INTRODUCTION
This ~eport transmlts for City Councll approval a Flnal Map for the
followlng Tenant-Particlpatlng Converslon project:

BACKGROUND
The Clty Plannlng Commisslon approved the Tentatlve Map and the Ten-
ant-Particlpating Conversion for the above project on 11/3/93,
after a public hearlng and a careful reVlew 0= the record and staff
recommendatlons. The action of the Plannlng Commisslon was based
on the Commlssion's flndings that the proposed Tenant-Participatlng
ConverSlon meets the requlrements of Article XX of the Clty Charter
and that the proposed subdlvlsion lS consistent wlth appllcable
general and speclflc plans as adopted by the Clty of Santa Monica
along wlth all mandatory requirements of the Subdivlslon Map Act of
the State of Callfornia
The owners have submitted to the Clty a Wrltten Consent Agreement
bindlng the owners and any successors in interest to each conditlon

lmposed In connectlon wlth approval of thlS Tenant-Partlclpating
ConverSlon. This Written Consent has been approved by the Clty
Attorney and the Clty Manager. Each participatlng tenant has been
informed ln wrltlng of hlS or her rlghts under Artlcle XX of the
Cl ty Charter. The Llcense D1V1Slon reports that proper arrangements
have been made to ensure payment of the Tenant-Participating
ConverSlon Tax.
The Flnal Map conforms to the Tentatlve Map. The Flnal Map has been
certlfled by the Clty Englneer for conformance with the Tentative
Map and condltlons thereon, the Subdivlslon Map Act and local
ordlnances. The City Attorney's offlce has approved a Declaration
of Covenants, Condltlons, and Restrictions, or equlvalent document,
for thlS project as complYlng with the condltlons of the Tentatlve
Map and the Tenant-Participating ConverSlon.
CounC11 approval of a final map for a Tenant-Partlclpating
ConverSlon represents one of the last steps necessary in the
converSlon process Followlng City Council actlon and approval by
the Callfornia Department of Real Estate the appllcants may begin
selling thelr unlts to the tenants. As each unit is sold a
converSlon tax per Sectlon 2008 of Article XX lS due In an amount
equal to twelve times the monthly maximum allowable rent for that
unlt. These taxes wlll be used to asslst low and ~oderate income
households to purchase or lmprove the~r unlts subJect to affordable
repaYTent per Sectlon 2009 of Artlcle XX.

BUDGET/FISCAL IMPACT
The recommendatlon presented ln thlS report does not have an lmmedi-
ate budget or fiscal lmpact. If and as unlts ln the project are
sold in ~he future, Tenant-Partlclpating Conversion Taxes wlll be
collected pursuant to the provislons of Artlcle XX of the Clty
Charter and some lncreased property tax revenues may be generated.
RECOMMENDATION
It is respectfully recommended that the Final Map for this Tenant-
Particlpating Conversion be approved by adoptlon of the accompanYlng
resolutlon

ACCEPTING AND APPROVING
A FINAL SUBDIVISION MAP FOR TRACT NO. 51729
AT 842-844 12th STREET
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the F1nal Map for Tract No. 51729 in the C1ty
of Santa Mon1ca hereby 18 accepted and approved.
SECTION 2 That the C1ty Clerk hereby is authorized and
directed to endorse upon the face of said Map this order
authenticated by the Seal of the C1ty of Santa Monica.
SECTION 3. That the City Clerk shall certify to the adoption
of th1S Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
