INTRODUCTION
ThIs report recommends that the City Council approve a resolution authonzmg the City Manager to
apply for grant funds from the Los Angeles County Park, Beaches and RecreatIOn Act of 1992 for
Improvements to Joslyn Park
BACKGROUND
In November 1992 Los Angeles County voters approved ProposHlOn A the Los Angeles County
Park, Beaches and RecreatIOn Act of 1992 ThiS Act prOVides for approximately $800 nulhon III
bonds to preserve, Improve and restore parks, beach, open space lands and recreatIOnal facIlitIes
throughout Los Angeles County
The City of Santa MOnIca IS el1gtble for S697,430 In per parcel discretIOnary grant funds On August
23, 1993, Clly Council authonzed the CIty i....1anager to apply for $546,180 for the Lmcoln Park
renovatIOn project The grant was approved and the funds were used Staff recommbthC

be used to reconstruct the basketball court and repaIr the extenor wrought Iron fence Staff selected

In FY 1994/95 $128,000 m PropOSItIOn A funds was appropnated m account #20-740-511-20095-
8905-99479 for thIS project Upon approval of the grant, It WIll be necessary that the $23,250 In
PropOSItIOn A funds remammg from the completed Lmcoln Park project be appropnated to the Joslyn
Park project to reflect the total of the $151,250 of remamIng grant funds Also In FY 1994/95
$100,000 was appropnated In account #01- 740-511-20095-8900-99516 for the replacement of the
playground eqUIpment at Joslyn Park Any addltlonal funds needed to complete the planned
Improvements WIll be Included In the proposed FY 1996/97 CapItal Improvement Program budget

RECOMMENDATION
Staff respectfully recommends that the City Council
1 Adopt the attached resolutIon which authorizes the City Manager to file an apphcatJon and
execute all necessary grant documents, and
2 Appropnate $23,250 to account #20-740-511-20095-8905-99479 contmgent upon approval
of the grant

Applicant possesses legal authority to apply for the grant, and to finance, acquire, and construct the proposed
ProJect, that a resolutIOn, motion or simIlar action has been duly adopted or passed as an official act of the
Apphcant's govermng body authonzing the filmg of the applIcatIOn, IncludIng all understandmgs and assurances
contained therem, and dIrectmg and authonzing the person identified as the offiCial representatIve of the Applicant
to act In connectIon WIth the applIcatton and to proVIde such addlttonal mformation as may be required.
Applicant will maintam and operate the property acquired, developed, rehabilitated, or restored with the funds ill
perpetuIty. \Vith the approval of the DIStrict, ApplIcant, or its successors III interest in the property, may transfer
the responsibIlity to mamtaIn and operate the property ill accordance WIth the PrOpOSItion.
Applicant will use the property only for tbe purposes of the Proposition and WIll make no other use, sale, or other
dtsposition of the property except as authonzed by specific act of the Board of SupervISOrs as govemmg body of

Applicant WIll cause work on the Project to be commenced WIt1un a reasonable tIme after receIpt of notIficatIOn
from the DIstrict that funds have been approved and will prosecute the Project to completIOn v,'ith reasonable
dIhgence.
Funds allocated to ApplIcant that are used for landscapmg, plantmg trees or any other plantmg projects shall use
dnp ImgatIOn systems and shall use drought-resIstant or xerophytIC trees, plants, lawn or- sod, except when
applIcant can show, to the DIStnct's satIsfactIon, that such use IS mfeaslble. When projects involve the
rehabilItatIon of eXIstmg lITIgatIon systems or the creatIon of new irrigation systems, reclaimed water should be
used whenever possible and pnority shall be given to development of reclaimed water rrngation systems.
In order to mamtam the exclUSlOfi from gross income for federal income tax purposes of the interest on any bonds,
notes or other eVIdences of mdebtedness iSSUed for purposes of this grant program, Applicant covenants to comply
WIth each applIcable reqUIrements of Section 103 and SectIons 141 through 150 of the Internal Revenue Code of
1986, as amended.
All grant funds allocated for projects mvolvmg the rehabIlitatIon or restoratIOn of beach, park, recreatIon, open
space or natural lands shall be used. to the maXImum extent practIcal, to employ youth from the commuruty m
which the particular rehabIhtatIOn or restoratIon Project IS bemg carned out
To the maximum extent feasIble, Applicant IS encouraged to enter mta, and has authonty to use funds receIved
through this grant for, agreements WIth community conservatIOn corps, the CalIforrua ConservatIOn Corps and
other commUnIty orgarnzatIons, particularly when youth can be employed to work on restoratIOn or rehabilItatIOn
projects being earned out m their own comrnumtles Such agreements shall be entered mto solely for the
accomplIshment of the purposes set forth in this applIcatIOn
Applicant WIll prOVIde reasonable publIc access to lands acqUIred in fee WIth funds made avaIlable through this
grant, except where that access may mterfere with resource protection Reasonable pubhc access mcludes parkmg
and publIc restrooms
No wetlands or npanan habitat acquired pursuant to the PrOpOSItiOn shall be used as a dredge spoil area or shall be
subject to revetmeu. that damages the quahty of the habd:.at for WhlCh the property was acqUIred.
Applicant will comply, where applIcable, \\'lth proVISIOns of the Cahfonua EnVironmental QualIty Act and the
CalIfornia RelocatIOn ASSistance Act, and all other federal. state and local laws, rules and regulatIOns

SANTA MONICA APPROVING THE APPLICATION FOR GRANT
FUNDS FROM THE COUNTY OF LOS ANGELES REGIONAL PARK
AND OPEN SPACE DISTRICT PER PARCEL DISCRETIONARY

WHEREAS, the people of the County of Los Angeles on November 3, 1992, enacted Los
Angeles County PropositIOn A. Safe Neighborhood Parks, Gang Prevention, Tree-Plantmg, Semor
and Youth Recreation, Beaches and Wddhfe Protection (the Proposltlon), whIch proVides funds to
the County of Los Angeles and other pubhc agencies In the County for the purposes of acqumng
and/or developmg faclhties for public recreational faclhtles and open space, and
WHEREAS, the PropositIon also created the County of Los Angeles Regional Park and Open
Space Distnct (the Distnct) to admmlster said funds, and
WHEREAS, the District has set forth the necessary procedures governmg local agency
applications for grant funds under the PropoSItIon, and
WHEREAS, the DIstrict's procedures reqUire the City as applicant to certifY, by resolutlOn,
the approval of the apphcation before submiSSIon of said appl1catlOn to the District, and
WHEREAS, the Joslyn Park Improvements (the Project) is an Important park and recreation
project for the City of Santa MOntca, and
WHEREAS, Said apphcatlon contams assurances Wlth which the CIty must comply, and
WHEREAS, the City wtll enter mto an Agreement With the Dlstnct for development of the
Project,

NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS
SECTION 1 The filIng of an applIcation with the County of Los Angeles ReglOnal Park
and Open Space DlStnct for funds under SectlOn 8 b 1 of PropOSItIOn A for the Project is hereby
approved
SECTION 2 Certifies that sald Apphcant understands the assurances and ceruficatiOn In the
apphcation fonn
SECTION 3 The CIty has, or will have. suffiClent funds to operate and maIntaIn the Project
In perpetUIty
SECTION 4 The CIty Manager, is hereby appoInted as agent of the City of Santa MOnica
to conduct all negotIatiOns, and to execute and submIt all documents mcludmg, but not limIted to,
