BACKGROUND
The City Planning Comm1.ssion approved the Tentatlve Map and the Ten-
ant-Part1.Cipatlng ConverSlon for the above proJect on March 2 f 1994,
after a public hear1.ng and a careful review of the record and staff
recommendatlons
The action of the Planning Commission was based
on the Commlssion's flndings that the proposed Tenant-Partlcipatlng
Conversion meets the requirements of Artlcle xx of the Clty Charter
and that the proposed 8ubd~vlsion 1.8 cons18tent with applicable
general and speciflc plans as adopted by the Clty of Santa Monlca
along wlth all mandatory requirements of the SubdlVlsion Map Act of
the State of California
The owners have submitted to the Clty a Wrltten Consent Agreement

blndlng the owners and any successors 1n lnterest to each cond1tlon
1mposed 1n connect1on with approval of this Tenant-Part1c1pating
Conversion. This Written Consent has been approved by the City
Attorney and the City Manager. Each part1cipat1ng tenant has been
informed in wr1ting of his or her r1ghts under Article XX of the
C1ty Charter. The License D1vision reports that proper arrangements
have been made to ensure payment of the Tenant-Particlpating
Conversion Tax.
The F1nal Map conforms to the Tentat1 ve Map. The Final Map has been
cert1fied by the C1ty Engineer for conformance with the Tentative
Map and cond1 tions thereon, the Subd1 vision Map Act and local
ordinances. The City Attorney's office has approved a Declaration
of Covenants f Condit1ons, and Restrictions, or equivalent document,
for th1S project as complying w1th the condltions of the Tentative
Map and the Tenant-Participatlng Conversion.
Council approval of a f1nal map for a Tenant-Partlcipat1ng
Conversion represents one of the last steps necessary in the
converSlon process. Following C1ty Council action and approval by
the Californ1a Department of Real Estate the applicants may beg1n
sell1ng thelr units to the tenants. As each unit is sold a
conversion tax per Section 2008 of Art1cle XX 1S due 1n an amount
equal to twelve times the monthly maximum allowable rent for that
un1t. These taxes w1ll be used to assist low and moderate lncome
households to purchase or lmprove the1r units subJect to affordable

repayment per Section 2009 of Article XX.
BUDGET/FISCAL IMPACT
The recommendation presented 1n this report does not have an 1mmedi-
ate budget or fiscal impact.
If and as units in the project are
sold 1n the future, Tenant-Part1cipatlng Conversion Taxes will be
collected pursuant to the provls1ons of Artlcle XX of the City
Charter and some increased property tax revenues may be generated.
RECOMMENDATION
It lS respectfully recommended that the Final Map for this Tenant-
Particlpating Conversion be approved by adopt1on of the accompanY1ng
resolution.

FOLLOWS:
SECTION 1. That the Final Map for Tract No.51767 ~n the City
of Santa Monica hereby is accepted and approved.
SECTION 2. That the City Clerk hereby is authorized and
directed to endorse upon the face of said Map this order
authenticated by the Seal of the City of Santa Monica.
SECTION 3. That the City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
