to the Zonlng Ordinance ln the following areas:

be addressed.
As a result of further consultatlons wlth the
Westslde Amateur Radlo Club, the American Radlo Relay League, the
Fire Department's Disaster Communlcation SerVlce ham radlo group,
LA Cellular, Airtouch Cellular, and Eughes DlrecTv, this report and
the proposed ordinance have been updated.

BACKGROUND
The Clty Councll dlrected staff to prepare regulations concernlng
amateur radlo antennas after the Councll heard from several
cltlzens concerned wlth the lnstallatlon of a radlo antenna ln a
residential neighborhood. Antennas are used ln a wide variety or
sltuations, includlng televlslon, amateur radlo, and cellular
radlotelephone operatlons. In the aftermath of the Northrldge
earthquake, both ham radio and cellular systems played an important
role in emergency communlcatlons when other means of communication
were lnoperatlve. For example, Clty BUlldlng and Safety staff and
mutual aid volunteers made extenslve use of cellular telephones In
the emergency lnspectlon process. Ham operators actlvated pre-
organlzed emergency networks immediately after the earthquake to
facilitate communicatlon not only ln the reglon, but wlth other
parts of the state and country Thus lt lS l~portant that
comprehensl ve standards be established for a range of antenna
types. Currently, the Zonlng Ordlnance contains regulatlons only
for parabollc antennas and not for other types of antennas that do
not have a parabollc shape, such as amateur radlo, standard
television, and some cellular antennas
Noncommerclal Nonparabolic Antennas
Noncommercial nonparabollc antennas are antennas used to transmlt
and recelve, or receive only, for noncommerclal purposes. These

antennas, which are lnstalled for personal use, are generally
located in resldentlal zones and lnclude amateur radio.
The Federal Commun1cation Commlss1on (FCC) requ1res that local
ordinances be crafted to reasonably accommodate amateur
communicatlons and to represent the min1mum pract1cable regulatlon
to achleve the Clty'S leglt1mate purposes. The proposed
regulat10ns reasonably accommodate amateur commun1cat1ons while
establlshing the mlnimum regulatlons and design standards necessary
to protect the public health, safety and aesthetic interests.
There are a varlety of types of antennas that operators use,
lncluding vertical, Wlre and horizontal antennas Many vertlcal
antennas are 25-35 feet in he1ght and about two 1nches in diameter
at the base, tapering to a pOlnt over its length A wire antenna
is orten strung between two vertical elements, such as poles or
trees The wire and vertical antennas, because of the1r Slze, are
not generally vlsua:ly obtrusive. A horizontal beam antenna 1S
typlcally mounted elther on a freestanding support structure, or on
a roof mounted support structure. Because of ltS nature and Slze,
the horizontal beam antenna is more vlSlble and may be v1sually
intrusive.
A critical question concerning the noncommerc1al non-parabollc
antennas relates to the height that 1S necessary to allow the radio
operator suff1c1ent ablllty to commun1cate. Many factors are
relevant, such as dlstance over wh~ch the operator 1S trYlng to

communlcate, radio frequency and output power used, a:J.d topography.
Greater antenna height reduces the chance of radio interference
with other electronlc devlces (such interference cannot be
regulated by the Clty), however for some types of installations,
greater height may lncrease aesthetlc lmpacts.
Californla Clties that have regulations pertaining to noncommerclal
nonparabollc antennas have adopted a wlde range of standards
pertainlng to locatlon, allowable helght, and approval process.
Accordlng to an analysis by the Clty of Los Angeles Plannlng staff,
allowable height, whlch generally lS the mal~ lssue, ranges from 10
to 100 feet, wlth the two most common helght ranges found between
30-40 and 60-75 feet. Several Jurisdictlons require use permlts
for all antennas. Rancho Palos Verdes allows as a matter of rlght
a height of 30 feet and up to 40 feet prov1ded the antenna 1S
retractable to 30 feet. Above these helghts, a mlnor exception
perm~t lS requlred, which involves noticing wlthln 500 feet of the
property and a flling fee of $145.
An issue raised at the Plannlng Commisslon hearing and the
subsequent staff workshop concerned whether or not to requlre that
antennas be retractable. A number of cltles, such as Newport Beach
and Rancho Palos Verdes, req~ire that if antennas exceed a certain
height, they be retractable, and that the antennas be retracted
when not In use The crank-up syste~ can be hand or motor drlven.
Assuming a motor drlven system, and that many amateur operators use
thelr equipment daily, a requirement for lowerlng the antenna after

