BACKGROUND
The City Plannlng Commlssion approved the Tentative Map and the Ten-
ant-particlpating ConverSlon for the above proJect on July 8, 1992,
after a public hearing and a careful review of the record and staff
recommendatlons. The act1.0n of the Planning Commiss1.on was based
on the Commlssion' s findlngs that the proposed Tenant-Particl.pating
Conversion meets the requ~rements of Art1.cle XX of the Cl.ty Charter
and that the proposed subdlvlsion lS conslstent wlth appl1.cable
general and speciflc plans as adopted by the Clty of Santa Monica
along wlth all mandatory requlrements of the Subd1.vislOn Map Act of
the State of Cal~forn1.a
The owners have submitted to the City a Wrltten Consent Agreement
blndlng the owners and any successors In 1.nterest to each condltion

imposed 1.n connection with approval of this Tenant-Participating
ConverSl.on. ThlS Wrl.tten Consent has been approved by the City
Attorney and the Clty Manager. Each partlclpatl.ng tenant has been
informed 1.n wrltlng of h1.s or her rights under Article XX of the
Cl t Y Charter. The License Di vislon reports that proper arrangements
have been made to ensure payment of the Tenant-Particlpat1.ng
Conversion Tax.
The Final Map conforms to the Tentat1.ve Map. The Final Map has been
certlfled by the City Engineer for conformance wlth the Tentative
Map and condltlons thereon, the Subdlv1.slon Map Act and local
ordlnances The Clty Attorney's office has approved a Declaration
of Covenants, Conditions, and Restrictlons, or equ1.valent document,
for thlS proJect as complying with the cond1.tlons of the Tentative
Map and the Tenant-Partl.Clpatlng Conversion.
Councl.l approval of a flnal map for a Tenant-Partlclpat1.ng
ConverSlon represents one of the last steps necessary in the
converSlon process. Followlng City Council action and approval by
the Callfornla Department of Real Estate the appl1.cants may begin
selllng thel.r unlts to the tenants. As each UTI1.t lS sold a
converSlon tax per Section 2008 of Artl.cle XX lS due ln an amount
equal to twelve tlmes the monthly maximum allowable rent for that
un1.t These taxes will be used to assist low and moderate income
households to purchase or improve thelr un1.ts subJect to affordable
repayment per Sectlon 2009 of Article XX.

BUDGET/FISCAL IMPACT
The recommendatlon presented in thlS report does not have an lmmedl-
ate budget or flscal 1.mpact If and as units in the proJect are
sold in the future, Tenant-Partlclpatlng ConverS1.on Taxes wlll be
collected pursuant to the prOV1S1.0nS of Artlcle XX of the City
Charter and some increased property tax revenues may be generated.
RECOMMENDATION
It 1.S respectfully recommended that the Final Map for th1.s Tenant-
Part1.C1.patlng ConverS1.on be approved by adopt1.on of the accompanYlng
resolut1.on.

OF THE CITY OF SANTA MONICA
ACCEPTING AND APPROVING
A FINAL SUBDIVISION MAP FOR PARCEL NO. 21879
AT 1235 24TH STREET
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS.
SECTION 1. That the Final Map for Parcel No 21879 in the
City of Santa Monica hereby is accepted and approved.
SECTION 2. That the City Clerk hereby is authorized and
directed to endorse upon the face of said Map this order
authenticated by the Seal of the City of Santa Monica.
SECTION 3. That the City Clerk shall certlfy to the adopt1.on
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
