed or modified to that extent necessary to
effect the provIsions of this Ordinance
SECTION 4 If any section, subsection, sentence, clause, or phrase of this
Ordmance IS for any reason held to be Invalid or unconstitutional by a decIsion of any court
of competent JUrisdiction, such decIsion shall not affect the validity of the remaining
portions of this Ordinance The City Council hereby declares that It would have passed thiS
Ordrnance and each and every sectIon, subsectIon, sentence, clause, or phrase not
declared invalid or unconstitutional Without regard to whether any portion ofthe ordinance
would be subsequently declared invalid or unconstitutional

SECTION 5 The Mayor shall sIgn and the CIty Clerk shall attest to the passage of
thiS Ordinance The City Clerk shall cause the same to be published once In the offiCial
newspaper wlthm 15 days after Its adoption ThiS Ordinance shall become effective 30
days from ItS adoption
