BACKGROUND
The C1.ty Planning Commisslon approved the Tentative Map and the Ten-
ant-Part1.cipating Conversion for the above proJect on November 4,
1992, after a publlC hearing and a careful review of the record and
staff recommendations. The actlon of the Planning Commlssion was
based on the Comm1.ssion's flndings that the proposed Tenant-
PartiC1.patlng ConverSlon meets the requirements of Article XX of the
C~ty Charter and that the proposed subdivlsion 1.S consistent wlth
appl1.cable general and speciflc plans as adopted by the City of
Santa Monlca along with all mandatory requirements of the
Subdiv1.s10n Map Act of the State of California
The owners have submltted to the Clty a Wrltten Consent Agreement

blnding the owners and any successors in 1.nterest to each condition
lmposed in connect1.on wlth approval of this Tenant-Partic1.pat1.ng
Conversion. This Written Consent has been approved by the City
Attorney and the Clty Manager. Each partlcipatlng tenant has been
1.nformed ln wrlting of his or her r1.ghts under Article XX of the
Ci t Y Charter. The Llcense Divlsion reports that proper arrangements
have been made to ensure payment of the Tenant-Part1.cipating
Conversion Tax.
The Final Map conforms to the Tentative Map. The Final Map has been
certifled by the Cl.ty Engineer for conformance wlth the Tentatlve
Map and cond~tions thereon, the Subdlvlsion Map Act and local
ord1.nances. The City Attorney's office has approved a Declaration
of Covenants, Conditlons, and Restr1.ctions, or equlvalent document,
for this proJect as complYlng with the condltions of the Tentatlve
Map and the Tenant-Participating ConverS1.on.
Council approval of a final map for a Tenant-Partic1.patlng
ConverSlon represents one of the last steps necessary ln the
converSlon process. Following City Council actlon and approval by
the California Department of Real Estate the appl1.cants may begl.n
selllng their unlts to the tenants As each un1.t lS sold a
conversion tax per Bect1.on 2008 of Artl.cle XX 1.S due in an amount
equal to twelve times the monthly maX1.mum allowable rent for that
un1.t. These taxes wlll be used to ass 1St low and moderate income
households to purchase or improve their units subJect to affordable

repayment per Section 2009 of Article XX.
BUDGET/FISCAL IMPACT
The recommendatlon presented in thlS report does not have an 1.mmedl-
ate budget or f1.scal lmpact If and as units l.n the proJect are
sold in the future, Tenant-Part1.cipat1.ng Convers1.on Taxes will be
collected pursuant to the provislons of Article XX of the City
Charter and some increased property tax revenues may be generated.
RECOMMENDATION
It lS respectfully recommended that the Final Map for this Tenant-
Part1.cipatlng Conversion be approved by adopt1.on of the accompanYlng
resolut1.on

A FINAL SUBDIVISION MAP FOR TRACT NO 51329

THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the Final Map for Tract No.51329 in the City
of Santa Monica hereby lS accepted and approved.
SECTION 2. That the City Clerk hereby 1.S authorlzed and
dlrected to endorse upon the face of sa1.d Map this order
authenticated by the Seal of the Clty of Santa Monica
SECTION 3. That the City Clerk shall certl.fy to the adoption
of thlS Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