each use could cause premature wear on the motor. In addition, on
a practlcal level, constant ralslng and lowering of an antenna
would be unllkely to occur and dlfflcult to enforce. However, the
retractable aspect would llkely reduce overall aesthetic i~pacts
even if the antenna was not lowered after each and every use.
The proposed ordlnance seeks to reasonably accommodate radio
operators while settlng mln~mum regulations and deslgn standards
necessary to protect the publlC health, safety, and aesthetlc
interests. The approach in the proposed ordlnance is to allow as
a matter of rlght antennas that meet certain helght and locatlon
crlterla. A Use Permlt would be required for antennas that do not
meet the crlteria. The ordlnance would permlt an antenna of up to
66 feet in helght, or 15 feet above the height llmlt of the zoning
district, whlchever is greater, wlth a requirement that the antenna
be retractable to 35 feet. A vertlcal antenna element could exceed
the 66-foot Ilmlt by up to 15 feet. Fixed antennas of 35 feet or
less would be permltted as of right. Alternatlves to this standard
would be to allow the 56-foot helght without a retractabllity
requlrement, or to allow a greater or lesser helght as of rlght.
Staff recommends that the Councl1 adopt the ordinance as presented.
As proposed, the ordinance does not preclude a taller antenna, but
rather requlres that there be a case-by-case reVlew Vla the Use
Permlt process to have a taller antenna. The burden would be on
applicants to demor:strate technical need for greater helghts

Absent such demonstration, the request would be denied. The Use
Permlt process wlll allow for publlc lnput at a hearlng for antenna
owners who seek to exceed the as-of-rlght helght llmlt, and would
include the rlght of appeal to the Plannlng CommlSSlon. Given the
slgnlflcant legal limitations on the City's regulatory authority
and the technlcal nature of these types of applications, the Use
Permit procedures appears more approprlate than a Condltlonal Use
Permit.
As of thlS writing, a Use Permlt would requlre a flllng fee of $600
(this fee will be $1000 as of September 1, 1994) Amateur
operators expressed concern wlth the $600 fee and belleve that
glven the potentlal emergency function of their operation, that a
nominal fee should lnstead be charged Although not a formal
recommendatlon, the Planning Commission reached consensus on the
fee and felt a reduction in the fee to $25 for a~ateur operators lS
appropriate. ThlS staff report recommends that a fee of $100 be
set for thlS type of Use Permit applicatlon. Whlle thlS amount
would result lD recovery of only a fraction of the Clty'S
processlng costs, thlS lS conslstent wlth Federal dlrectlon that
localitles ffilDlmlze costs and regulatory procedures for this type
of communication. The revenue lmpacts are also ffiltlgated by the
publlC benefit of potential emergency functlons associated wlth the
ham radlO antennas, and by the relatlvely low antlclpated number of
such appllcations.

In summary, the proposed ordlnance provldes standards ln terms of
locatlon, number and height for the lnstallatlon of noncommerclal
antennas as a matter of rlght on all propertles wlthln the Clty.
The proposed ordinance does ~ot preclude someone froIT installing an
antenna that does no~ meet the regulatlons. In that circumstance,
the ordinance requires that the appllcant demonstrate technical
reasons as to why the regulatlons cannot be met. Technical reasons
could lnclude topography of the area and the proxinity of taller
buildings that would dlsrupt transmlssion. The procedure to
request an exceptlon would be the Use Permlt process, which would
allow for publlC input at a publlC hearlng held by the Zonlng
Admlnlstrator. As drafted, the ordinance would allow eXlsting
antenna structures that do not meet the regulatlons to remaln but
would not allow the replacement of an eXlsting antenna with a
larger antenna An alternatlve would be to requlre that all
antenna structures comply wlth the regulatlons wlthin a certaln
perlod of time. Staff does not recommend this revlsion due to the
expense it would cause operators already uSlng older equlpment and
the difflculty in enforclng such a provislon should it be adopted

The Callfornla PubllC Utllities CommlSSlon (CPUC) establlshed a
statewide system for cellular telephone communlcation. The CPUC
has llcensed two companles to operate ln each metropolitan area,
the two authorlzed companies for the Santa Monlca area are LA
Cellular and Air Touch (formerly PacTel Cellular). The Clty may
regulate the locatlon and Slze of antennas and support structures
lnvol ved ln cellular telephone communlcatlons / but local
regulatlons may not confllct wlth the statewlde lnterest in having
wldespread and rellable cellular telephone serVlce The CPUC has
reta~ned the ]urlsdlctlon to preempt local regulatlon of cellular
telephone antennas ln cases where a publlcally regulated cellular
telephone utlllty establlshes that local regulatlons clearly
confllct wlth that statewide interest.

