INTRODUCTION This staff report recommends that the City Council introduce for first reading an ordinance to amend various sections of the Municipal Code in order to regulate firearm dealerships w.~thin the City of Santa Monica. BACKGROUND On August 9, 1994, the City Council adopted Interim Ordinance #1753 which placed restrictions and requirements on existing and future firearms dealer operations. In adopting the interim ordinance, the Council found that firearms are used in hundreds of crimes annually in Santa Monica, that inadequately secured firearms can be stolen and used in serious crimes and that the accidental discharge of firearms can lead to seziaus injury or death. The interim ordinance M Y s .{t i ~~~ prohibited the issuance of home occupation permits for firearms dealers, requires the issuance of a Conditional Use Permit for new firearms dealers, limits firearms dealerships to locations which are at least 1,500 feet from a similar use, school or day care facility and requires all firearms dealers to obtain a Firearms Dealer Permit from the Chief of Police. The City Council adopted Interim Ordinance #1832 on November 28, 1995 which extended the provisions of Interim Ordinance #1763 for nine (9} months to allow sufficient time for City staff to develop permanent standards. The ordinance now presented for Council consideration implements on a permanent basis the requirements contained in the interim ordinance with the exception of future locations for new firearms dealerships. Under the proposed ordinance, firearms dealerships will be allowed only in the M1 District, and will be prohibited in all other zoning districts, The prohibition on proximity to similar uses, schools and day care facilities has been eliminated. According to business license information, there are currently four businesses licensed as firearms dealers in the City which are in compliance with the interim ordinance and wi11 be subject to applicable provisions of the permanent ordinance. They are: 1) Ace Jewelry Loan Co., 1334 5th Street; 2} Art's Jewelry and Loan Co., 1418 2nd Streets 3} Big 5, 3121 Wilshire Blvd. and 4} Pacific Cartridge, 2834 Colorado Avenue. These businesses will be allowed to remain as legal non-conforming land uses. Under the provisions of the interim ordinance, no business licenses have been renewed or 2 issued for home-based firearms dealerships. ANALYSIS The number of crimes, deaths and injuries attributable to firearms is unacceptable and warrants stricter control over the availability of firearms within the City of Santa Monica as Police Department statistics indicate that firearms were used in 50$ of the homicides in the City of Santa Monica during 1994 and 1995, were used in 66~ of robberies in the City of Santa Monica during 1995, and were used in 27 aggravated assaults in the City of Santa Monica during 1995. The City Council, through the adoption of Interim Ordinances #1763 and #1831, has acknowledged the problem by taking steps on an interim basis to impose stricter requirements on existing and future firearms dealerships in the City. This provided staff with time to investigate the appropriate measures to be taken by the City on a permanent basis. Proposed Amendments to the Zoning Ordinance Definitions for Firearms Dealerships The Zoning Ordinance currently does not have a definition for firearms dealerships. Staff is proposing to add Section 9.04.02.030.312 to the Zoning Ordinance to define firearms dealerships as follows: Firearms dealership: An establishment which sells, transfers, leases, offers or advertises for sale, transfer or Lease any firearm or munitzons. 3 Firearms Dealerships Standards City staff reviewed ordinances from other California cities which also regulate firearms dealerships and talked to organizations within the state who advocate for and monitor firearm dealership regulations statewide. These organizations have indicated that the City of Oakland has the most comprehensive regulations in place. The adopted interim ordinance is patterned after the Dakland ordinance in its provisions for a firearms dealer permit, liability insurance, locational restrictions from similar uses, day care facilities and schools and on--premises security measures. In developing recommendations for permanent firearms dealership standards, staff analyzed where dealerships could locate within the City given the 1,500' distance required from schools or day care facilities and similar uses as provided far in the interim ordinance. Staff found that under this requirement there are only three locations in the City where new firearms dealers could locate. These locations include Main Street, the commercial area on 26th Street between San Vicente Boulevard and Georgina Avenue and Santa Monica Place. All three of these areas are heavily travelled by pedestrians including families with children and are inappropriate locations for firearms dealers due to the incompatibility with the adjacent residential uses and the commercial uses in these areas which serve the neighborhoods and the community. Furthermore, since land uses are constantly changing (ie. child care/day care facilities}, with a distance requirement 4 as outlined above, allowable locations of firearms dealerships would also constantly change. This would not be an appropriate approach for permanent standards. Rased upon this analysis, staff does not believe that using a distance restriction as part of the permanent standards is appropriate and therefore analyzed specific zoning districts in the City to identify appropriate locations for firearms dealerships. Based upon review of the City's commercial and