INTRODUCTION
This report recommends that the City Council approve Zone Change
(ZC) 92-002 and Specific Plan Amendment (SPA) 92-001 ta change
the Official Districting Map ~ar the north side of Sroadway
between 20th and 23rd Streets from C4 (Highway Cammercial) to
CP-3 (Commercial Professional) and ta amend th~ Hospital Area
Specific P1an to include these parc~ls within the Specific Plan
area. Pursuant to the requirements of the California
Environmental Qual.ity Act {CEQA}, ~his report also recommends
approvaZ of Initial. Study 93-003 and N~gativ~ Daclaration for the
proposed application. On May 19, 1993, the Planning Commission
vo~ed 4-0 on a rmotion to approve the applicatian and associated
Negata.ve Declaration, with one abstention and two absenc~s.
BACKGROUND
Appl.icatian Description
The applicant fi~ed SPA 92-001 and ZC 92-Q02 an December 23,
1992. Included in the application is a petition szgned by ov~r
50 Santa Monica res~dents in support of the proposal. Although

no application has been submitted for a developmant in
association with the proposed amendments, the applicant stated in
a letter to staff that "order~y expansion of health care
faciZities for Saint Jahn's Hospital requires the inc~usion of
its property and similarily~situated property within the Haspital
Area Speci£io Plan (HASP) and the CP Zone." (Attachment A.)
S~veral parcels and portions af parcels on the north side of
Broadway between 2~th and 23rd Streets would changa from a C4
District designation to a CP~3 ~istrict designation i~ the
proposal is adopted by the City Council. This area is between
l00 and 150 feet in depth from the Broadway street fronta~e,
encompasses a total of 106,844 square feet, and is b~sected by
21st Streat, as shown in the plans contained in Attachment N.
Most af the affected parc~ls are utiilized for sur£ace parking. A
port'lon of a G~neral Telephone sw~tching stat~on~ an 8-story
senior housing building, two one-story office structures, and two
1-story residential duplexes are also contained on the subject
parcels.
The affected ar~a is surrQUndad by a number of different Land Us~
Districts, including CP-3 (Commercial Professional), R3 {Medium
Density Multiple Family Residential), BCD (Broadway CommerciaZ)~
C4 (Highway Commercial), and C5 (Special Office) Districts, as
shown in the ~vllowing table:

CEQA Status
The propased Spec~fic Plan Amendment and Zone Change does n~t
qualify for a categorical exemption under the City of Santa Moni-
ca Guidelines for the Implementation of tha California Enviran-
mental Quality Act (CEQA). An Initia~ Study Checklist and pro-
posed Negative ~eclaratian were prepared for which the 3a-day
comment period end~d on April lg, 1993. No comm~nts were
received. Tf the City Council approves the application and
adopts a Negative Declaration, a certified Negative Decla~ation
will be prepared and a Notice of Determinatian will be filed with
the County Clerk. A copy Qf the Initia~ Study Checklist and pro-
posed Negative Dec~aration are included in Attachment B.

ANALYSIS
Land Use and Density Implica~ians of the Praposed Specific Plan
Map Amendment and Zone Change
The area proposed for rezoning was included in the original Study
Area €or the Hospital Area Specific Plan (HASP), as shown in At-
tachment C. However, it was not included in the area recommen-
ded for rezaning within the HASP, as shown in Attachment D. Per
the HASP, the parcels currently under revie~r urere nat re~oned te
CP-3 and therefore remain part of the C4 District.
The propvsal would result in a madification of the Official F3is-
tricting Map to shaw "CP-3" rathar than C4 f~r the affected par-
cels, and a modification of Maps I5 and 16 of the HASP to show
tha subject parcels as re2oned to "CP" designations rather than
the current C4. No change to the text of the Zoning Ordinance or
the text of the HABP is proposed.
A maximum FAR of 1.5 applies to the subject C4-zaned parcels as
af the time of this hearing date. However, based on the Coun-
cil~s action on June 15, 1993, the FAR for the C4-zoned parcals
over 7,50z square feet is substan~ially lower than 1.5 for proj-
ects without a residential component. The one change with regard
to permitted usas in the C4 District will be that residentia].
~nixed-use projects will not require a Performance Standards
Permit.
The proposal wou~d resu7.t in a change to the uses permitted an
the subject parcels. The current C4 designation allows general

