SR-9B (6)LUTM:PB:DKW:DB/taQ02cc.pcword,plan Santa Monica, California Council Mtg: June 29, 1993 To: Mayor and City Council FRaM: City Staff SUBJ£CT: Zone Change 92-002, Specifia Plan A~endment 92-00~, Initial Study 93-003 for the properties located an the narth side of Broadway between Twentieth and Twenty-Third Streets Applicant: Saint John's Hospital and Health Center INTRODUCTION This report recammends that the City Council apprave Zone Change (ZC) 92-002 and Specific Plan Amendment (SPA) s2-DO1 to change the Official Districting Map for the north side of Broadway between 2oth and 23rd Streets ~rom C4 {H~ghway Commercialy to CP-3 (Commercial Professional) and to amend the Hospital Area Specific P~an to include these parcels within the Specific Plan area. Pursuant to the requirements of the California Environmental Quality Act (CEQA), this report aZso recommends approval af Tnitial Study 93-003 and Negat~ve Declaratian for the proposed application. On May 19, 2993, the Planning Commission vated 4-0 on a motion to approve the application and associated Negative Declaration, with one abstention and two absences. BACKGROUND App~icatian Description The applicant filed SPA 92-001 and ZC 92-OQ2 on December 23, 1992. Included in the application is a petition signed by over 50 santa Manica residents in support of tha proposal. ~lthough - 1 - no application has been submitted for a deveZopment in association with the propased amend~ents, the applicant stated ~n a letter to staff that "orderly expansion of health care facilities for Saint John's Hospital requires the inclusion of its praperty and similarily-situated property within the Hospital Area Specif~c Plan (HASP) and the CP ~one.'+ (Attachment A.) Several parcels and port~ans of parcels on the north side of Br~adway between 20th and 23rd Streets wau~d change from a C4 District designation to a CP-3 District designation if the proposal is adopted by the City Counci~. This area is between 300 a~d 15~ feet in depth from the Brvadway street frontage, encompasses a total of 106,844 square ~e~t, and is bfsected by 21st Street, as shown in the plans contained in Attachment N. Mast af the affected parcels are utilized for surface parking. A portion of a General Telephone switching station, an 8-story senior housing building, two ane~story office structures, and two 1-story residential duplexes are also cantained vn the subject parcels. An Initial Study Checklist and pro- pased Negative Declaration were prepared far which the 30-day comment period ended on April 19, 1993. No comments were receivad. If the City Counci~ approves the appZication and adopts a Negative Declaration, a certified Negative Declaration will bs prepared and a Notice a~ Determination will be filed with the Caunty Clerk. A copy of the Initial Study Checklist and pro- posed Negative Dec~aratian are included in Attachment B. - 3 - ANALYSIS Land Use and Density Implicatians of the Proposed Specific Plan Map Amendment and Zone Change The area proposed for rezoning was included in the original Study Area for the HQSpitaZ Area Specitic Plan (HASP}, as shown in At- tachment C. However, it was not included in the area recommen- ded far rezoning within the HASF, as shown in Attachment D. Per the HASP, the parcels currently under review were not rezoned ta CP-3 and therefare remain part of the C4 District. The proposal would result in a modification ~f the Official Dis- tricting Map to show "CP-3" rather than C4 far th~ affected par- cels, and a modification of Maps ~5 and 16 of the HASP ta show the subject parcels as rezonad ta "CP" designations rather than the current C4. No change ta the text of the Zoning Ordinance or the text of the HASP is proposed. A maximum FAR o€ 1.5 applies to the subject C4-zaned parcels as of tha time ef this hearing date. However, based an the Coun- ci~'s actian an June 15, I993, the FAR for the C4~2oned parcels over 7,501 square feet is substantia~~y lower than 1.5 for proj- ects withaut a residential component. The one changa with regard to permitted uses in the C4 District will be that residential mixed-us~ pro~ects will not require a Performance Standards Permit. The proposal wou~d result in a change to the uses permitted on the subject parcels. The current C4 designation allows gen~ral - 4 - retail~ offiae and sutom~bile-serving uses {SNIIuiC Sections 9.04.