SUBJECT: A Resolution setting a Public Hearing for July 13, 1993,
on the Confirmation of Assessment of Costs to Repair
Damaged Sidewalks, Driveways, Curbs, and the Removal of
Damaged Pavement in Parkway Areas on Various city streets
(SR-93-188)
Introduction
This report recommends that city Council set a public hearing for
July 13, 1993, to hear protests regarding the completed work and
confirm the assessment of costs to repair damaged sidewalks,
driveways, curbs, and the removal of damaged pavement in parkway
areas on various City streets.
Backqround
On October 9, 1979, City Council approved a sidewalk repair program
which provided for property owner participation in the cost of
repairing damaged sidewalks. Residential property owner
participation is 50% of the cost of the repairs if the damage is
related to tree roots with the City paying the remaining 50% of
the repair costs. Property owners are assessed 100% of the cost
if the damage is not related to tree roots and commercial
property owners are assessed 100% of the cost regardless of the
cause of the damage.

*Approximately 99% of all damage is from tree roots. Where damage
is not because of the roots, the property owner's share is 100% of
cost.
Sidewalks, driveways, curbs and parkways if damaged were replaced
and repair work has been completed at the following addresses:
422 20th Street, 1033 24th street, 514 25th street, 602 25th
Street, 2445 Cloverfield Boulevard, 1437 Franklin street, 1636
Franklin Street, 1638 Franklin street, 1215 Grant street, 1315
Grant Street, 2115 Main street, 1733 Pine Street, 1739 pine street,
1402 San Vicente Boulevard, and 802 Third street . The property
owners' share of the costs is now due.
A public hearing to confirm the assessment of costs must be held
pursuant to the provisions of Chapter 22, sections 5600 to
5630, of the streets and Highways Code of the State of California.
A Resolution setting the public hearing for 6:30 p.m. on July 13,
1993, is attached. All affected property owners will be notified of
the public hearing date and the assessment amount fifteen days
prior to the public hearing. A list of property owners and

assessment amounts will be available to Council at the time of the
public hearing.
Budqet/Financial Impact
The financial analysis, which will indicate total revenues to be
derived from this assessment district over the next two years,
will be presented to City Council at the time of public hearing.
Recommendation
It is recommended the city Council adopt the attached Resolution
setting a public hearing on July 13, 1993, to confirm the
assessment of costs of the repair of damaged sidewalks, driveways,
curbs, and the removal of damaged pavement in the parkway areas for
the above-cited properties.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A PUBLIC HEARING DATE
ON JULY 13, 1993, FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIR OF SIDEWALKS,
DRIVEWAYS, CURBS AND THE REMOVAL OF DAMAGED
PAVEMENT IN PARKWAY AREA (SR-93-188)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Superintendent of streets will file a
report of repair pursuant to section 5617 of the streets and
Highways Code of the state of California, relating to the
construction of certain improvements to sidewalks and driveways at
422 20th Street, 1033 24th street, 514 25th Street, 602 25th
street, 2445 C10verfield Boulevard, 1437 Franklin Street, 1636
Franklin Street, 1638 Franklin Street, 1215 Grant street, 1315
Grant Street, 2115 Main street, l733 Pine Street, 1739 Pine Street,
1402 San vicente Boulevard, and 802 Third Street, all within the
City of Santa Monica.
SECTION 2. Pursuant to section 5600 et seq. of said Code,
the City Council does hereby order and declare that on the 13th day
of July 1993, at 6:30 p.m., in the city Council Chambers of city
Hall, 1685 Main Street, it will hear and pass upon the report by
the Superintendent of streets of the cost of repairs, together
with objections or protests, if any, which may be raised by any
property owner liable to be assessed for the cost of such repairs
and any other interested persons.

SECTION 3. All protests or objections must be in writing

and filed with the City Clerk on or before the time set for the
hearing of the protests and objections.
SECTION 4. The superintendent of Streets is hereby
directed to mail notices, in the manner and form prescribed by law,
of the costs of repair and of the adoption of this Resolution to
all persons owning real property affected by the sidewalk
assessment repair program, whose names and addresses appear on the
last equalized assessment roll for the City taxes or as known to
the city Clerk.
SECTION 5. The city Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