retail, office and automobile-serving uses (SMMC Sections
9.04.08.22.02~-050}. The proposed CP-3 d~signation would
primarily allow medica~-related uses, including medical-related
retail uses, medical affice uses, hospitals, and "affices and
meeting raoms far charitable, youth and welfare organizations."
It is difficult ta characterize the change in permitted uses in
terms of intensity, as the permitted uses are different in
character. The proposa]. would a~low restaurants of any size by
right, whereas the current zoning requires a CUP far any res-
taurant af more than 50 seats; it would eliminate drive-in,
drive-through, take-out and fast-food restaurants as possible
uses an the subject parcels; it wauld eliminate service stations
and autamobile dealerships as possible uses on the subject par-
cels; and it would a~law residential uses by right (or with a
Perforn~ance standards Permi~ if part of a mixed use project},
whereas the C4 designation allows residentia~ projects anly if a
Performance Standards Permit is abtained. (Ordinance ~635{CCS),
which is effective until August 14, 1993, allows residential uses
in a~l cammercial districts without requiring a Performance Stan-
dards Permit.)
The proposal would not resu~t in any new nonconforming uses. The
surface parking which occupies most of the parcels requires a
Conditional Use Permit under both the C4 and CP-3 designatians if
it is nat on the same parcel as tha building which utiZizes the
parking. The portion af the General Telephone switching station
would remain a 1ega1 nancon€flrming use, the senior housing and

dup~exes wauld become conforming us~s, and the medical office
~ses wou~d xemain conforming us~s.
With ane exception, the maximum permitted tloar area ratio (FAR)
of 1.5 would remain intaet if the zoning designatian is changed
to CP-3 as proposed. The exception would be the provision of the
CP-3 Section which states that parking structures have no limit
on the number of stories and, if develaped with "at least half of
the spaces... provided to address an existing parking space de-
ficiency or [to replace] existing parking," no maximum FAR shall
apply but the maximum heiqht must not exce~d the maximum of A5
feet parmitted in the District (SMMC Sections 9.04.08.30.03D~a]
and [b]),
For all types of deveLopment, th~ proposed change wou~d result in
an increase in the maximum height from 2 ta 3 stories and from 30
feet to 45 feet. The pr~posal wou~d also result in a required
minimum front yard setback of 20', whereas the current C4 desig-
nation does not have a frant yard setback requirement ather than
a Zandscaped area eq~al to 1.5 times the street frontage.
The change in development standards wauld create a nonconforming
f~ont yard ~etback for th~ one-story medical affice buildings and
residential duplexes wh~ch are located on three parcels fronting
23rd Street an the eastern edge of the area proposed f~r a zon~
chang~, and for the GTE switching station which fronts Broadway
on the subject area's western edga. The 8-story senior housing
pxoject wouZd r~main nonconforming as to height. It is nat knawn
whether the GTE switching statian exceeds 45' 3n height, but it

does appear to exceed 30', which wauZd mean it is aurrently nan-
confvrming as t~ height.
~bjections
Four written objections to the proposal have been received. Ruth
Blaom wrote ~hat she opposes ~he Zone Chanqe because it will
result ir~ increas~d traffic and reduced parking on Broadway.
(Attachment E.) However, with the proposed Zone Change, the
maximum FAR is the same for all uses except some parking struc-
tures, so it is nat anticipated that the iinpact of the change on
circulation voiumes would be different than existing zoning. In
that it provides an incentive ta construct parking structures
which address an exist~.ng parking deficiency, the proposed Zone
Change may actually reduce the demand for street parking on
Braadway.
Zrwin Zeke Warsaw wrate with a number of concerns relating to tha
property Qwned by Saint John's Hospital but not directly re~ated
ta the proposed Zone Change. Mr. Warsaw requested a file from
staff for 220D Santa Manica Boulevard, an addrass for which no
pZanning file exists. He inq~ired regarding the construction of
a sma~l parking booth, for which a17, required building permits
were obtair-ed after re~iew by the Parking and Traffic Division.
Mr. Warsaw s~ates that the 2001 Broadway address used by staff
far ths Zone Change fi~e is "incorrect"; however, this number was
chosen far reference purposes because it f.s the lawest numbered
addr~ss alang Broadway propased for a zone change. Mr. Warsaw