~8.22.020-050). The propased CP-3 designation would primarily allow medical-related uses, including medical-related retail uses, medical office uses, haspitals, and "affic~s and meeting rooms for charitable, yauth and welfare arganizations." It is difficult to characterize the change in peraeitted uses in terms of intensity, as the permitted uses are differant in character. The praposal would al~ow restaurants of any size by right, whereas the currant zoning requires a CUP for any res- taurant of more than 5~ seats; it wauld eliminate drive-in, drive-thraugh, take-aut and fast-food restaurants as possible uses an the subject parcels; it would eliminate service stations and autom~bile dea].erships as possible uses on the subject par- cels; and it would a~Iow residential uses by right (ar with a Performance Standards Permit iF part of a mixed use project), whereas the C4 dasignation allows residential projects anly if a P~rformance Standards Perrnit is obtained. (Ordinance 1635(CCS), which is effective until August 14, Z993, allaws residential uses in all commercial districts without requiring a Performance Stan- dards Permit.) The proposal wauld not result in any new nanconfarming uses. The surface parking which occup~es most of the parcels requires a Conditional Use Permit under b~th the C4 and CP-3 designations if it is not on the same parcel as the b~zilding which utilizes the parking. The portion af the General Telephane switching station would remain a legal nonconfarming use, the senior housing and - 5 - duplexes would bacome aonforming uses, and the medical office uses wauld remain conforminq uses. With one exception, the maximum permitted floor area ratia (FAR} of 1.5 would remain intact if the zoning designatian is changed to CP-3 as proposed. The exception wauld be the provision of the CP-3 Section which states that parking structures have no limit on the number of stories and, if developed with "at least half of the spaces,.. provid~d to address an existing parking space de- fici~ncy or [to replac~] existing parking," no maximum FAR shall apply but the maximum height must not exceed the maximum of 45 feet permitted in the District {SMMC Sactions 9.04.08.30.o34[a} an~ [b]). For a~l types o€ development, the proposed change would result in an increase in the maximum height from 2 tQ 3 stories and €ram 30 feet to 45 feet. The propasal wauld also result in a required minimum front yard setback of 2~', whereas the current C4 des~g- nation does nat have a frant yard setback requirement other than a landscaped area equal ta 1.5 times the street frontage. The change in development standards would create a noncantorming front yard setback for the one-story medical office buildings and residential duplexes which are located on three parceYs fronting 23rd Street on the eastern edge of the area propased fvr a zone change, and for the GTE switching station which fronts Broadway on the subject area's western edge. The S-story senior housing project wou~.d remain nonconforming as to height. It is not known whether the GTE switching station exceeds 45' in height, but it - & - does appear to exceed 30~, which wouid mean it is currently non- conforming as ta height. objections Four written objections ta tha praposal have ~een recei~ed. Ruth Bloom wrate that 6he opposes the Zane Change because it will result in increased traffic and reduced parking on Broadway. (Attachment E.) However, with the proposed Zone Change, the maximum FAR is th~ sama far all uses except some parking struc- tures, so it is not anti.c~pated that the impact of the change an circulation volumes wauld be different than exi.sting zoning. In that it provides an incentive to construct parking structures which address an exist~ng parking deficiency, the proposed Zone Change may actually redtice the demand far street parking on Broadway. ~rwin Zeke Warsaw wrote with a number of concerns relating to the property owned by Saint John's Hospital but not direct~.y re3ated ta the proposed Zone Change. Mr. Warsaw requested a file from staff for 220d Santa Monica Boulevard, an address f~r which no planning file exists, He inquired regarding the construction of a s~a11 parking booth. far which all required building permits were obtained after review by the Parking and Traffic Division. Mr. Warsaw states that the 20D1 Broadway address used by staff for the Zone Change file is "incorrect"; hawevar, this number was chosen for