industrial zoning districts, staff recommends the M1 zoning district as an appropriate place for any new firearms dealers. The visibility and presence of firearms dealerships in heavily travelled commercial areas and in areas near where people live is a constant reminder of the prevalence of firearms-related violence in our society and is detrimental to the peace of mind and quality of life of Santa Monica residents. Additionally firearms dealerships are incompatible with other uses in commercial areas, particularly bars and restaurants that serve alcohol, which can impair human judgement and as such can lead to violent confrontations and disputes involving firearms. The M1 district is an area of the City which does not have heavily travelled commercial areas and has few residences, schools, churches and other public gathering places; it is largely physically separated from adjacent residential areas to the south by the I-10 Santa Monica Freeway, is geographically separated from the major commercial corridors of the City to the north and is not pedestrian oriented. Additionally, staff met with Police Department officials to discuss this approach and they indicated support for limiting 5 firearms dealerships to one geographical area of the City as a way to more easily monitor these uses. Staff further recommends that within the M1 zoning district, firearms dealerships be permitted by Conditional Use Permit {CUP) by amending Section 9.04.08.34.040. By requiring a Conditional Use Permit, decision makers will be given an opportunity to examine the particular locational characteristics of each application for a new firearms dealership, review the design and configuration of the improvements and the potential impacts an the surrounding area, and make appropriate findings and conditions of approval. Among the findings that must be made by the Planning commission, or City Council on appeal, in approving the CUP are that the firearms dealership does not impair the character and integrity of the district; the firearms dealership is compatible with existing and permissible land uses on the site; within the district and within the general area, the placement of the firearms dealership is compatible with and relates harmoniously to the surrounding neighborhood; and that the f~.rearms dealership is not detrimental to the public interest, health, safety, convenience or general welfare. Under the CUP process all property owners and tenants within 500 hundred feet of the proposed location are notified of the public hearing enabling public input into the decisian making process. 6 Amendment to Purpose Section of the M1 Zoninq District The Purpose Section of the M1 Zoning District currently does not call out firearms dealerships as an intended land use. In order to ensure consistency with the Zoning Drdinance, an amendment to the Purpose Section of the M1 Zoning District contained in Section 9.04.08.34.010 of the Zoning Ordinance to allow firearms dealerships in the M1 Zoning District with the issuance of a Conditional Use Permit {CUP) is required. This proposed text amendment would add language to the Purpose Section which would allow the M1 district to "accommodate those general retail uses which do not serve community and neighborhood needs and are not compatible with other commercial land uses allowed zn commercial zoning districts elsewhere in the City." Firearms dealerships would fall under this category. Prohibiting Hame Occupation Permits for Firearms Dealerships The City Council, in adapting Interim Ordinances #1763 and #1831, found that, "The sale of firearms or munitions in residential districts or in residential property is incompatible with the use of the district or property for dwelling purposes," and therefore, prohibited the issuance of Home Occupation Permits for firearms dealerships. Staff is recommending that this prohibition be made part of the permanent standards by amending Section 9.04.20.04.040 of the Municipal Cade to list firearms dealerships as a prohibited home occupation use. Staff is also recommending that Section 9.04.20.04.050 be amended to authorize the revocation of any home 7 occupation permits located in residential areas or which are otherwise inconsistent with the standards of the permanent ordinance. Prohibiting Firearms Dealerships in Other Commercial Zoninq Districts Finally, staff is recommending that firearms dealerships be identified as a prohibited use in the RVC, BCD, BSC, C2, C3, C3-C, C4, C5, C6, CM, CP, and LMSD zoning districts of the City by amending the following Sections of the Zoning Ordinance: Sections 9.04.0$.12.050, 9.04.0$.14.050, 9.04.08.15.050, 9.04.08.16.050, 9.04.08.18.050, 9.04.08.20.050. 9.04.0$.22.050, 9,04.0$.24.050, 9.04.0$.26.050, 9.04.08.28.050. 9.04.08.30.050, 9.44.08.35.040. Firearms dealerships are incompatible with commercial areas in which alcohol outlets such as bars and restaurants are located as alcohol can impair human judgment and lead to violent confrontations and disputes involving firearms, regardless of whether the firearms user is properly licensed to awn the weapon. Proposed Amendment to Chapter 3.24 of the Santa Monica Municipal Code Staff recommends that the Firearms Dealership Permit requirements contained in Interim Ordinance #1$31 be made permanent by amending Chapter 3.24 of the Municipal Code. In the interim ordinance, Firearms Dealership Permits which are issued by the Chief of Police, require firearms dealers to install security measures 8 including secure locks, windows, doors, adequate lighting and fire and theft alarms in their buildings in addition to secured and locked facilities for the on-site