furth~r states that an Environm~ntal Impact Report shauld be re-
quired for the propased zone cha~ge, whereas the City has pre-
pared an Initial Study Check~ist and, after review by th~ City
Environmental Review Committee, has prapared a draft Negative
Declaration which was notic~d in the outlook and made available
for public comment £or the required 3D days (no public comment
was reaeived). Mr. Warsaw also questioned the inv~~vement of a
Planning Commissioner an this application, an issue which was
referred ta the City Attorney's affice. The applicant has met
with Mr. Warsaw to discuss his concerns.
On May 19, 1993, the day of the Plan~ing Commission public hear-
ing an this matter, staFf received further corraspondence from
Mr. Warsaw. (Attachment E.) This correspondence contained a
request far a written response ta his previous correspandence,
and a request that the proposal be contznued from the May 19
agenda. Staff respanded the same day with a 3ettar explaining to
Mr. Warsaw that his concerns had been addressed in several oral
cammunications with staff and in the Planning Commission staff
report, and that the Planning Commission was the anly bady with
the authority to continue the item. Mr. Warsaw attended the
Planning Commiss3an hearing and reiterated his position.
However, the Planning Commission did not find that Mr. Warsaw's
comp~aints warranted any changes to the propasal.
on June 9, 1993, staff mailed Mr. Warsaw further correspandenoe
regarding the application, informing him of the scheduZed City
Council date, expZaining the proc~ss for reviewing fzles, and

explaining how to get a copy of the City Counci~ staff report and
appraximat~Zy when it wauld become available.
A letter was also received from Malcom H. Levin, who is President
of the 1440 23rd Street H~meowner's Association~ a condominium
building in the R3 District to the nor~h of a portion af area
proposed for a Zone Change. Mr. Levin reiterated Mr. Warsaw's
concerns, adding a concern rela~ing ta the proposal's impact on
"traffic, noise, excess ligh~ing, public safety, and other re-
Iated matters" affecting the residential units at 1440 23rd
Street. Mr. Levin attended the Planning Commission pubZic hear-
inq and has reviewed the Planning Commission staff report and its
discussion of the land use and density imp~ications of the pra-
pasa~. Staff has also responded to his questians by telephone
and infornied him of the City Council public hearing date and the
methad far obtaining a copy of the City Council staff report. On
June 7, 1993, the applicant met with Mr. Levin to discuss his
concerns.
The Mid-City Neighbors Assoeiation Board of Directors has voted
to oppose Saint Jahn's appl~catian. Their May 19, 1993 Zetter to
the Planning Commission sta~es that they do not object ta the
future construction of a parking garage on the parcel (which is
not proposed at this time), but ~hat they believe that "the con-
cept af rezoning the property simply because it has been acquired
by St. Jahn's represent~ bad public policy and sets a potentially
dangerous precedant." (Attachment E.) The applicant has met
with representatives of the Mid-City Neighbors Association.

General Plan and Specitic Plan Conforntance
The praposed change to Maps 15 and 3.5 of the HASP and the pra-
posed redistricting are consistent with the goals and objectives
aontained in both the General. Plan and the HASP. By allowing
increased area for the construction of hospitals and other
madical-reZated uses, as we11 as allowing a density incentive far
the construction af parking which addresses existing parking de-
ficiencies in th~ vicinity, the proposal is consistent with Ob-
~ective 1.13 of the Land Use and Girculat~.on Element (LUCE),
which states the fallowing:
Recognizing the importance of the City's hospitals to the
cammunity and the value oP their aervices to the residents
of Santa Monica and thase in surrounding areas, the Land
Use Elament acknowledges the hospitals need to expand and
accommodates future growth of hospitals and health care
€acilities whi~e minimizing harmful effects on surraunding
residential neighborhoods.
LUCE Policy 1.13.1 further stipulates that the City shall adopt a
Specific Plan far the area around the City's two hospitals, and
Po~icy 1.13.3 establishes the policy of providing a density
incentive for the construction of parking which addresses exist-
ing parking deficiencies in the area. The HASP was adopted on
Sept~mber 2'7, 1988.
The proposed changes are consistent with the statement on page 30
of the HASP which states that "some residents, hospital officials
and organized n~ighborhood groups of the area have expressed a
preference that parcel rezanings facus St. John's Hospital
development sauth of Santa Manica Bou~evard," which inc~udes the
area now propasad for rezoning and which is more predominantly

comm~rcial than the area to the north of Santa Monica Baulevard.