structures where possible Staff recommends that the perm1tted
height of a commerc1al antenna be 15 feet above the he1ght limit of
the dlstrlct.
As with the noncommercial antenna, a Use Permlt would be requlred
to obtain approval for an antenna that does not comply with the
regulations.
Television Antennas
Currently, the Zonlng Ord1nance does not address standard
televls10n antennas. TeleVlS10n antennas can be either commercial
or noncommerc 1al

antenna of up to 15 feet ln helght per res1dential unit, with one
such antenna allowed to extend up to 25 feet above the roofllne in
all zonlng districts to address sltuations where reception lS
restricted by topography or tall build1ngs

The Zon1ng Ord1nance currently conta1ns regulatlons for parabolic
antennas located l.n residential and nonresldentl.al zones. The
three main lssues wlth the current regulat10ns are: 1) the Slze of
the antennas permitted as a matter of right; 2) addresslng d1ameter
in feet rather than meters; and 3) the process to reVlew
appllcatlons to exceed the code.

The Federal Communications CommlSSlon (FCC) has part1ally preempted
local regulation of parabolic TVRO antennas Local regulations
must have a reasonable and clearly defined health, safety, or
aesthet1c objective, they may not operate to impose unreasonable
llmitat10ns on or prevent television recept10n or impose costs
excessive 1n llght of the purchase and 1nstallation costs of the
equlpment. The new ordinance clearly states the publlC health,
safety and aesthetic interests sought to be protected by the new
regulations and design standards, and makes flndlngs related to
those 1nterests.
In general, the range of parabolic TVRO antennas ava1lable on the
market 1S 7.5 to 12 feet in dlameterj the average size installed on
resident1al propert1es is 10-12 feet in diameter. In resident1al
zones, staff recommends an increase 1n the perm1tted Slze of TVRO
antennas from 1.5 meters (about 5 feet) to a 12 foot diameter so
that the ordinance corresponds w~th the Slze of antennas that are
typically available. The new ord~nance would allow ground-mounted
parabol1c antennas of these sizes conforming to the new standards
1n all resldential d1strlcts, roof-mounted antennas would be
allowed as-of-r1ght in the hlgher denslty multi-fam1ly zones where
yard area adequate to place a ground mounted antenna is not
generally available, but ln the lower-density resldential zones a
Use Perm1t would be requlred for any roof-~ounted parabollc
antenna. In addition, a parabollc antenna of up to 2 feet in
d1ameter would be allowed to be elther roof or ground-mounted,

type of television antenna which receives signals from a satell1te
system and is intended to be an alternat1 ve to cable systems
(Hughes D1recTv) .
In commerc1al zones, staff recommends an increase 1n the perm1tted
size of TVRO antenna from 3.0 meters (about 10 feet) to a 12 foot
d1ameter Currently, these antennas may be roof mounted but must
comp~y w1th the he1ght Ilm1t of the zoning distr1ct. No screen1ng
1S currently requ1red. Staff recommends that these antennas be
allowed to extend up to 15 feet above the roofline and that a
requ1rement be added to provide screen1ng from V1ew from street
leve~ and from ne1ghbor1ng residential propert1e8.
Currently, 1f an except10n to the regulat10ns 1S requested, a
Cond1t1onal Use Perm1t (CUP) 18 required. The concern w1th th1S
approach 18 the level of review and the cost The review procedure
required to request an except10n to the code should generally be
commensurate w1th the cost of the phys1cal improvement. A CUP is
reviewed by the Planning Comm1S81on (with poss1ble appeal to the
C1ty Council) and the flling fee is $1,630 as of thlS wr1t1ng (this
type of CUP will cost $1310 as of September 1, 1994) In the case
of parabolic TVRO antennas, thlS fee may sometlmes equal or exceed
the cost of the a!1tenna, Wh1Ch raises a slgnificant concern
relatlve to federal law. In lleu of the current CUP requ1rement,
staff recommends the util1zat1on of a Use Perm1t, similar 1n level