reference purposes because it is the lawest numbered address along Broadway proposed for a zone change. Mr. Warsaw - 7 - further states that an Environmental Impact Report should be re- quired for the proposed zone change, whereas the City has pre- pared an Initial Study Checklist and, after review by the City Enviranmenta2 Review Committee, has prepared a draft Negative Declaration which was nQticed in the Outlook and made available for public comment for the required 30 days (no public coxrment was received). Mr. warsaw also questioned the involvement af a Planning Commissioner an this application, an issue which was referred to the City Attarney's office. The applicant has met with Mr. Warsaw to discuss his concerns, On May 19, 1993, the day of the Planning Commission puhlic hear- ing on this matter, staff receiv~d further correspandence from Mr. Warsaw. (Attachment E.) This correspondence contained a request for a written respanse to his previous correspondence, and a request that the praposal be continued froin the May 19 agenda. Staff responded the same day with a letter explaining to Mr. Warsaw that his concerns had been addressed in several orai communications with staff and in the Planning Cammission staff report, and that the Planning Commission was the tinly body with the authority to continue the item. Mr. Warsaw att~nded the Planning Commissi.on hearing and reiterated his position. However, the Planning Commission did not find that Mr. Warsaw's compZaints warranted any changes ta the praposal. On June 9, 1993, staff mailed Mr. Warsaw ~urther correspondence regarding th~ appiication, informing him of the schedu~ed City Cauncil date, explaining the process for reviewing files, and - 8 - explaining how to get a copy of the City Council staff report and approximately when it would become available. A letter was aZso rece~ved from Malcom H, Levin, who is President of the 1440 23rd Street Homeowner's Association, a candominium building in the R3 District to the north of a portian of area proposed €or a Zone Change. Mr. Levin reiterated Mr. Warsaw's concerns, adding a concern relating to the proposal's impact an "traffic, naise, excess lighting, pubZic safety, and other re- Yated matters" a~fecting the residential units at 1440 23rd Street. Mr. Levin attended the Planning Commission public hear- ing and has reviewed the Planning Commission staff report and its discussion of the land use and density impi~cations af the pro- pasa~. 5taff has a~.so responded to his questions by telephone and informed him of the City Council public hearing date and the method for o3ataining a capy of the City Council staff report. On June 7, 1993, the applicant met with Mr. Levin to discuss his concerns. The Mid-City Neighbors Association Board vf Directors has voted to appose Saint John's applicativn. Their May 19, 1993 letter to tha Planning Commission states that they do not ob~ect to the future construct~.an of a parking garage an the parcel (which is not proposed at this time), bu~ that they believe that "the con- cept of rezoning the property simply because it has been acquired by St. John's represents bad puhlic paliay and sets a patentially dangerous precedent." (Attachment E.) The applicant has met with representatives of the Mid-City Neighbors Association. - 9 - General Plan and Specific Plan Conformance The proposed change to Maps 15 and 16 of the HASP and the pro- posed redistricting are consistent with the goals and objectives cantained in both the Genera~ Plan and the HASP. Hy a~lowing increased area for the constructian af hospitals and ather medical~related uses, as weli as allawing a density incentive for the constructian af parking which addresses existing parking de- ficiencies in the vicinity, the proposal is consistent with Ob- jective 1.13 of the Land Use and Circulation Element (LUCE), which states the fol~owing; Recagn~zing the impartance of the City's hospita~s to the community and the value of their services to the residents af Santa Manica and those in surraunding areas~ the Land Use Element ac}cr~aw~edges the hospitals need to expand and accommodates future growth of hospitals and health care facilities while ~inimizing harmful effects on surraunding residentia~ neighborhoods. LUCE Palicy 1.13.1 further stipulates ~hat the City sha~I adopt a Specific P~an for the area araund the City's tw~ hospitals, and Po~icy 1.