As it wou~d allow expanded hospital-related development in an
area more predominant~y commercial than the area ta tha north of
Santa Manica BouZevard, the proposal is consistent with objective
~ af the HASP Land Use E~ement which states that land us~s shall
"ensure that development in tha hospital area balances the need
for medical facilities and uses while protecting residential uses
in the area.~' The proposal is alsa consistent wi~h Circulation
EZement abjective i3 of the HASP, which states that the City
shall "protect the anviranmant of 1oca1 res~dential streats by
minimizing the intrusian of non-residentiaZ vahicular traffic and
parking into residentia~ neighborhoods.~~
HASP C~xculation ~lament ~b~ective 26 states that
Saint John's Hospital Centex and Health Center shall~
within five years, provide parking spaces ta eliminate any
parking defici~ncy discussed in the Hospital Area Specific
Plan of 1988. Spac~s shall be pronided within 500 feet of
the Health Center campus. By ar before five y~ars of the
adoption of the HASP, the Health Center shall submit docu-
mentation that deficiencies have baen eliminated. Failure
to meet this o~jective sha11 be a coasideratian in City
review of Health Center development applications.
5aznt John's Haspital has nat submitted a d~velopment p~oposal to
address existing parking deficiencias or an eva~uation of exist-
ing parking def iciencies with this application. The 5-year
deadline wi11 not be reached u~til September 27, 1993.

Conclusion
The proposed Zone Change and Specific Plan Amendment is consis-
tent with the objectives of the General P~an and Hospita~ Area
Specific Plan. By allowing a density incentive for the provision
af new parking spaces which address existing parkinq deficiencies
at Saint John's Hospital and Health Center, by allowing an expan-
ded area in which to construct new parking intended to be uti-
Iized by the Health Center campus, and by allawing increased op-
portunities for medical uses in the primarily commercial area to
the sa~th of Santa Monica Boulevard, the praposal is consistent
with objectives in the HA5P. An Initial Study Checklist has been
prepared by staff which concludes that a Negative Declaration is
appropriate. Therefore, staff recammends that the City Counci~
approve o~ th~ praposed Specific Plan Amendment, Zone Change, and
Negative Declaration.
PUBL~C NOTIFICATION
The Zoning Ordinance daes not require any public notification for
zane changes other than a n~tice in the ~utlnok. However,
Specific Plan AmendmEnts require that a noticE of the public
hearing be mailed to aIl owners and residential and conunercial
tenants o£ property located within a 500' radius of the subjec~
site at least ten consecutive calendar days prior to the hearing.

BUDGET~FINANCIAL IMPACT
The recommendatian presented in this report does not have any
budget or fiscal impact.
RECOMNlENDATION
It is respectfully recommended that the Council adopt ZC 92-002,
SPA 92-001 and IS 93-003 based on the following findings:
ZONE CHANGE AND SPEC~FIC PLAN AMENDMENT FINDINGS
1. The proposed Specific P1.an Amendment and Zone Change are
cansistent in principal with the gaals, objectives, poli-
cies, land us~s, and programs specified in the adopted
General Plan, in that they are cansistent with Land Use
and Circul,ation Element ~bjective 1.13, which states that
the City should allflw for the expansion af existing hospi-
tais whil.e minimizing their impacts on adjacent residen-
tial neighbarhoads, and they are consistent with Objec-
ti.ves 1 and 13 of the Hospital Area Specific Plan.
2. The public health, safety, and general welfare require the
adoption of the proposed Specific Plan Amendment and Zone
Change, in that the amendment wot~ld al~.ow increased oppor-
tunities and incentives to address the deficiency of off-
street par}~ing spaces wh~,ch exists in the the Hospital
Specitic Plan area.
NEGATIVE DECLAR.ATION FINDINGS
The City Council hereby finds that the Final Initial Study and
Negative Dec~aration should ba certified in that:
l. The Ci.ty Counail has reviewed and considared the con~ents
af the Final Initial Study and Negative Declaratian,
consisting of the Draft Initial Study and Negative
Declaration, public camments, and responses.
2. The Final Initial Study and Negative D~claration
adequately review and analyze potential environmental
e~fects af the proposEd projECt.
3. The environmental review was conducted in accordance with
applicabie stat~ and City CEQA guidelines including
preparatian, not~fication, and content requirements.

4. A Negative Declara~ion is appropriate, in that the Initial
Study pravides sufficient data to support a findzng that
the project wiii nat have a significant e~fect on the
environment.