of reVlew and cost to the variance process ThlS process would
require a publlC hearing by the Zonlng Admlnlstrator with an appeal
process to the Plannlng Commission. Staff 1S recommending a filing
fee of $100 for Use Permlts lnvolvlng televlslon-only recelvlng
antennas (TVRO antennas) to provide conslstency wlth federal law.
Accordlng to Jonathan Kramer, President of Communications Support
Corpcratlon and a consultant to the City expert ln a varlety of
telecommunicatlons systems, the typlcal cost of a 10-12 foot
dlameter TVRO satellite dlSh system is between $3,500 and $4,500.
Based on thlS approximate cost range, a Use Permlt fee of $100
would not lmpose costs on applicants that would be excessive ln
llght of the purchase and lnstallation costs of such equipment
The proposed standards for such dlshes would also not impose
exceSSlve costs Roof mounted dishes would need screenlng, however
1n most cases thlS would create costs of not more than several
hundred dollars. In most cases, simple lattlce or metal panel
screenlng would be adequate. Non-TVRO types of parabollc antennas
needing a Use Permit would be subJect to the standard Use Permlt
fee.
Plannlnq Commisslon
In preparlng the orlglnal report WhlCh was clrculated ln January
1991, staff met with and received lnformat~on from a varlety of
sources Staff dlsc~ssed this matter wlth representatives of the
West Slde Radio Club, other cltles, staff at the California Public
Utllities Commission, and professionals in the telecommunicatlons

and electronics flelds Flve people provided detailed, extensive
comments to the original report.
The Planning CommlSSlon held a public hearlng on June 26, 1991.
Seventeen people addressed the Commlsslon, all provldlng testlmony
in the area of amateur radio operatlons Members of the public who
testlfled before the Plannlng Commlssion directed thelr comments
to the followlng 1) the importance and the role of amateur
operators ln emergency Sl tuatlons, 2) the need for a gyeater
allowable antenna helght, 3) the number of antennas allowed on the
site, 4) the use of a retractable support structure, and 5) the fee
requlred for amateur radlo operators to request an exception to the
regulations.
The Planning Commission discusslon focussed on the proposed
regulatlons for amateur radio since publlc testimony was provlded
only by amateur radlo operators. The Planning CommlSSlon dld not
dlSCUSS parabollc antennas or the proposed Use Permlt process The
four Plannlng Commissioners present forwarded the ordlnance to the
C~ty Councll, but dld not reach the requlslte four vote ~aJorlty
needed for a deflnltlve recommendatlon to Coup-cil.
Subsequent to the Planning CommlSSlon hearing, staff conducted a
workshop on the proposed ordlnance in October 1992. There was
considerable public comment provided at the meetlng, prlmarily
focusslng on the ham radlO antenna issue, but also wlth some lnput
on satelllte antenna regulatlons. Both ham radio operators

desiring ~ore Ilberal allowances, as well as neighbors of ham radio
antennas advocatlng for more restrictive standards spoke at the
workshop. As a result of this workshop and addltlonal staff
review, the draft ordinance was further reflned.
Chanqes From May la, 1994 Proposed Ordlnance
As a result of a request from ham radio operators, this matter was
continued from the May la, 1994 City Council meeting to provlde an
opportunity for staff to work wlth concerned partles so that
potential issues mlght be addressed. Subsequently, staff had
consultations with a number of lnterested groups, lncluding the
Westside Amateur Radlo Club, the Amerlcan Radlo Relay League, the
Flre Department's Disaster Communication Service group of ham radio
operators, LA Cellular, Alrtouch Cellular, and Hughes DlrecTv. As
a result of these discussions, a new version of the ordinance has
been prepared. The significant changes from the prlor version are
descrlbed below.
-Up to one standard nonparabolic television antenna of up to 15
feet in height above the roofllne would be permltted per dwelling
unit. These antennas have mlnlmal vlsual lmpact. The prlor
verSlon of the ord1nance only allowed one standard televlsion
antenna per parcel, which 1S 1mpractlcal for many multi-tenant
bU1ld1ngs.