storage of firearms and munitions. These measures are particularly important since inadequately secured firearms can be stolen and used in serious criminal activities where, because of the range and effectiveness of firearms, a discharge of the weapon can lead to the death or serious injury of bystanders, especially in or near residential areas. The permit also requires all dealerships to keep complete and current inventories of all firearms in stock including an entry far each weapon, its classification, serial numbers and any other information required by the Chief of Police for the tracking of the chain of ownership of each firearm. Additionally, an insurance policy with a minimum liability limit of One Million Dollars ($1,000,000) for damage to or destruction of property in any one incident and with a minimum liability limit of One Million Dollars ($1,000,000) for death or injury to any one person is required to be in full force and effect. The four existing dealerships are in compliance with the provisions of the interim ordinance. The proposed ordinance contains some minor modifications to the requirements contained in the interim ordinance with respect to the firearms dealership permit: 1). the interim ordinance regulated the sale of firearms "or munitions". To more clearly parallel state law, the proposed 9 ordinance would apply to a person or business selling firearms, but not to one selling only munitions. Neither the Business License Division nor the Police Department is aware of any businesses in the City which sell only munitions. 2) . The interim ordinance did not contain a definition of the term "firearm." The proposed ordinance defines "firearms" by reference to an appropriate definition contained in the Penal Code. 3). The interim ordinance required certain findings to be made before a conditional use permit could be issued for a firearms dealership. These findings were similar to, but not identical to, those contained in the Zoning Ordinance for CUPs. The proposed ordinance requires that the standard zoning ordinance findings for the issuance of CUPS be made. 4}. The interim ordinance contained a list of conditions to which a firearms dealer permit was subject. The proposed ordinance makes a number of nonsubstantive changes to these conditions. The conditions have been reorganized and the interim ordinance requirement for insurance has been incorporated as a permit condition. The security measures to be imposed are specified as all measures "reasonably" required by the Chief of Police, and have also been incorporated into the permit conditions. Far clzrity, the proposed ordinance imposes other conditions by reference to state law, rather than delineation in the ordinance, and specifies that 10 to the extent the City's requirements are stricter than those contained in state law, the City's requirements will prevail. 5). The proposed ordinance makes other nonsubstantive organizational changes to the permit procedures and requirements. Prohibiting Gun Shows Within The City Section 5 of the proposed ordinance has been included to add Section 3.24.080 to the Santa Monica Municipal Code to clarify that gun shows or events shall be prohibited in the City except for gun shows or events in the M1 zoning district. A gun show or event is any event at which firearms are sold, transferred, leased or offered or advertised for sale, transfer or lease. Any gun show or event in the M1 zoning district will be required to obtain all other approvals or permits required by local, state or federal law. "Saturday Night Special" Handguns In a separate action regarding the sale of firearms, the City Council directed the City Attorney to prepare an ordinance banning the sale of "Saturday Night Special" handguns in the City. An ordinance will be presented to the City Council in July. The Council also requested that the City Attorney contact other cities for insight on such ordinances. The City of West Hollywood is currently in litigation regarding its ordinance banning such weapons. The City Attorney will report on the status of the West Hollywood litigation at the July Council meeting, and the 11 implications such litigation may have regarding the contents of the proposed Santa Monica Ordinance. PLANNING COMMISSION RECOMMENDATION On November 15, 1995, the Planning Commission conducted a public hearing on the proposed Zoning Text Amendment. No members of the public addressed the Commission at the public hearing. Following the public hearing, the Commissioners voted unanimously to recommend appraval of the standards contained in this report. On March 20, 1996, the Planning Commission adopted a Resolution of Intention and on April 17, 1996 conducted a public hearing and recommended appraval of the proposed amendment to the Purpose Section of the M1 Zoning District to accommodate those general retail uses which do not serve community and neighborhood needs and are not compatible with other commercial land uses that are allowed in commercial zoning districts elsewhere in the City. Firearms dealerships would be included in this category. CEQA STATUS The amendments to the Zoning Ordinance and Chapter 3.24 of the Municipal Cade contained in the proposed ordinance, although proposing discretionary activities, have no possibility of causing a significant effect on the environment. Therefore, in accordance with Article 5, Section 15061, Subsection (b)(3) of the State of California CEQA Statutes and Guidelines, the proposed ordinance is 12 exempt from the provisions of CEQA. GENERAL PLAN CONFORMANCE The proposed amendments are consistent with policies contained in the Land Use Element of