are bound by the CP3 Distr~ct to the north, the C4 Dist~ict
across 23rd Street to the east, the C5 (Special Off~ce) District
across Broadway to the sattth. and the BCD (Broadway Commercial)
~istract to t~e west.
~o specific development is called for in the project. If
a~proved, the project would allaw new deve~apment ta bE 3 maximum
of ~5' high instead of the maximum of 30' permitted under the
existing zoning designation. The project would also a11ow no FAR
restrictions for parking strtxctures for which half af the spaces
address existinq parking de~iciencies ar replace existing
parking. Under current zoning, there is no density bonus for
parking structures. The base FAR of 1.5 and the maximum number
a° s~ories of 3 would remain ~f the project were approved.
The pr~pased pr~ject wauld alter the permitted uses on the
su~ject parcels. Restaurants of any size would be permitted by
iirht instead of being rastricted by a 50~seat maximum. P~aces
of ~r~orship would require a Canc~itianal Use Pe~mi~ rather than be
permitted by right. Residential uses would require a Performance
C~ar.daxds Pez~it, as under the existing zoning designation, but

prcperties allow a maximum building height of 3b', whereas the

length af shadaws cast by any future development at the subject
~roperties wauld potentially be greater than the length of
shadows cast by any proposed development under existing
standards. It is not anticipated that any mitigation measures
would be required for this possible impact as i~ is nat
consi.dered significant.
14. Land Usa (a). The praject does not contemp~ate a specific
develop~ent for the subject properties. However, it wauld result
in a~imited change to the d~v~lapment standards and permitted
uses on the subject properties. The ~'AR would not be affected
by the project. However, the maximum height would be increased
from 30' to 45' and the maximum number ~f stories would be
increased from 2 to 3 for a~I prajects and there would be no
maximum FAR for parking structures far which at least haZf of the
spaces were "provided to address an existing parking space
deficiency" or to replace existing parking.
The total ntimber of permitted uses allowed on the subject
properties would be reduced by the praject. Restaurants of any
size would be permitted by right (instead of limited ta a maximum
o~ 50 seats), and resid~ntial uses would be perznitted anly in
mixed use prajects (rather than permitted as a single use) with a
Perfarmance Standards Per~ait. P].aces af worship would require a
Conditional Use Permit (rather than be permittad by right).
The threshold at which Development Review is required would be
reduced from 25,000 square feet to 22,50a square feet.
It is not anticipated that the change in dEVelopn~ent standards
w~uld result in any significant impacts. Therefore, na
mitigation measures are proposed.

RE: Rezoning Applicahon of St Tohn's Hospital
Please be advised that the Baard af Directors of l~id-Clty Neighbors has voted
unanimously to oppose the applica~ior. of St Jahn's Hospital to rezone the
area immediately south of the existing Hospital District
We wish to emphasize that Mid-City Neighbors does no~ oppose the proposal
advanced by St. John's ta build a parking garage on part of that site. In fact, we
agree with St. john's #hat that is a much more appropriate site for such a
facility than the alt~rnahve site of 23rd and Arizona Avenue However, we
believe that the concept af rezoning the property simply because it has been
acquired by St John`s represenfs bad public policy and sets a potentially
dangerous precedent
We urge the Commission to take no action on this appl~cation at this time.
We betiEVe that a meaningful three-way dialogue between the City Staff, the
Hospital and the community should be instrtuted and may well lead to an
acc~ptable re~olution af this issue

SITE LOCATI~N AND DESCRIPTION
The propased Specific Plan Amendment and Zone Change wauld affect
11 parcels and por~ions of parcels with total area of 106,844
square feet located on the north side of Broadway between 20th
Street and 23rd Street having a frontage on Braadway af 971 feet
and bisected by 21st Street (which is 80 feet wide). Surraunding
uses consist of parking structures, surface parking iots, medical
offices, a portian of an 8-story senior housing project, a por-
tian of a GTE switching statian, and apartment buildings to the
north/ CP~3, R3 {Medium Density Multiple Family Residential) Dis-
tricts, CoZorada Place of~ices/ C5 (Special Office} District to
the sQUth, 2-story medical offices/ C4 District across 23rd
Street t~ the east and a one-story retail structura/ BCD (Broad-
way Commercial) District across 20th Street to the west. Exist-
ing on-site uses include surFace parking far uses adjacent to the
narth, a portion af a GTE switching station, a portion of an 8-
story seniar housing project~ twa I-story affices, and two 1-
stary dup~exes.