~3.3 establxshes the po~icy of providing a density incentive for the construction af park~ng which addresses exist- ing parking deficiencies in the area. The HASP was adopted on September 27, 1988. The proposed changes are consistent with the statement on page 30 of the HASP which states that "some res~dents~ haspital afficials and organized neighborhood groups of the area have expressed a preference that pa~cel rezon~ngs focus St. Jahn's Hospital development sauth of Santa Monica Boulevard," which includes the area now proposed far rezoning and which is more predaminantly - 1,0 - commerciaz than the area to the north of Santa Monica Bo~ievard. Most of the area currently propoaed for rezoning ~s owned by St. John's Haspital. As ~t would a~law expanded hospital-related development in an area more predominantly commercial than the area to the north of Santa Monica Boulevard, the proposal is consistent with Objective 1 of the HASP Land Use E~ement wh~ch states that land uses shall "ensure that development in the hospital area balances the need for medical facilities and uses while protecting residential uses in the area." The proposal ~s alsa consistent with Circulation Element Objective 13 of the HASP, whieh states that the City shall "protect the environment of lacal residential streets by minimizing the intrusion of non-residential vehicular traffic and parking into residential neighborhoods." HASP Circu~at3an Element Ob~ective 26 states that Sa~nt Jahn's Hospital Center and Health Center ahall, within five years, pravide parking spaces to eliminate any parking deficiency discussad in the Hospital Area Specific Plan of 1988. Spaces shall be prov~dad within 500 feet of the Health Center campus. By or before five years of the adoption of the HASP, the Health Center shall submit docu- mentatian that deficiencies ha~e be~n eliminated. Failure to meet this objective shall be a cons~deration in City review of Health Center development applications. 5aint John's Hosp~tal has not submitted a development proposal to address existing parking deficiencies or an evaZuation of exist- inq parking deficiencies with this app~ication. The 5-year deadl~ne will nat be reached until September 27, 1993. _x~_ Canclusian The proposed Zone Change and specific Plan Ame~dment is c~nsis- tent with the objectives flf the General Plan and HaspitaZ Area Specific P~an. By allowing a density inc~ntiva far the pro~ision of new parking spaces whieh address existing parking de~iciencies at Saint John's Hospital and Health Center~ by allowing an expan- ded area in which tQ construct new parking intended to be uti- Iized by the Health Center campus, and by allawing increased op- partunities for medical uses in the primari~y cammercial area to the south of Santa Monica Boulevard, ~he proposal is consistent with objectivas in the HASP. An Initial Study Checklist has been prepared by staff which concludes that a Negative Declaration is appropr~ate. Therefore, statf recammends that the City CaunciZ approve of the propased Specific Plan Amendment, Zone Change, and Negative Declaration. PUBL~C NOTIFICATION The Zoning Ordinance does not require any pu]alic notification for zone changes other than a notice in the Outlaak. However, Specific Plan Amendments require that a notice of the public h~aring be mailed to aI~ owners and residential and commercial tenants of property located within a 50Q' radius of the subject site at least ten consecutive aalendar days priar to the hearing. A copy of the not~ce is contain~d in Attachment F. -ia- BUDGETIFINANCIAL IMPACT The recomiaendation presented in this report does not have any budget or fiscal impact. RECOMMENDATI~N It is respectfully recom~nended that the Council adapt ZC 92-002, SPA 92-p01 and IS 93-003 based on the follawing findings: ZONE CHANGE AND 5PECIF~C PLAN AMENDMENT FINDINGS Z. The proposed Specific Plan Amendment and Zone Change are cansistent in principal with the goa~s, ob~ectives, poli- cies, land uses, and programs specified in the adopted General Plan, in that they are consistent with Land Use and Circulation EIe~Gnt Objective ~.13, which states that the City should a11ow for the expansion of existing hospi- tals while minimizing their impacts on adjacent residen- t~al neighborhoads, and they are consistent with Objec- tives 1 and 13 of the Hospital Area Specific Plan. 2. The public health, safety, and general welfare require the adaption of the proposed Specific Plan Amendment and Zone Change, in that the amendment would allow increased oppor- tunities and incentives to address the deficiency of aff- street parking spaces which exists in the the HospitaZ Specific Plan area. NEGAT~VE DECLARATION FINDINGS The City CaunciZ hereby finds that the Final Initial Study and Negative Declaration should be certified in that: l. The C~ty Council has reviewed and considered the contents of the Final Ynitial Study and NEgatiye Declaratian, cansisting of the Draft Initial Study and Negative Dec~aration, public comments, and responses. 