INTRODUCTION

BACKGROUND
The Clty Plannlng Commlssion approved the Tentatlve Map and the Ten-
ant-Particlpatlng COTIVerS10n for the above proJect on 3/2/94, after
a public hearing and a careful reVlew of the record and staff
recomrnendatlons. The action of the Planning Commisslon was based
on the Comm1ssion IS findlngs that the proposed Tenant-Part1cipating
ConverS1on meets the requlrements of Article XX of the City Charter
and that the proposed subdivis10n lS cons1stent wlth applicable
general and speclfic plans as adopted by the Clty of Santa Monica
along wlth all mandatory requlrements of the Subdivlsion Map Act of
the State of Callfornla.
The owners have submltted to the Clty a Written Consent Agreement
bind1~g the owners and any successors 1n lnterest to each condltion

l.mposed In connection with approval of this Tenant-Participatlng
ConVerSlon. ThlS Written Consent has been approved by the Clty
Attorney and the City Manager. Each partlcipatlng tenant has been
l.nformed J.n wrlting of his or her rights under Article XX of the
Cl ty Charter. The LJ.cense Dl visJ.on reports that proper arrangements
have been made to ensure payment of the Tenant-Partlcipat~ng
Conversion Tax.
The Flnal Map conforms to the Tentatlve Map. The Final Map has been
certified by the CJ.ty Engineer for conformance wlth the Tentatlve
Map and condltions thereon, the Subdivlsion Map Act and local
ordlnances. The Clty Attorney's office has approved a Declaratlon
of Covenants, Conditlons, and Restrlctlons, or equivalent document,
for this project as complYlng wlth the condit~ons of the Tentatlve
Map and the Tenant-Partlcipating Conversion.
Council approval of a final map for a Tenant-Participating
Convers~on represents one of the last steps necessary in the
converSlon process. Following C~ty Councll actlon and approval by
the Cal~fornia Department of Real Estate the appllcants may begin
selling thelr units to the tenants. As each unit is sold a
converSlon tax per Sectlon 2008 of Article XX 18 due In an amount
equal to twelve times the monthly maximum allowable rent for that
unlt. These taxes will be used to asslst low and moderate lucorne
households to purchase or lmprove the1r units subject to affordable
repayment per Section 2009 of Artlcle xx.

BUDGET/FISCAL IMPACT
The recommendation presented in this report does not have an immedl-
ate budget or flscal impact. If and as unlts ln the proJect are
sold in the future, Tenant-Part~cipating Conversion Taxes will be
collected pursuant to the provlsions of Artlcle XX of the Clty
Charter and some increased property tax revenues may be generated.
RECOMMENDATION
It is respectfully recommended that the Final Map for this Tenant-
PartlcipatJ...ng ConverSl0n be approved by adoption of the accompanying
resolution.

A RESOLUTION OF THE CITY COUNCIL

ACCEPTING AND APPROVING
A FINAL SUBDIVISION MAP FOR TRACT NO. 51820
AT 423 PIER AVENUE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1 That the Flnal Map for Tract No. 51820 in the City
of Santa Monica hereby lS accepted and approved.
SECTION 2. That the City Clerk hereby is authorlzed and
directed to endorse upon the face of said Map this order
authenticated by the Seal of the City of Santa Monica.
SECTION 3. That the City Clerk shall certify to the adoption
of thls Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
