SUBJECT: Resolution to Set a Public Hearing on August 9, 1994, for
the Confirmation of Assessment of Costs to Repair Damaged
Sidewalks, Driveways, Curbs, and the Removal of Damaged
Pavement in Parkway Areas on Various city Streets
(SR-94-190)
Introduction
This report recommends that the city council set a public hearing
for August 9, 1994, to confirm assessment costs for repairing
damaged sidewalks, driveways, curbs, and removing damaged pavement
in parkway areas on various City streets, and to hear protests
regarding the completed work.
Backqround
On October 9, 1979, City Council approved a sidewalk repair program
which provided for property owner participation in the cost of
repairing damaged sidewalks. Residential property owner
participation is 50% of the cost of the repairs if the damage is
related to tree roots, and the City paying the remaining 50% of
the repair costs. Property owners are assessed 100% of the cost
if the damage is not related to tree roots and commercial property
owners are assessed 100% of the cost regardless of the cause of
the damage.

The property owners' share of the costs is now due. A public
hearing to confirm the assessment of costs must be held pursuant to
the provisions of Chapter 22, sections 5600 to 5630, of the
streets and Highways Code of the state of California. A Resolution
setting the public hearing for 6:30 p.m. on August 9, 1994, is
attached. All affected property owners will be notified of the
public hearing date and the assessment amount fifteen (15) days
prior to the public hearing. A list of property owners and
assessment amounts will be available to Council at the time of the
public hearing.
Budqet/Financial Impact
The financial calculation, which will indicate total revenues to be
derived from this assessment district over the next two years, will
be presented to the City council at the time of public hearing.
Recommendation
It is recommended the City Council adopt the attached Resolution
setting a public hearing on August 9, 1994, to confirm the
assessment of costs of the repair of damaged sidewalks, driveways,
curbs, and the removal of damaged pavement in the parkway areas for
the above-cited properties.

HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The superintendent of Streets wl1l file

of repairs, together with objections or protests, if any, which
may be raised by any property owner liable to be assessed for the
cost of such repairs and any other interested persons.
SECTION 3. All protests or obJections must be ~n
wrlting and flIed with the City Clerk on or before the time set for
the hearing of the protests and objectlons.
SECTION 4. The Superintendent of Streets ~s hereby
directed to mall notices, ln the manner and form prescribed by
law, of the costs of repalr and of the adoptlon of thls Resolutlon
to all persons ownlng real property affected by the sldewalk
assessment repair program, whose names and addresses appear on the
last equalized assessment roll for the City taxes or as known to
the City Clerk.
SECTION 5. The City Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be ln full force and effect.