PROJECT DESCRIPTION
The proposed Specific Plan Amend~ent and Zane Change would result
in a change from C4 District to CP3 District for parcels located
~n the north s~de of Broadway between 2bth and 23rd Street. No
specific development prQject is proposed in conjunction with the
Specific Plan Amendment and Zane Change. The subject parcels
currently contain surface parking, a port~on of a General Tele-
phone switching station, a portion of an 8-story senior hausing
pro~ect~ and three 1-story bui~dings built as dwelling units and
now utiiized for office purposes.
MUNICIPAL C~DE AND SPECIFIC PLAN CONFORMANCE
The proposed Zone Change is inconsistent with Map 15 of th~
Hospital Area Specific P1an and therefore requires an amendment
to tha~ Specific Plan, The propasal does not require any amend~
ments ta the text of the Zoning Ordinance ar the HASP.
CEQA STATUS
The proposed Specific Plan Amendment and Zane Change does not
qualify far a categorical exemption under the City of Santa Moni-
ca Guidelines for the Impl~mentation af the Californ~a Environ-
mental Quality Act (CEQA). An Initial Study Checklist and pro-
posed Negative Declaration were prepared for which the 30-day
comment period ended an April 19, 1993. No comm~nts were
received. If the City Cauncil approves the proposed praject and
adopts a Negative Declaration, a certified Negative Declaration
wi11 be prepared and a Notice af Determination wi~l be filed with
the County Clerk. A copy of the Initial Study Checklist and pro-
posed Negative Declaration are incl~ded in Attachmant E.
FEES
The proposal is nat subject to any develapment fees.
PUBLIC NOTIFICATION
The Zoning Ordinance does nat require any public natificatian for
zane changes other than a notice in the Dutlook. H~wever,
Specific P1an Amendments require that a notice of the public
hearing ba mailed to a~l owner~ and residential and commercial
tenan~s of property located within a 500' radius of the project
at ~east ten cansecutive calendar days prior to the hearing. A
cop~ af the notice is contained in Attachment A.
ANALYSIS
Background
The applicant filed SPA 92-OQl and ZC 92-002 on December 23,
1992. Included in the application is a petition signed by over
50 Santa Monica residents in support vf the proposal. Although

no application has been submitted for a development in associa-
tion with the praposed amendments, the applicant sta~ed in a let-
ter to staff that "orderly expansion of health care facilities
for Saint John's Hospital requires the inclusion of its property
and similari~y-situated property within the Hospital Area
Specific Plan (HASP) and the CP Zone." (Attachment F.~
Several parcels and portions of parcels an the north side of
Broadway between 20th and 23rd Streets would change frnm a C4
District designation to a CP-3 District designation if the pro-
posal is adopted by the City Council. This area is between 100
and 150 feet in depth from the Broadway street frantage, encom-
pas5es a total of 106,844 square feet, and is bisected by 21st
Street, as shown in the plans contained in Attachment H. The
affected area is surrounded by a numl~er af different Land Use
Districts, includi~g CP-3, R3 (Medium Density Multiple Family
Residential), C4, and C5 {Special 4ffice) Districts. Most of the
affected parcels are utilized for surface parking. A portion of
a General Telephane switching station, an 8-story senior housing
building, two one-story affice structures, and two 1-stary du-
plexes are also contained on the subject parceZs.
Prapased Specific P1an Map A~endment and Zon~ Change
The area propased for rezoning was included in the original St~dy
Area for ~he Hospital Area Speci~ic Plan (HASPy, as shown in At-
tachment B. However, it was not included in the area recommen-
ded far rezoning within the HASP, as shown in Attachment C. Per
the HASP, this area was not rezoned and remains part of a C4
District.
The proposal wauld result in a modification of the Official Dis-
tricting Map to show "CP-3" rather than C4 for the affected par-
cels, and a modification of Map 15 of the HASP ta show the sub-
ject parca~~ as rezoned to «CP~~ designations rather than the cur-
rent C4. No change to the tex~ of the Zoning Ordinance or the
HASP is propos~d.
The propasa~ wauld result in a chang~ to the uses permitted on
the subject parcels. The current C4 designatian allows general
retail, affice and autamotive--related uses (SMMC Sections
9.04.08.22.020-050). The praposed CP-3 designation would
primarily allow medical-related uses, including medical-relat~d
retail uses, medical office uses, hospitals, and "offices and
meeting rooms far charitable, youth and welfare organizations."
It is difficult to characterize the change in permitted us~s in
terms of intensity, as the permitted uses are different in
character. Hawev~r, it should be noted that the proposal wauld
allaw restaurants of any szze by right, whereas the current
zoning requires a CUP for any restaurant of more than 50 seats;
it would eliminate drive-in, drive-thraugh, tak~-out and fast~-
foad restaurants as possible nses an the subject parceZs; it
wou~d eliminate service stations and autamabile dealerships as a
possible uses on the subject parcels; and it would allow residen-
tial uses by right (ar with a Performance Standards Fermit if
part of a mixed use project), whereas the C4 designation allows

