BACKGROUND
The City Planning Commlss~on approved the Tentative Map and the Ten-
ant-particlpating ConverSlon for the above project on November 13,
1991, after a public hearing and a careful review of the record and
staff recommendations. The action of the Planning Commisslon was
based on the CommlSSlon's findlngs that the proposed Tenant-
Particlpating ConverSlon meets the requlrements of Artlcle XX of the
City Charter and that the proposed subdlvislon is consistent wlth
appllcable general and speciflc plans as adopted by the City of
Santa Monica along with all mandatory requirements of the
Subd~vislon Map Act of the State of Californ~a.
The owners have submltted to the Clty a Wr~tten Consent Agreement

1mposed in connect1on with approval of th1S Tenant-Partlcipating
Conversion Th1S Written Consent has been approved by the Clty
Attorney and the City Manager. Each participat1ug tenant has been
informed in wr1tlng of hlS or her rlghts under Article XX of the
Ci ty Charter. The License D1v1sion reports that proper arrangements
have been made to ensure payment of the Tenant-Partlclpating
ConverS1on Tax.
The Final Map conforms to the Tentat1ve Map. The Final Map has been
certified by the C1ty Englneer for conformance w1th the Tentatlve
Map and conditlons thereon, the SubdivlS10n Map Act and local
ord1nances. The C1ty Attorney's offlce has approved a Declarat10n
of Covenants, Cond1t1ons, and Restr1ct1ons, or equivalent document,
for thls proJect as complying wlth the conditions of the Tentative
Map and the Tenant-Partic1patlng Conversion.
Council approval of a final map for a Tenant-Participating
Conversion represents one of the last steps necessary in the
converS1on process. Followlng City Council action and approval by
the Californ1a Department of Real Estate the applicants may begin
selling their un1ts to the tenants. As each unit 1S sold a
conversion tax per Section 2008 of Art1cle xx 1S due ln an amount
equal to twelve tlmes the monthly maximum allowable rent for that
unlt These taxes w1II be used to assist low and moderate income
households to purchase or 1mprove the1r units subject to affordable
repayment per Section 2009 of Article XX

BUDGET/FISCAL IMPACT
The recommendat1on presented 1n th1S report does not have an 1mmedi-
ate budget or f1scal impact. If and as un1ts 1n the proJect are
sold 1D the future, Tenant-Part1cipating Convers1on Taxes w1ll be
collected pursuant to the provislons of Article XX of the City
Charter and some increased property tax revenues may be generated.
RECOMMENDATION
It 1S respectfully recommended that the Final Map for this Tenant-
Partic1pat1ng ConverS1on be approved by adoption of the accompanYlng
resolut1on.

A FINAL SUBDIVISION MAP FOR TRACT NO.50B??

THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the Final Map for Tract No.50S77 In the City
of Santa Monica hereby is accepted and approved.
SECTION 2. That the City Clerk hereby J.5 authorJ.zed and
dJ.rected to endorse upon the face of said Map thJ.s order
authenticated by the Seal of the City of Santa Monica.
SECTION 3. That the City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
