SUBJECT: Ordinance Adding Section 3.08.390 to the Santa
Monica Municipal Code To Establish Preferential
Parking Zone AA
At its meeting on May 25, 1993, the City Council introduced
for first reading an ordinance establishing Preferential Parking
Zone AA in the area bounded by Kensington Road, 7th Street, Pine
Street, and Lincoln Boulevard, except not including Lincoln
Boulevard. The accompanying ordinance is now presented to the
city Council for its adoption.
gECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADDING SECTION 3.08.390
TO THE SANTA MONICA MUNICIPAL CODE TO
ESTABLISH PREFERENTIAL PARKING ZONE AA
WHEREAS, the Parking and Traffic Engineer has recelved a
petition requesting establishment of a preferential parking zone
in the area bounded by Kensington Road, 7th street, pine Street,
and Lincoln Boulevard, except not including Lincoln Boulevardj
and
WHEREAS, the petition has been verified to be signed by
residents living in two-thirds of the dwelling units comprlsing
not less than fifty percent (50%) of the developed frontage of
the proposed preferential parking zonej and
WHEREAS, the Parking and Traffic Engineer has undertaken
such studies and surveys deemed necessary to determine whether a
preferential parking zone should be designated in the area; and
WHEREAS, the City Councl.l is satisfied that the proposed
area meets the designatlon criterla set forth in Municipal Code
Section 3232A,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:

SECTION l. section 3.08.390 lS added to the Santa Monica
Municipal Code to read as follows:
Sect10n 3.08.390. Preferential
Parking Zone AA.
(a) The followlng named and
described area within the city shall
constitute Preferential Parking Zone AA:
the area bounded by Kensington Road, 7th
street, Pine street, and Lincoln
Boulevard, except not including Lincoln
Boulevard.
(b) No vehicle shall be parked or
stopped adjacent to any curb in
Preferential Parklng Zone AA between the
hours of 8:00 a.m. and 6:00 p.m. daily,
without a permit lssued and displayed in
accordance with this Chapter.
( c) Any vehicle parked or stopped
without a permit when required by this
Section may be removed from the street by
any police officer.
(d) The annual fee for each permit
issued for Preferential Parklng Zone AA
shall be $15.00 per permit, or such other
fee as may be established from time to
time by resolution of the City Council.

SECTION 2. Any provision of the Santa Monica Municipal
Code or appendlces thereto inconsistent with the provisions of
this Ordinance, to the extent of such lnconsistencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this Ordinance.
SECTION 3. If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this ordinance. The Clty Councll hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether
any portion of the Ordinance would be subsequently declared
invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance. The City Clerk shall
cause the same to be published once ln the officlal newspaper
wlthin 15 days after lts adoptlon. This Ordinance shall become
effective after 30 days from its adoption.