residential pro~ects anly if a Perfoxmance Standards Permit is
obtained. (Ordihance 1635, which is effective until August 14,
1993, allows residential uses in all commercial district~ withaut
req~iring a Performance Standards Permit.)
The proposal wou~d n~t result in any new nanconforming u5es. The
surface parking which occ~pies most of the parcels requires a
Conditional Use Permit und~r both the C4 and CP-3 designatians if
it is not on tha same parcel as the building which utilizes the
parking. The porti~n af the General Telephone switching statian
wauld remain a legal nonconforming use, the senior housing and
duplaxes would become conforming uses, and the medical office
uses would remain conforming uses.
with one exception, the maximu~ permitted floor area ratio (FAR)
of 1.5 would remain i~tact if the zo~ing designation is changed
to CP-3 as proposed. The exception wauld be the provision of the
CP-3 Sectian which states that parking structures have no limit
on the number of stories and, if developed with "at least half of
the spaces... pravided ta address an existing parking space de-
ficiency or [to replace] existing parking," no maximum FAR shall
apply but the maxi~um height must not exceed the maximum af 45
feet permitted in the District (SMMC Sections 9.04.08.30.030[a]
and [b]).
For all types of development, the proposed change would result in
an in~rease in the maximum height ~rom 2 to 3 st~ries and from 30
feet to ~5 feet. The prQposal wauld alsa result in a required
minimum front yard se~back of 2fl', whereas the current C4 desig~
nation does not have a front yard s~tback requirement other than
a landscaped area equal ta 1.5 times the street €rantage.
The change in development stiandards would create a nanconforming
front yard se~back for the ane-stary medical office buildings and
residential duplexes which are lacated on three parcels fronting
23rd 5treet an the eastern edg~ of th~ area proposed for a zone
change, and far the GTE switching station which frants Braad~ay
on the subject area's western edge. The 8-story senior housing
project would remain nonconfornting as to height. It is not known
whether the GTE switching station exceeds 45' in height, but it
does appear ta exceed 30', which would mean it is currently non-
conforming as to height.
Objections
Two letters of objectian have been received by staff. Ruth Bloom
wrote that she opposes the Zane Change because it will result in
increased traffic and reduced parking on Broadway, However, with
the proposed Zone Change, the maxi~tstizm FAR is the same for all
uses except same parking structures, s4 it is not anticipatad
that the impact of the change on circulation would be different
than existing zaninq. Tn that it provides an incentive to con-
struct parking structures which address an existing parking de-
ficiency, the proposed Zane Change may actually reduce the demand
for street parking on Broadway.

Irwin Zeke Warsaw wrote with a number of cancerns relating to the
property awned by Saint John's Hospital but not direct~y related
to the proposed Zone Change. Mr. Warsaw requested a~ile from
staff for 2200 Santa Monica Boulevard, an address for which no
planning file exists. He inquired regarding the construction of
a small parking boath. for which all required b~ilding permits
were obtained after review by the Parking and Traffic Division.
Mr. Warsaw states that the 2001 Braadway address used by staff
far the file is "incorrect;" however, this number was chasen for
reference purpas~s because it is the lowest numbered address
alonq Broadway prapased for a zone change. Mr. Warsaw further
states that an Environmental Impact Report should be required for
the proposed zone change, whereas the City has prepared an Ini-
tial Study Checklist and, after re~iew by the City Environmental
Review Committee, has prepared a draft Negative Declaration which
was nQticed in the Outlaok and made availab~e for public comm~nt
for the required 30 days (no public cammant was received). Mr.
Warsaw also questioned the involvement of a Planning Co~nmissioner
on this project, an issue which has been referred to the City
Attornay's office.
General Plan and Specific Plan Conf~~mance
The proposed change to the Map 15 of the HASP and the proposed
redistricting are consistent with the goals and objectives con-
tained in both the G~neral Plan and tha HASP. By allawing in-
creased area for the construction af hospitals and other meda.cal-
related uses, as well as allowing a density incentive for the
construction of parking which addresses existing parking de-
ficiencies in the vicinity, the proposal is consistent with Ob-
jective 1.13 of the Land Use and Circulation Element (LUCE),
which states the following:
Recognizing the importance af the City's hospitals ta the
community and the value of their services to the residents
of Santa Monica and those in surrounding areas, the Land
Use Element acknowledges the haspitals need to expand and
accammodates future graw~h of hospitals and health care
facilities while minimizing harmful effects on surrounding
residential neighborhoods.
LUCE Policy 1.13.Z further st~pu~ates that the City shall adopt a
specific Plan for the area araund the Cityis two hospitals, and
Policy 1.13.3 establishes the policy af providing a density
incentive for the construction of parking which addresses exist-
ing parking deficiencies in the ar~a. The HASP was adopted an
Sep~am}~er 27, 1988.
The propased changes are cansistent with the statement on page 30
of the HASP which states that "some residents, haspital officials
and organized neighborhood groups of the area have expressed a
pr~ference that parcel rezonings fac~s St. John~s HQSpital
development south of Santa Monica Bouleva~d," which includes the
area now proposed for rezaning and which is more predaminantly
cammercial than the area to the narth of Santa Monica Boexlevard.

