SUBJECT; Annual Report on Compliance with California Revenue and
Taxation Code section 17274 Regarding Rental Housing Code
Enforcement for calendar Year 1995
INTRODUCTION
Thl.s report presents the rental housing code enforcement activities
of the Building and Safety Division for 1995 and recommends that
the C1ty Councl1 rece1ve and file this report.
DISCUSSION
Sectl.on 17274 of the Call.fornia Revenue and Tax Code requires that
regulatory agencies report to the Franchise Tax Board the names and
addresses of the owners of substandard rental housing in the city
,,,ho fail to make necessary repairs to bring the property into
compliance T";]. th health, safety and building codes within a
spec~fied period of time. The Franchise Tax Board is required to
deny income tax deductions to owners of these properties until the
regulatory agency determines that the substandard housing has been
brought into compliance. The Code also requl.res that a report be
flIed by each regulatory agency with its local legislative body by
July 1 of each year, advising of the status of enforcement
actlvitles l.nitiated under this program during the prior calendar
year.

The Building and Safety Division staff reviewed the city's records
of rental housing code complalnts and enforcement activities during
calendar year 1995. The required information is presented in Table
1. A total of 202 substandard housing type complaints were filed
with the city in 1995. Of the 202 complaints, eighty were written
notlces of violation for substandard dwellings, the remaining 122
complaints were investigated but not found in violation. Thirteen
of the eighty violations are unresolved and being processed by the
Clty Attorney's office or the Building and Safety Division.
BUDGET/FINANCIAL IMPACT
There are no budget or flnancial impacts related to the filing of
thlS report.
RECOMMENDATION
It is recommended that the city council receive and file this 1995
report required by Revenue and Taxation Code Section 17274.