2. The Final Initial Study and Negative D~claration adequately review and analyze patential environmental eff~cts of the propased pro~~ct. 3. The environmental review was conducted in accordance with applicable State and City CEQA guidelines including preparation, notification, and content requirements. - 13 - 4, A Negative Declaration is appropriate, in that the Initial Study pravides sufficient data to support a finding that the project will not ha~e a significant effect an the environment. The parceZs are bound by the CP3 District to the narth, the C~ District acrass 23rd Street to the east, the C5 (Special Office) District ac;~ss Broadway to the south, and the BCD (Broadway Commercial) ~istr~c~ to the west. No specific development is called for in the pr~ject. If approved, th~ project wauld allow new develapment to be ~ maximum o~ 4~' high instead of the maximum of 30' permitted under the existing aoning dasignation. The project wau~d also a11nw no FAR restrictions for parking structures for which half of the spaces address existing parking deficiencies or replace existing parking. SITE LOCATION AND DESCRIPTION The proposed Specific Plan Amendment and Zone Change would affect 11 parcels and portians of parcels with total area of 106,844 square feet lacated on the north side af Broadway between 20th Street and 23rd Street having a frontage on Broadway of 971 feet and bisected by 21st Street (which is 84 feet wide}. Surrounding uses consist of parking structures, surface parking lots, medical offices, a portion vf an 8-story seniar housing project, a por- tian af a GTE switching station, and apartment bui].dings to the narth/ CP-3, R3 (Medium Density Multiple Family Residential) Dis- tricts, Colarada Place offices/ C5 (Spe~ial 4ffice} District to the south, 2-story medical af~ices/ C4 District across 23rd Street to the east and a one-stary retail structure/ BCD (Broad- way Cammercial) District across 2ath Street to the west. Exist- ing an-site uses include surface parking for u~es adjacent to the north~ a partion of a GTE switching station, a portian of an 8- story senior housing project, two 1-story offices, and two 1- stary duplexes. MUNICIPAL CODE AND SPECIFIC PLAN CONFORMANCE The proposed Zone Change is inconsistent with Map 15 of the Hospital Area Specific P3.an and therefore requires an amendment to that Specific Plan. The propasal does nat require any amend- ments to the text of the Zoning Ordinance ar the HASP. CEQA STATUS The proposed Specific P~an Amendment and Zone Change does nat qualify ~or a categorical exempt~~~ under the City of Santa Moni- ca Guidelines for the Implementation of the Califarnia Environ- mental Quality Act (CEQA). An Initial Study Checklist and pra- posed Negative Declaration were prepared for which the 30-day comment period endecl on April 19, 1993. Na comments were received. If the City Counci]. appraves the proposed project and ad~pts a Negative Declaration, a certified Negative Dec~aratian will be prepared and a Notice of Determinatian will be filed with the County Clerk. A copy of the Initial Study Checklist and pra- posed Negative Declarati~n are included in Attachment ~. FEES The proposal is not subject ta any development fees. PUBLIC NOTIFICATION The Zoning Ordinance does not require any public notification for zone changes other than a notice in the Outlook. However, Specific Plan Amendments require that a notice of the public hearing be mailed to a~l owners and residential and cammercial tenants of property located within a 500' radius of the project at least ten consecutive caZendar days prior to the hearing. A copy of the notice is contained in Attachment A. ANALYSIS Background The applicant filed SPA 92-001 and ZC 92-042 on DeceYnber 23, 1992. Included in the application is a petitian signed by over 