the General Plan. In particular, Land Use Element Objective #1.2 calls for the City's land use policies to "ensure compatibility of adjacent land uses, with particular concern for protecting residential neighborhoods." Further, the proposed amendments to the Zoning Ordinance are compatible with Land Use Objective #1.6 which addresses the need of the City's commercial corridors to "accommodate commercial uses which serve regional, community and local needs while respecting the adjacent residential neighborhoods. Adjust allowable use and intensity to existing context and any other special constraints." The proposed amendments to the Zoning Ordinance would remove home-based firearms dealerships from residential neighborhoods by prohibiting the issuance of home occupation permits for this use and would preserve and protect residential neighborhoods adjacent to commercial areas by limiting firearms dealership locations to the M]. Zoning District with approval of a CUP. The visibility of firearms dealerships to the general public in heavily travelled commercial areas and in areas near residences is a reminder of the prevalence of firearms- related violence in our society and, as such, is undesirable and detrimental to the peace of mind and quality of life of Santa Monica residents. The Ml district is a non-pedestrian oriented area of the City with few residences, schools, churches and other public 13 gathering places. It is physically separated from adjacent residential areas to the south by the I-10 Santa Monica Freeway and geographically separated from the major commercial corridors of the City to the north. The proposed amendments to Chapter 3.24 of the Santa Monica Municipal Code would, through the police permit process, further regulate the operation of firearms dealerships by requiring them to comply with vigorous security measures which will work to protect the community at large. BUDGET/FINANCIAL IMPACTS The proposed amendments to the Zoning Ordinance will not have any budgetary or financial impacts. The proposed amendments to Chapter 3.24 of the Municipal Cade will net have any budgetary or financial impacts in that a $44 fee was established by Resolution #8866 of the City Council for a Firearms Dealer Permit. RECOMMENDATION Staff is recommending that the City Council introduce for first reading the proposed ordinance attached hereto as Attachment A to regulate firearms dealerships within the City of Santa Monica. FINDINGS 1}. The proposed amendments to the Zoning Ordinance are consistent in principle with the goals, objectives and policies, land uses and programs of the City's General Plan, specifically with Land Use Element Objective #1.2 which requires that the City "ensure 14 compatibility of adjacent land uses, with particular concern for protecting residential neighborhoods" and Objective #1.6 which requires that the City "accommodate commercial uses which serve regional, community and local needs while respecting the adjacent residential neighborhoods" and to "adjust allowable use and intensity to existing context and any other special constraints" in that the proposed amendments will prohibit home-based firearms dealerships in residential neighborhoods and preserve and protect residential neighborhoods adjacent to commercial areas by limiting new firearms dealerships to the M1 Zoning District with approval of a CUP. 2.) The public health, safety and general welfare require the adoption of the proposed amendments to the Zoning Ordinance in that the amendments set appropriate standards for the location of firearms dealerships by allowing these uses to operate in the City and be located in the M1 Zoning District with approval of a Conditional Use Permit which will serve to protect the quality of life of residential neighborhoods since the M1 Zoning District is a non-pedestrian oriented area of the City with few residences, schools, churches and other public gathering places and is physically separated from adjacent residential areas to the south by the I-10 Santa Monica Freeway. 3). The public health, safety and general welfare require the adoption of the proposed amendment tv Chapter 3.24 of the Santa 15 Monica Municipal Code, in that the standards for a Firearms Dealership Permit will require the operator of the dealership to operate the facility in a secure manner with appropriate inventory controls and amounts of liability insurance which will protect the health and welfare of the city residents and maintain quality of life standards. Findings and Purpose. The City Council finds and declares: (a} California Penal Code Section 12Q71 provides that municipalities may exercise discretion to grant or deny applications for permits to sell firearms, and recognizes the applicability of local laws and regulations affecting gun dealers. Neither the State of California nor the federal government has sufficiently addressed the problems resulting from the increased availability and use of firearms in urban areas such as the City of Santa Manisa. (b) The purpose of this Ordinance is to provide far the appropriate location of firearms sales activity and to regulate such activity through the police permit process. 