SUBJECT: Ordinance Adding section 2.48.030 to the
Santa Monica Municipal Code to Create the
position of Commissioner Emeritus on the
Commission on Older Americans
At its meeting on June 21, 1994, the city Council
introduced for first reading an ordinance adding section 2.48.030
to the Santa Monica Municipal Code to create the position of
Commissioner Emeritus on the Commission on Older Americans. The
ordinance is now presented to the city Council for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADDING SECTION 2.48.030
TO THE MUNICIPAL CODE TO CREATE THE POSITION
OF COMMISSIONER EMERITUS ON THE COMMISSION
ON OLDER AMERICANS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Section 2.48.030 1S hereby added to the Santa
Mon1ca Munic1pal Code to read as follows:

CommissionerCs)
Emeritus.
One or more Commissioner(s)
Emeritus shall be appointed to the Commission
on Older Amer1cans ("Commission") by the City
Council based upon the recommendat1ons of the
Cornmisslon. To be ellglble for appointment to
such a pos1t1on, a person must have served two
full terms as a Commlssioner on the Commission
and shall be active In the Santa Mon1ca
communlty.
Each Commlssioner Emerltus shall
be a nonvoting member of the Commiss1on, may
represent the Commlssion at community and

other functions as d~rected by the commission,
may serve on CommlSSlon co~mittees, and shall
abide by the bylaws of the commission. There
shall be no liIut to the number of
Commissioners Emeri tus appointed to the
Commisslon, each of whom shall serve a two
year term as a Commissioner Emeritus.
Unlimited term renewals of Commissioners
Emeritus can by made by the City Councll upon
the recommendation of the Commisslon.
SECTION 2. Any provlsion of the Santa Monica Municipal Code
or appendices thereto inconslstent with the provisions of this
Ordinance, to the extent of such lnconslstencles and no further,
are hereby repealed or modifled to that extent necessary to affect
the provisions of this Ordinance.
SECTION 3. If any section, subsectlon, sentence, clause, or
phrase of this Ordlnance lS for any reason held to be lnvalid or
unconstitutional by a decision of any court of any competent
jurisdiction, such declsion shall not affect the validity of the
rernainlng portlons of thls Ordinance. 'The city Councll hereby
declares that lt would have passed thlS Ordlnance, and each and
every section, subsection, sentence, clause, or phrase not declared
invalld or unconstltutional wlthout regard to whether any portion
of the Ordinance would be subsequently declared lnvalid or

unconstitutional.
SECTION 4.
The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance.
The City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoption.
This Ordinance shall become
effective after 3D days from its adoption.