50 Santa Monica residents in suppart of the proposal. Several parcels and portians af parcels on the north side of Broadway between 20th and 23rd Streets would change from a C4 District designation to a CP-3 District designatian if the pro- posal is adopted by the City Council. This area is between 100 and 150 feet in depth fram the Broadway street frontage, encam- passes a total of 10~.844 square faet, and is bisected by 21st Street, as shown in the plans contained in Attaahment H. The affected area is surrounded by a nuxnber of different Land U5e Districts, including CP-3, R3 (Medium Density Multiple Family Residential), C4, and C5 (Special. Office) Districts. Most o~ the affected parcels are ut~.lixed for surface parking. A portion of a General Telepho:~e switching station, an 8-story seniar housing building, two one-story office structures, and two ~-story du- plexes are also contained on the subject parceis. Proposed Specific P~an Map Amendment and Zone Change The area proposed for rezoning was included in the ariginal Study Area for the Hospital Area Spec~fic Plan (HASP), as shown ~.n At- tachment B. However, it was nat included in the area recammen- ded for rezoning within the HASP, as shown in Attachment C. Per the HASP, this area was not rezoned and remains part of a C4 District. The propasa~ would result in a madification of the officia~. Dis- tricting Map to shaw "CP--3" rather than C4 for the affected par- cels, and a modification af Map 15 of the HASP ta show the sub- ject parcels as rezoned to "CP" designations rather than the cur- ren~ C4. No change td the text of the Zoning ord inance or the HASP is propased. The proposal would result in a change to the uses permitted an the subject parcels. The current C4 designation a~~.ows general retail, o~fice and automative-related uses (SI+II~IC Sections 9.04.08.22.020-050). The proposed CP-3 designation woul.d primarily allow medical-related uses, including medical-related retail uses, medical office uses, hospitals, and "offices and meeting raams for charitable, youth and welfare organizations." It is difficult to characterize the change in permitted ~ses in terms of intensity, as the permitted uses are different in character. However, it should be noted that the proposal would allow restaurants af any size by right, whereas the current zoning requires a CUP for any restaurant of mare than 50 seats; it wQUld eliminate drive-in, drive-through, take-out and fast-- food restaurants as passible uses on the sub~ect parcels; it wou~d eliminate service stations and automabile dealerships as a possible uses on the subject parcels; and it would a~3ow residen- ta.a1 uses by right (or with a Performance Standards Permit if part of a mixed use project), whereas the C4 designation allows - 3 - 1~~~• ~ ~ residential projects only if a Performance Standards Permit is obtained, (Ordinance 1635, which is effective until August 14, 1993, allows residential ~ses in all commercial districts without requ~ring a Perfarmance Standards Permit.) The proposal would not result in any new nonconforming uses. The surface parking which occupies most of the parcels requires a Conditional Use Permit under bath the C4 and CP-3 designations if it is not an the same parce~ as the building which utilizes the parking. The portion of the General Telephone switching station would reYaain a legal nonconforming use, the senior housing and duplexes would become confarming uses, and the medical office uses would remain confar~aing uses. With one exception, the maximum permitted floor area ratio (FAR) of 1.5 would remain intact if the zoning designatian is changed to CP-3 as proposed. The exception would be the provision of the CP--3 Section which states that parking structures have no limit on the number of stories and, if developed with "at least half of the spaces... pravided to address an existing parking space de- ficiency or [to replace] existing parking," no maximum FAR shall apply but the maximum height must not exceed the maxi~um af 45 feet permitted in the District (SNIIKC Sectians 9.04.08.3b.030[a] and [b]). Far all types of development, the praposed change would result in an increase in the maximum height €rom 2 to 3 stories and from 30 feet to 45 feet. The proposal would also result in a required minimum front yard setback of 20', whereas the current C4 desig- nation does not have a frant yard setback