SUBJECT: Recommendation to Adopt a Resolution to Set a March 26,
1991 Public Hearing to Hear Protests Regarding the
Weed Abatement Program
Introduction
This report requests that the city council adopt a Resolution of
Intention declaring weeds and rubbish on vacant lots, improved
lots, parkways, sidewalks, and dirt upon sidewalks to be a public
nuisance and to set a March 26, 1991, public hearing to hear
protests, if any.
Backqround
The annual weed and rubbish abatement program in Santa Monica has
been in operation for many years in accordance with the
provisions of Chapter 13, Section 39500 to 39588, Title 4 of the
California Government Code. Approximately 313 lots will be
posted for weed and rubbish abatement. Of these lots, 301 are
privately owned and 12 are city owned. These lots were selected
for inclusion in the weed abatement contract based on the street
Inspector's citywide inspection of lots. The estimated cost for
this work is $77,525 which includes a contract amount of $70,000
and an administrative charge of $7,525 ($25 x 301 lots) for
administrative costs including inspection, supplies, and clerical

The city is reimbursed for both contract and administrative costs
incurred on private property for this program through property
assessments.
When the weed abatement work is done by a contractor hired by the
City, the costs are assessed against the property and collected
through the property tax bills by the County Assessor on the
City's behalf. If the property owner chooses to do the work,
there is no assessment against the property. While the state
Government Code requires only that the property owner be notified
of the necessary work by posting the lot, the city has instituted
procedures to notify property owners by mail that it is necessary
to clear the lots of weeds and rubbish. This notification
ensures that non-resident property owners receive notification
and are allowed sufficient time to clear their own lots.
Budqet/Financial Impact
Appropriation authority for the issuance of the weed abatement
contract to a maximum of $39,094.79 is in Maintenance Management
Account No. 01-500-481-00000-6642-00000. Appropriation for
additional funds will be requested at the time the contract for
weed abatement work is awarded. Revenues will be received in FY
1991-92 through assessments which will be on the December
1991jApril 1992 tax bills.
Recommendation
It is recommended that the City Council:
l. Adopt the attached Resolution of Intention which declares

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA DECLARING CERTAIN WEEDS
GROWING UPON CERTAIN LANDS WITHIN THE CITY
OF SANTA MONICA TO BE A PUBLIC NUISANCE
WHEREAS, there are weeds growing upon the streets,
sidewalks, and certain lots in the City of Santa Monica, which
bear seeds of a wingy or downy nature or attain such a large
growth as to become a fire menace when dry, or are otherwise
noxious and dangerous to the public health and welfare; and
WHEREAS, there are accumulations of rubbish, refuse,
and dirt upon certain streets, sidewalks, and lots in the City of
Santa Monica which are hazardous or dangerous to the public
health and welfare,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA RESOLVES AS FOLLOWS:
SECTION l. That all weeds growing upon the streets,
sidewalks, or certain lots in the city of Santa Monica, which
bear seeds of a wingy or downy nature or attain such a large
growth as to become a fire menace when dry or which are otherwise
noxious or dangerous, are hereby declared to be a public
nuisance.
SECTION 2. That all rubbish, refuse, and dirt
accumulated upon streets, sidewalks, o~ lots in the City of Santa
Monica are hereby declared to be a public nuisance.
SECTION 3. That a public hearing shall be set for
March 26, 1991, at 7:30 p.m. in the City Council Chambers of city
Hall, to hear any protests in regard to this Resolution.

It is important to note that this early hearing does not preclude
or supplant the public review opportunity and hearing process
normally scheduled for May and June.
Budget struoture
The adopted city budget for FY1990-91 totals $174.8 million. The
budget is organized into twenty-four separate funds. For ease of
discussion, these funds can be grouped into three major
categories:
- Enterprise and Internal service Funds which operate much
like private businesses where the services provided are
financed primarily from fees. Examples are the Water
Fund, Solid waste Management Fund, and the city
self-insurance funds.
- special Revenue Funds which are used to keep track of
expenditures that can legally only be made for specific
uses and where the revenues come from specialized
sources. Examples are the Community Development Block
Grant Fund and the Beach Fund.
- The General Fund in which revenues and expenditures
associated with providing basic city services such as
POlice, Fire, and Library are tracked. Almost two-
thirds of the General Fund is financed from tax revenues
with the remaining revenues coming from various fines
and cost-offsetting fees.
Attached are a series of pie charts showing the largest funds as
well as the major revenue and expenditure components of the
General Fund.
Current and projected Financial Condition
At this early stage of the annual budget process, staff has
focused its attention on projecting the financial condition of
the General Fund because it comprises a little over half of the
total City budget; incorporates all of the primary services which
are most easily controlled by the City Council; and is most
