Council Meeting February 25, 1997 Santa MOnica, California TO Mayor and City Council FEB 2 5 1997 FROM City Staff SUBJECT Award of Contract for the 1996-97 Street Resurfacing Project to Damon Construction Company and Recommendation to Authorize the City Manager to Negotiate and Execute a Professional ServIces Contract with eM I Englneenng Consultants for Construction Management of the Street Work INTRODUCTION ThIs report recommends that the City Council award a contract to construct street Improvements at various locations Within the City to Damon Construction Company, the lowest bidder. In the amount of $ 2,899,851 Furthermore, staff recommends that the City Council authOrize the City Manager to negotiate and execute a profeSSional services contract With C M I Engmeenng Consultants, a construction management firm, for construction management of the street work undertaken The negotiated fees for thIs contract shall not exceed $ 200,000 Background Each fiscal year. the City Council authOrizes the Implementation of street Improvements Identified by the Department of Environmental and Public Works Management for the year Including street resurfacing, slurry sealing, and repairs to curbs, gutters, curb ramps, bus pads. and Sidewalks The prlonty projects for the year are selected from among those streets that rank high In the hierarchy of warranted street repairs outlined In the "Pavement Management System" Report This report, reqUired since 1989 to qualify for federal Qr" . ~ !B 2 5J997 fundrng, IS updated annually, and ranks the condItion of all streets, sIdewalks, curbs, and gutters In the City DUring the annual on-site inspection of these priority locations, staff further evaluates streets for type and schedule of repair by age, surface and subsurface conditions, complamts received, type of use (I e , commercial, Industnal or reSidential), current traffic volume. and projected change of use or volume Financial considerations are also factored Into the scheduling of the street resurfacing projects ComprehensIve resurfacing projects reqUIring additIonal work on gutters and sidewalks are more costly, limiting the number of locations that can be addressed In one year Every effort IS made to repair and recycle eXisting pavement rather than unnecessarily Incur the expense of total pavement replacement Badly damaged streets are resurfaced by heatrng and scorrng the top 1rnch, addrng all to rejuvenate the pavement and then adding 1 Inch of new rubber-asphalt For streets with more limited traffic and/or where the pavement IS not as badly damaged, an asphalt slurry coating of approximately 1/8" thickness IS applied over the old pavement. This seals the cracks and prevents stormwater intrusIon. and smooths surface Irregulantles Sidewalks, curb ramps, bus pads, curbs, gutters. driveways and parkway pavements In need of repair are also replaced at the time of resurfacing or slurry sealing 2 --- Historically. a portion of the street resurfacing was funded through the formation of an assessment district which IS permitted by the Improvement Act of 1911 PrOposition 218, recently adopted by California Voters, slgmficantly changes the procedures associated With the establishment of assessment districts Specifically, ProposItion 218 reqUires extensive noticing and a majority vote by affected property owners actually voting on the proposed assessment dlstnct (each vote weighted In proportion to the amount of the assessment to be paid) Staff IS currently investigating the new procedure and wIll attempt to establish an assessment dlstnct usmg the new requirements In order to expedite this project, the entire scope of work WIll be awarded now However, the contractor will be authOrized to proceed With only the non-assessment portion of the work Staff will not authOrize the contractor to proceed With work contained In the potential assessment dlstnct area until the assessment dlstnct process has been completed In accordance WIth the prOVIsIons of PropositIon 218 If the affected property owners In the proposed assessment district approve the formation of the dlstnct, the contractor will be authonzed to proceed With the assessment work and owners will be assessed the associated costs If the affected property owners In the proposed assessment dlstnct oppose the formation of the district, staff will evaluate whether the affected work should proceed or be deferred until full funding IS Identified ThiS contract will Include street resurfacing and reconstructIon of four downtown alleys, construction of ADA curb ramps at vanous locations, resurfacing of the water diVISion 3 parking lot at the Santa Monica City Yard, and the construction of concrete bus pads at vanous locations on transit routes Bid Package The Notice Inviting Bids was published In The Outlook on January 3 and 4, 1997 A Notice Invltlng Bids, along with the plans and specifications were also submitted to four (4) constructIon Journals, and were sent to SIX (6) women/mlnonty business enterprise (\NMBE) associations Bidding packages were requested by eIght contractors The CIty Clerk's Office received seven sealed bids, whIch were publicly opened and read aloud on January 21, 1997, by the Deputy City Clerk The base bid results were as follows 1 Damon Construction Company $ 2,899,851 2 Excel Paving Company $ 2,976,784 3 Sequel Contractors, Inc $ 2,978,788 4 Sully Miller Contracting Company $ 3,037,823 5 Los Angeles Englneenng, Inc $ 3,038,204 6 Sylvia ConstructIon, lnc $ 3,045,311 7 Hillcrest Contracting $ 3,177,871 The City Engineer's Estimate was $2,850,000 to $3,350,000 The lowest bidder, Damon Construction Company, supplied the City With three references and all references reported that the Contractor's work was satisfactory The State 4 Contractors License Board venfled that the Contractor's license IS current, active, and In good standmg The professional services constructIon management contract Includes inspection and management of the construction work detailed above Requests for Proposals were sent to SIX (6) firms The City received three (3) replies which were scored by a staff committee of three (3) engineers Three (3) firms were interviewed by the same committee resulting In the selection of C M I Engineering Consultants They supplied the City With three (3) references and all references reported that the consultant's work was excellent BUDGET/FINANCIAL IMPACT CONSTRUCTION FUNDS REQUIRED, BASE BID Contract $ 2,899,851 Contmgency , $ 490,365 TOTAL FUNDS REQUIRED $ 3,390,216 5 CONSTRUCTION ACCOUNTS I ACCOUNT NUMBER CONTRACT CONTINGENCY TOTAL AMOUNT I .01-770-402-2009]-8905-99152 (Street Res) S 1.884,916 $ 400,000 $ 2,284,916 , 20-770-402-20097 -8905-99152 (Street Res) $ 500,000 $ -