requirement other than a landscaped area equal to 1.5 times the street frontage. The change in develapment standards would creata a nonconforming frant yard se'~back for the one-story medical office buildings and residential dup].exes which are lacated on three parcels fronting 23rd Street on the eastern edge o~ the area praposed for a zone chang~, and for the GTE switching station which fronts Broadway on the subject area's western edge. The 8-story senior housing praject would remain nonconforming as to height. It is not known whether the GTE switching station exceeds 45' in height, but it does appear to exceed 30', which would mean it is currently non- confarming as to height. objections Two letters of objecticn have been received 1oy staff. In that it provides an incentive to con- struct park~ng structures which address an existing parking de- ficiency, the proposed Zone Change may actualZy reduce the demand for street parking on Broadway. - 4 - ~ . av~ : f w Irwin Zeke Warsaw wrote with a number af eoncerns relating to the property owned by 5aint John's Hospita~ but not directly related to the proposed Zone Change. Mr. Warsaw requested a file from staff for 2200 Santa Moniaa Boulevard, an address for which no pYanning f ile exists. He inquirad regarding the canstruction of a small parking booth, far which all required building permits we~e obtained after review by the Parking and Traffic Division. Mr. Warsaw states that the 2001 Broadway address used by staff for th~ file is "incorrect;" however, this number was chasen for re~erence purposes because it is the lowest numbered address along Broadway proposed for a~one change. Mr. Warsaw further states that an Environmental Impact Report should be required far the pzoposed zone change, whergas the City has prepared an Ini- tial Study Checklist and, after review by the City Environmental Review Committee, has prepared a draft Negative Declaratian which was noticed in the Outiook and made availab~e for public comment far the required 30 days (no public comtnent wa5 received) . Mr. Warsaw alsa qusstioned the invol.vement of a P}.anning Commissioner on this project, an issue which has been referred to the City Attorney's office. The proposad changes are consistent with the statement an page 30 of the HASP which states that "same residents, haspital officia~s and oXganized neighborhood groups of th~ area have expressed a prefe~ence that parcel rezonings focus St. John's Hospital developmen~ south of Santa Monica Boulevard," which incZudes thE area now proposed for rezoning and which is more predominant~y cammercial than the area to the north of Santa Manica Boulevard. - 5 - • ~~7t, ~ .~ Most of the area currently proposed for rezoning is owned by St. John's Hospital. As it wou~d allow expanded hospital-related development in an area more predominantly commercial than the area ta the north af Santa Monica Boulevard, the proposal is cansistent with Objective 1 of the HASP Land Use Element which states that Iand uses shall "ensure that development in the hospital area balances the need far medical fac~lities and uses while protecting residential uses in the area." The proposal is alsa consistent with Circulation Element Objective 13 of the HASP, which states that the City shalZ "protect the environment of local residential streets by mini~izing the intrusion of nan-residential vehicular traff~c and parking into residential neighb~rhoods." HASP Circulation Element Objective 26 states that Saint John's Hospital Center and Health Center shall, within f~ve years, provide parking spaces to eliminate any parking deficiency discussed in the Hospital Area Specific Plan of 1988. Spaces shall be provided within 500 feet of the Health Center campus. By or before five years of th~ adoption of the HASP, the Health Center shall submit dacu- mentation 4hat deficiencies have been eliminated. Failure to meet this abjective shall be a cansideratian in City review of Health Center development applications. Saint John's Hospital has not submitted a development proposal to address existing parking defic~encies (or an evaluatian of exist- ing parking deficiencies) with this application. The 5 year deadline wi~l not be reached until September 27, 1993. Conclusion The proposed Zone Change and Specific Plan Amendment is consis- tent with the objectives of the General Plan and Hospita~ Area Specific P1an. By allawing a