Natlonal recognition of the damage caused by polluted urban runoff throughout the country led to a~endments to the Clean Water Act in 1987 to lnclude nonpolnt source pollutlon Under these amendments Nat~onal Pollutlon Dlscharge Ell~inatlon Systew (NPDES) permlts for dlscharges or stormwater to the mun~ c~pal separate storm sewer system (storm dral~ systeM) req'.J.J.rlng controls to reduce the dlscharge of pollutants to the maximum extent practlcable were mandated Because of the complexity and networklng of the stor~ dra~n system and dralnage facilltles wlthln and trlbutary to the Cou~ty of Los Angeles, the Reglor:al Board adopted a county wlde approach to permlttlng stormwater a~d urban runoff discharges. Consistency with the City's Urban Runoff Pollution Ordinance In 1992, CauDell adopted the Urban Runoff Pollut.ion Ordlnance wh~ch co~ta~ns prov~s~ons for runoff m~tigatlon durlng and after construct:.on, runoff pollution preventioro and control, as well as citywlde runoff educatlon programs The proposed perTlt specifles req'L:irements ln these areas WhlCh will serve to create a unlfled and conslstent stormwater manage~ent program =~rcughout the watershed. 2 . Implementation of the Santa Monica Bay Restoration Plan The Santa MODlca Bay xestoratlon Projec-: developed a Bay Restoratlon plan to serve as a blueprlnt for recovery of the 3ay. The adoptlon of a s-:rong, envlronwentally-sound NPDES pernlt was recomnended =--n the Plan, WhlCh was endorsed by che Council In 1994, as the regulatory ~ec~anism for enforcement of urban runoff pollution preventlon. 3 . Cost Effective Water Quality Protection The proposed XP8ES perm~t presents a cO[l')prehens~ve and lntegrated watershed managemer--= strategy towards water resource protect=--on, enhancement and restoratlon, whlle balanclng economlC and env=--ron~ental iT-pacts. 5 -- BUDGET/FISCAL IM?ACT All f'.lnding requlrements for Santa ~onlca's stormwater ~anage~ent prograrr. have been ref~ected ln the Proposed Stormwater Budget for FY 1996-97. These program costs are recovered Vla parcel fees collected by the Stormwater 3nterprlse Fund. RECOMMENDATIONS It is recommended that the Clty CauDell approve the attache<i resolutlon endorslng the adoptlon of the N?~3S Permlt for MUTIlclpal Stormwater and Urban Runof= ~lscharges wlthln the County of Los Angeles. J RESOLUTION NO. 9047 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA TO SuPPORT THE ADOPTION OF THE TENTATIVE WASTE DISCHARGE REQUIREME~'"TS FOR MUNICIPAL STORMWATER AND URBAN RUNOFF DISCH1~GES WITHIN THE COUNTY OF LOS ANGELES (NPDES NO. CAS614001) . WHEREAS, Santa Monica Bay is an econom1C resource for the region, contr1but1ng to the ambiance which draws over 25 million tourists to Los Angeles County annually, and, lS a recrea~lonal, environmental ard educational resource for the mil110ns of people who visit the beaches annually; and, WHEREAS, contaminated stormwater runoff has been determined to be the largest source of pollut~on to the Santa Monica BaYi and, WHERE]l~S r the large lmpervious surfaces of urban areas increase the qua~tity and peak flows of runoff which in turn causes hydrologic impacts such as loss of hab1tat, scoured stream bed channels, in-stream sedimentation and mass loadlngs of pollutants; and, WHEREJI._S , an epidemiolog1cal study conducted durlng the summer of 1995 for the Santa Mon1ca Bay Restoration ProJect demonstrated tha.t there 1S an :i.ncreased r1sk of acute 1llness caused by sW1mming near flow1ng storm drain outlets in Santa Monica Bay; and, WHEREAS, the 1987 amendments to the Clean Water Act (CWA) established statutory requ~rements to control industrial and municipal stormw~ter d~scharges to waters of the Un~ted States [CWA ~ ~ Section 402 (p) ] by requiring Natlonal Pollution Dlscharge Elimination Systems (NPDES) permits for stormwater discharges to the municipal separate storm draln system and requires controls to reduce the di.3charge of pollutants to the maximum extent pract~cable; and, WHEREhS , the Los Angeles Reglonal Water Quality Control Board staff, ~Il consultat~on wlth a committee of stakeholders comprlsed of ref?resentatives of the Permlttees and environmen~al groups, as well as discussions wlth business communltles, state offlcials and the public, has issued a proposed NPDES permlt outlining waste d~scharge requ~rements for mun~c~pal stormwater and urban runoff discharges withln the County of Los Angeles; and, WHERE]\'.S , the Santa Monica Bay Restoration Plan adopted by Council in 1994. which serves as a blueprlnt for the Santa Monica Bay's recovery, recommends actlons that the Reg~onal Board has integrated into the stormwater permit and provides guidance to the Regional Board for the development of a strong, environmentally- sound stormwate:::- program; and, WHEREAS, the Regional Board has implemented a Watershed Management Approach to address water quality protect~on in the region which provides a comprehensive and integrated strategy towards water :resource protection, enhancement, and restoration while balanclnq economlC and envlronmental lMpacts wlthln a hydrologically deflned drainage basin or watershed, NOW THEREFORE, THE CITY COUNCIL OF THE CITY 0::<' SANTA MONICA DOES RESOLVE AS FOLLOWS. SECTI')N 1. To support the adoption of the Waste -- <- Discharge Requirements for the Munlcipal Storm Water and Urban Runoff Discharges Within the County of Los Angeles {NPDES NO. CAS614001} by the Los Angeles Regional Water Quality Control Boardi and, SECTION 2. To participate on the watershed Management Committee in the development of the Watershed Management Area Plani and, SECTION 3. To support lmplementatlon of plans, programs and procedures as developed by Los Angeles County, the Prlnclpal Permittee; and, SECTION 4. To urge the other 84 lDcorporated clties and the County of Los Angeles to support the adoption and implementation cf the permlt. SECTION 5. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