Most of the area currently proposed for rezoning is owned by St.
John's Hospital.
As it would allow expanded hQSpital-related development in an
area more predominantly commercial than the area to the north af
Santa Monica Baulevard, the proposal is consistent with Objective
1 of the HASP Land Use Element which states that land uses shall
"ensure that devalopment in the hospital area balances the need
for medical tacilities and uses while pratecting residential uses
in the area." The proposal is a1sQ consistent with Circulation
Elemant Objective 13 af the HASP, which states that the City
shall "pratect the environment of local residential streets by
mini~izing the intrusion af non-residen~ial vehicular traffic and
parking into residential neighbarhaods."
HASP Circulation Element Objective 2G states that
Saint Jahn's Haspital Center and Health Center shall,
within five years, provide parking spaces to eliminate any
parking defici~ncy discussed in the Hospital Area Specific
Plan af 1988. Spaces shall be provided within 50D feet of
the Health Center campus. By or before five years af the
adoption of the HASP, the Health Center shall submit dacu-
mentation that deficiencies have laeeh eliminated. Failure
to meet this objective shall be a consideration in City
review af Health Center develapment app].i.catians.
Saint John's HospitaZ has not submi~ted a development prQposal ta
address existing parking deficiencies (ar an evaluation of exist-
ing parking deficienaies) with this application. The 5 y~ar
deadline wiZl not be reached until September 27, 1993.
Conclusion
The proposed Zone Change and Specific Plan Amendment is consis-
tent with the objecti~es of the General Plan and Hospital Area
Speci~ic Plan. Hy allawing a density incentive for the provision
af new parking spaces which address existing parkinq deficiencies
at Saint John's Hospital and Health Center, by allawing an expan-
ded area in which to construct new parking intended ta be uti-
lized by the Health Center campus, and by allowing increased op-
portunities far medical uses in the primarily commercial area t~
the south of Santa Monica Baulevard. the proposal is consistent
with objectives in the HASP. An Ini~ial Study Checkli~t has been
prepared by staff which concludes that a Negative Dec7.aration is
apprapriate. Therafare, staff recammends that the Planning Com-
missian recommend that the City Council approve of the proposed
Specific Plan Amendment, Zone Changa, and Negative Declaratian.
RECOMMENDATION
It is recommended that the Planning Commission recommend to the
City Council approval of SPA 92-001, ZC 92-002 and a Negative
D~claratian for these prajects based on the following findzngs:

ZONE CHANGE AND SPECIFIC PLAN AMENDMENT FINDINGS
1. The proposed Specific Plan Amendment and Zone Change are
consistent in principal with the goals, objectives, poli-
cies, land uses, and pragrams sp~cified in the adopted
General Plan, in that they are consistent with Land Use
and Circulation Elemant dbjective 1.13, which states that
the City should allow for the expansion of existing hospi~
tals while minimizing their impacts on ad~acent r~siden-
tial neighbarhoods, and they are consistent with ~bjec-
tives 1 and 13 of the Hospital Area Specific P~an.
2. The public health, safety, and general welfare require the
adoption of the proposed Specific Plan Amend~ent and Zo~e
Change, in that the amendment would allaw increased oppor-
tunities and incentives to address the deficiency of off-
street parking spaces which exists in the the Hospital
Specific Plan ar~a.
NEGATIVE DECLARATION FINDiNGS
The Planning Commission hereby finds that the Final Initial Study
and Negative Declaration should be certified in that:
1. The Commission has reviewed and considered the cont~nts of
the Final Initial study and Negative Declaration, cansisting
of the Draft Initial Study and Negative Declaration, public
comments, and responses.
2. The Final Tniti~l Study and Negative Declaration adequately
review and analyze potential environmental effeats af the
propvsed project.
3. The environmental review was conducted in accardance with
applicable State and City CEQA guidelines including
preparatian, natification, and con~ent requirements.
4. A Negati~e Declaratian is appropriate. in that th~ InitiaZ
Study pravides sufficient data to support a finding that the
