:aACKGROUND
The Clty Plannlng Comm1ssion approved the 'I'entatl ve ~ap and the Ten-
ant-Partic1pating ConverS1on for the above proJect on September I,
1993, after a publ1C hearing and a careful reVlew of the record and
staff recommendatlons. The act10n of the Plann1ng Commlssion was
based on the CO'llmlss:.on's flnd:i.ngs that the proposed Tenant-
Partlc~patlng COilverS1on meets the requ:.rements of Artlcle XX of the
C1ty Charter and that the proposed subdivlsion lS consistent wltn
applicable general and speclflc plans as adopted by the Clty of
Santa Monlca along w1th all T'1andatory requ1rements of the
subdivlslon Map Act of the State of Callfornla.

The owners have submltted to the Clty a Writ~en Co~sent Agree~ent
blndlng the owners and any successors In lnteyest to each condition
imposed ln connection with approval of thlS Tenant-Partlclpating
Conversion. ThlS Wrltten Consent has been approved by the City
Attorney and the Clty Manager. Each partlclpatlng tenant has been
::..nformed In writing of hls or her rlghts under Artlcle XX of t:C.e
Ci ty C~arter. Tr.e Llcer:se D1VlSlon reports that proper arrangerrents
have been made to ensure payment of the Tena~t-Partlclpatlng
Converslon 'I'ax.
The F:..nal Map conforms to the Tentative Map The F lnal Map has been
certified by the City Englneer for conformance wlth the Tentatlve
Map a:ld condltlons thereon, the Subdivlslon Map Act and local
ordinances. The Clty Attorney's offlce has approved a Declaration
of Covenants, Conditions, and Restrictlons, or equivalent document,
for thlS project as complying wlch the conditlons of the Tentative
Map a:1d the Tenant-Particlpatlng Conversion
Counell approval of a flnal nap for a TenaLt-~articlpatlng
Conversion represents one of the last steps necessary In the
conVerSlon process. Followlng Clty Councll action ar:d approval by
the Californla Department of Real Estate the appllcants may begln
sel::"lng thelY units to the tenants As each unit is sold a
converSlon tax per Section 2008 of Art:..cle XX is due lD an am01..1nt
equal to twelve tlmes the ~orrthly maXl~um allowable rent for that
unit. These taxes wlll be ~sed to asslst low and moderate lnCOTLe

households to purchase or 1mprove the1r units subJect ~o affordable
repayment per Sectio~ 2009 of A:r-t.1cle XX,

sold 1n the future, Tenant-Part1c1pating Convers1on Taxes wlll be
collected pursuant ':0 the provlsions of Artlcle XX of the C1ty
Charter and some 1ncreased property tax revenues Tay be generated
