The ordinance is now presented to the city council for adoption. RECOMMENDATION It is respectfully recommended that the accompanying ordinance be adopted. PREPARED BY: Marsha Jones Moutrie, city Attorney JUN 2 8 1994 S r3_ ; CA:MJM:muni\laws\Jl\prfpkgcc city council Meeting 6-21-94 Santa Monica, California ORDINANCE NUMBER 1751 (CCS) {Clty council Series} AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 3.08.410 TO THE SANTA MONICA MUNICIPAL CODE TO ESTABLISH PREFERENTIAL PARKING ZONE CC WHEREAS, the Parking and Traffic Engineer has received a petition requestlng establishment of a preferential parklng zone in the area on 10th street between Montana Avenue and Alta Avenue; and WHEREAS, the petltion has been verifled to be signed by residents living in two-thlrds of the dwelling unlts comprlsing not less than flfty percent (50%) of the developed frontage of the proposed preferential parking zone; and \VHEREAS, the Parklng and Traffic Engineer has undertaken such studies and surveys deemed necessary to determine whether a preferential parking zone should be deslgnated ln the area; and WHEREAS, the Clty Council is satisfied that the proposed area meets the deslgnation criterla set forth in Municipal Code Section 3.08.040, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Sectlon 3.08.410 lS added to the Santa Monica Municipal Code to read as follows: - 1 - '- section 3.08.410. Zone CC. (a) The following named and described area wlthin the City shall canstltute Preferential Parking Zone cc: the area located on 10th Street between Montana Avenue and Alta Preferentlal Parkinq Avenue. (b) No vehicle shall be parked or stopped adjacent to any curb in Preferential Parking Zone cc between the hours of 9:00 a.m. and 9:00 p.m. daily, wlthout a permit issued and displayed in accordance wlth this Chapter. (c) Any vehicle parked or stopped without a permit when requlred by this Section may be removed from the street by any police officer. (d) The annual fee for each permit issued far Preferential Parking Zone CC shall be $15.00 per permit, or such other fee as may be established from time to time by resolution of the City council. SECTION 2. Any provlslon of the Santa Monica Munlcipal Code or appendlces thereto inconsistent ~vi th the provisions of this Ordinance, to the extent of such inconslstencies and no further, are - 2 - r hereby repealed or modified to that extent necessary to affect the provislons of thlS Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance 1S for any reason held to be inval~q_9r unconsti tutional by a decision of any court of any competent jurisdiction, such declsion shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared invalld or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the city clerk shall attest to the passage of this Ordlnance. The City Clerk shall cause the same to be publ1shed once in the offlcial newspaper within 15 days after lts adoptlon. This Ordinance shall become effective after 30 days from 1ts adopt1on.