density incentive for the provision of new parking spaces which address existing parking deficiencies at Saint John's Hospital and Health Center, by allowing an expan- ded area in which to construct new parking intended ta be uti- ~ized by the Health Center campus, and by allowing increased op- portunities for medical uses in tha primarily commercial area to the south of Santa Monxca Boulevard, the proposal is consistent with objecti~es in the HASP. An Initial Study Checklist has been prepared by staff which concludes that a Negative DecZaratian is appropriate. Therefore, staff recommends that the Planning Cam- mission recommend that the City Counci~ apprave of the proposed Specific Plan Amendment, Zone Change, and Negative Declaration. RECOMMENDATION It is recommended that the Planning Commission recommend to the City Council approval of SPA 92-001, ZC 92-DO2 and a Negative Declaration for these projects based on the following findings: - 6 - ~~t, r ~ ZONE CHANGE AND SPECIFIC FLAN AMENDMENT FINDINGS l. A ' WHEREAS, the City Planning and Zoning Divisian deem~d camplete and accepted for filing ZC 92-aaa on February 25, 1993; and WHEREAS, Initial Study Checklist (IS} 93-003, which recommends that a Negative Declaration be adopted for the proposal, was duly noticed and circulated for public comment; and WHEREAS, no pub~ic comment was received regarding IS 93- 003 during the 30-day public comment period which ended on April 19, 1993; and WHEREAS, on May 19, 1993, the Planning Commission recommended that the City Council approve ZC 92-002, SPA 02-001, and IS 93--DQ3, and WHEREAS, the proposed amendment is consistent in principle with the goals, objectives, policies, land uses, and programs specified in th~ adopted General Plan in that it is consistent with Land Use and Circulation Element Objective 1.13, which states that the City should allow for the expansion of existing hospitals while minimizing their impacts on adjacent residential neighborhoods, and it is consistent with Objectives ~ and 13 of the Hospital Area Specific P~an; and 2 , ! ~ ~ ~~ WHEREAS, the public health, safety, and general welfare require the adoption of the proposed amendment in that the amendment would allow increased opportunities and incentives to address the deficiency of off-street parking spaces which exi,sts in the Hospital Specific Plan area; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS; SECTION 1. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a dacision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. WHEREAS, on May 19, 1993, the Planning Commission zecommended that the City Council approve ZC 92-002, SPA 92-001 and IS 93-003; and WHEREAS, the City Council has revi.ewed and cansidered the contents of the Final Initial Study and Negative Declaration, consisting af the Draft Initial Study and Negative Declaratian, public comments, and respanses; and WHEREAS, the Final Initial Study and Negative Declaration adequately review and analyze potential environmental effects of the proposed proj~ct; and WHEREAS, the environmental review was conducted in accordance with applicable State and City CEQA guidelines including preparation, notification, and cantent requirements; and WHEREAS, a Negative Declaration is appropriate, in that the Initial Study provides sufficient data to support a finding that the project will not have a sign~ficant effeet on the envi.ronment; and WHEREAS, the proposed amendment to the Hospital Area Specific P~an is consistent with the Genera~ Plan in that it is consistent with Land Use and Circulation E~.ement ~b~ective 1.13, which states that tha City should allow for the expansian of 2 existing hospitals while mini~izing their impacts on adjacent residential neighborhaods, and it is consistent with Objectives 1 and 13 of the Hospital Area Specific Pian; NOW, THEREFORE, THE CiTY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The documents attached hereto marked Exhibits A and B are hereby approved and adopted as Map 15 and 16, respectively, of the Hospital Area Sp~cific Plan of the City of Santa Monica. SECTION 2. A Negative Declaration is adopted in that Initial Study (IS} 93-003 pravides sufficient data to support a finding that the project will not have a significant effect on the environment. SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thencefarth and thereafter the same shall be in full force and effect.