1 (c) The number of deaths and injuries attributable to firearms is unacceptable and warrants stricter control over the availability of firearms within the City. The 1995 homicide rate for the City of Santa Monica was higher than the rate for 1994 and firearms were used in fifty percent of the homicides in the City of Santa Monica during both 1994 and 1995. In addition, firearms were used in b6~ of the robberies which occurred in the City in 1995, and in at least 27 aggravated assaults in the City in 1995. (d) Inadequately secured firearms can be stolen and used in serious criminal activities. Residential buildings are usually not as secure as buildings located on commercial or industrial sites. (e) Because of the range and effectiveness of firearms, the use of firearms in violent crimes is mare likely to lead to the death or injury of bystanders. The accidental discharge of a firearm can lead to serious injury or death, especially when it occurs in a residential area. (f) one objective of the Land Use Flement of the General Plan is to ensure compatibility of adjacent land uses, with particular concern for protecting residential neighborhoods, by limiting the number, controlling the location, and otherwise mitigating the impact of commercial uses which might have an adverse impact on surrounding neighborhoods. {g} Firearms dealerships are incompatible in or adjacent to residential areas and in heavily travelled commercial areas. Firearms dealerships are incompatible with the character of 2 residential. neighborhoods in which commercial uses, except those that serve the day to day needs of residents, are generally prohibited. (h) Further, firearms dealerships are incompatible with commercial areas in which alcohol outlets such as bars and restaurants are located. Alcohol can impair human judgement and lead to violent confrontations and disputes involving firearms, regardless of whether the firearms user is properly licensed to own the weapon. (i) The visibility of firearms dealerships to the general public in heavily traveled commercial areas and in areas near residences is undesirable and creates a type of visual blight. The appearance of easy availability of gun purchases is a reminder of the prevalence of firearms_related violence in our society and, as such, is detrimental to the peace of mind and quality of life of Santa Monica residents. (j) The Police Department of the City of Santa Monica has indicated that permitting the location of future firearms dealerships in a more concentrated geographic district of the City will allow for better monitoring of firearms dealership operations. (k) The M1 Industrial Conservation Zoning District within the City of Santa Monica provides a location for land uses which are the Least compatible with residential and other commercial land uses. The M1 has fewer residences, businesses, schools and churches than other zoning districts in the City. 3 (1) The M-1 Industrial Conservation Zoning District is characterised by the predominance of industrial land uses, and has less pedestrian and vehicular traffic. (m) Allowing gun dealerships in the M1 and not in other commercial districts within the City will concentrate the geographic locations at which guns may be purchased, thereby providing for easier police oversight as well as reducing the appearance of easy availability of gun purchases within the City. (n) Interim Ordinances Nos. 1745, 1763, and 1831 allowed gun dealerships to locate in the general commercial districts but prohibited such uses in residential districts or within 1500 feet of any other similar use, any day care facility, or any elementary, middle, junior or high school. However, because of the dense nature of the City, and the number of day care facilities, this restriction resulted in there being only three locations in the City at which such use would be permitted. All three of the locations are in areas which are heavily traveled by pedestrians, including families, and are thus inappropriate locations for a gun dealership. Additionally, the location of day care facilities change. For that reason, allowing gun dealerships in the Ml, and not general commercial districts, brings more certainty to both the City and prospective gun dealerships regarding where such uses may be located, and, in general, provides for greater compatibility of uses. 4 (o) For the reasons stated above, the sale of guns at gun shows or events is also incompatible with residential and commercial areas, and should be allowable only in the Ml. (c} A written determination of revocation of a Home Occupation Permit shall be mailed to the property owner and the permit holder within 10 days of such determination. SECTION 23. Effect of this Ordinance on Existing Dealers. Firearms Dealers existing on the effective date of this Ordinance who obtained a Firearms Dealer Permit pursuant to Ordinance No. 1763(CCS} or Ordinance No. 1831(CCS} on or before January 1, 1995, shall not be required to obtain a conditional use permit, but shall comply with all other provisions of this Ordinance. If such existing dealers are located other than in the M1 Industrial Conservation District, such uses shall be considered legal nonconforming uses. Any Firearms Dealership existing as of the 27 effective date of this Ordinance who did not obtain a Firearms dealer permit by January 1, 1995, is in violation of law. SECTION 24. Any provision of the Santa Monica Municipal Code or appendices thereto, including Ordinance Number 1831 (CC5}, inconsistent E~rith the provisions of this Drdinance, to the extent of such inconsistencies and no further, is hereby repeated or modified to that extent necessary to effect the provisions of this Ordinance. SECTION 25. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it ;ould have passed this Ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance a:auld be subsequently declared invalid or unconstitutional. 28 SECTION 26. The Nlayor shall sign and the City Clerk shall attest to the passage of this Drdinance, The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effective 30 days from its adoption.