-Up to four non-parabollc, non-commercial antennas of up to 10 feet
ln height above the roofllne would be permltted per parcel to
acco1l'modate a particular type of ham antenna, WhlCh resemble a
standard televlslon antenna and are relatively small and
unobtrusive.
-Up to one parabollc, non-commerclal antenna of less than 24 lnches
ln dlameter would be allowed per unit This would accommodate the
type of antennas used by the Hughes DlrecTv system, as well as a
partlcular type of ham radlo antenna.
-The maXlmum as-of-rlght helght of a ham radlo antenna would be
increased by 11 feet to 66 feet, which would enhance the baS1C
effectlveness of thlS type of antenna. Th:..s lncrease in height
would have the added beneflt of potentlally reduclng lnterference,
Slnce the greater the antenna helght, the less power needed to
transffilt.
-An exemptlon from the provlslons of the ordlnance would be created
for munlclpal communlcatlons antennas. The Clty has a ~ultipliclty
of antennas currently ln operatlon by the Pollce Department, Flre
Department, General SerVlces Department, and by the Resource
Management Department at the Airport
One lssue not addressed in the revised ordinance is a potential
allowance for non-parabollc commerclal "mlcrocell" lnstallations on

utillty poles ThlS type of antenna serves a small area, and is
generally less than two feet ln any dlmenslon No lnstallatlons of
such antennas eXlst ln Santa Monica, but ln the region, mlcrocells
have been used by both cellular companies, particularly ln canyon
areas. Both cellular companles operatlng ln the Los Angeles region
anticlpate greater use of this technology, lncludlng in urban
settlngs. In additlon, lt lS expected that pendlng Personal
Communlcatlon SerVlces (PCS) companles wlll make slgnlflcant use of
thlS type of lnstallatlon Due to the complexity of issues ralsed
by thlS technology, staff will conduct further research and if
necessary, wlll return to the Plannlng CommlSSlon wlth recommended
standards for microcell installations.
BUDGET/FINANCIAL IMPACT
Adoptlon of the ordinance amendments wlll not have a
budgetjfinanclal lmpact If the fee for amateur radlo operators
and noncommerclal parabollc antennas is reduced as recommended, the
fee would not cover the costs for processlng such applicatlons,
WhlCh would be expected to be relatively few lD number on an annual
basis.
RECOMMENDATION
Staff recommends that the Clty Councll:
A. Introduce for flrst readlng the attached ordinance includlng
its flndlngs, establishing regulatlons and deslgn standards for

nonparabolic antennas and modifying the regulations and deslgn
standards for parabollc antennas.
B. Approve the attached resolution to establlsh a fee of $100.00
for Use Permlt appllcations concernlng noncommerclal non-parabolic
antennas, and for TVRO parabollc antennas.

parabolic
Antenna.
An
accessory
structure of any shape, including the main
dish
and
covering,
feedhorn,
low-noise
amplifier, structural supports and all other
components
thereof,
which transmits and
receives electromagnetic waves by line of
sight.
( a)
Groundmounted nish Antenna.
A
parabolic antenna, the ent1re weight of which
is
supported
by
an
approved platform,
framework, poke or other structural system,
which system is affixed directly on or in the
ground by a foundation and which system is
freestanding, excluding lateral bracing to a
building.
(b)
Height.
The vertical distance
between the highest point of an antenna when
actuated to its most vertical position and
grade below, for a groundmounted dish antenna,
and to the roof below for a roofmounted dish

reasonable.
(h) TVRO Antenna. Television receiving
only antenna.
SECTION 4. The City Council finds that the proposed text
amendments related to nonparabolic and parabolic antennas are
consistent in principal with the goals, objectives, policies, land
uses, and programs specified in the adopted General Plan.
SECTION 5. The City council finds that the public health,
safety and general welfare require the adoption of the proposed
text amendments, in that the proposed text amendments provide clear
direction as to the size and location of nonparabolic and parabolic
antennas in order to protect the public health, safety, welfare and
aesthetic interests.
SECTION 6. Any provision of the Santa Monica Municipal Code
or appendices thereto inconsistent with the provisions of this
Ordinance, to the extent of such inconsistencies and no further,

are hereby repealed or modified to that extent necessary to effect
the provisions of this Ordinance.
SECTION 7. If any sectionf subsectionf sentence, clause, or
phrase of this Ordinance is for any reason held to be invalid or
unconstitutional by a decision of any court of any competent
jurisdiction, such decision shall not effect the validity of the
remaining portions of this Ordinance.
The city council hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not declared
invalid or unconstitutional without regard to whether any portion
of the Ordinance would be subsequently lnvalid or unconstitutional.
SECTION 8.
The Mayor shall slgn and the City Clerk shall
attest to the passage of this Ordinance.
The city Clerk shall
cause the same to be published once in the official newspaper
within fifteen (15) days after its adoption. This Ordinance shall
become effective upon adoption,
