" council Mtg: June 15, 1993 TO: Mayor and CIty Council FROM: CIty Staff SUBJECT: Statenent of Official Action for Tenant-Participating Conversion 270 and Vesting Tentative Tract }'lap 51424, for the property located at 153 San Vicente Boulevard INTRODUCTION ThIS report recoMMends that the City Council approve the attached statement of Official Action for the denIal of Tenant-Particlpating conversion (TPC) 270 and Vesting Tentative Tract Map (VTTM) 51424 for the property located at 153 San VIcente Boulevard. On May 11, 1993, the City Council voted 5-2 on a motlon in favor of denying TPC 270 and VTTM 51424 without prjudice. BUDGET/FINANCIAL IMPACT The recommendation presented in this report does not have any budget or fiscal impact. ThlS Tenant-Participating Conversion Application does not meet the requirewents of Artlcle XX of the City Charter of the Clty of Santa Monica ln that insufficient slgnatures of cosigning tenants have been obtained. [reference Sec. 2004 (a), Article XX] 2. The Tenant-Participating Conversion Application has been deemed complete and accepted for filing. At the time of filing it met the requirements of section 2002 of Article XX of the City Charter for a complete application. However, based on data submitted Slnce that time, it has been determlned that the application fails to meet all of the requlreMents of Section 2002 of Artlcle XX of the city Charter. The subject application was signed by cosigning tenants occupying 70% (not less than two-thirds) of all - 1 - the residential units in the building. However, four of these signatures have been obtained from tenants who have not been shown to quallfy as cosigning Tenants. These individuals are Daniel Anzel (unit 2K) Paula Vasilas (unit 3B), Sophie Vasilas (unit 4A), and Anthony Vasilas (unit 4K). Danlel Anzel's Agreement to ConverSlon form was not submitted within the time limits set forth by Ar- ticle XX. Paula Vasilas occupies a unit WhlCh is joined to another unit for which a vote has also been cast. As a total of one vote is permitted per household, Ms. Vasilas' vote is not val1d. For the remaining tenants listed above, Sophie and Anthony Vasilas, the applicant has not demonstrated that they personally and continuously occu- pied their units as their principal residences for the six months prior to slgning the "Agreement to Conversion" forM, as requlred under Section 2001 (b) . Without these four votes, the applIcatIon does not contain the minimum of 2/3 tenant approval required by Article XX. Tentative Map FIndings 1. The proposed subdivision, together with its provisions for its design and Improvements, 1S lnconsistent with Article XX of the city of Santa Monica Charter.
